I met with customer, looked over his property, discussed drainage issues and retaining walls During this conversation, customer stated to me multiple times he had issues with a previous contractor he hired to do work for him and resolved it in court I presented a bid to customer; we discussed the job and his finances Because I felt sorry for him and wanted to help him out, I decided to lower my bid a substantial amount from the original cost while continuing to give customer quality work at high standards according to original bid rateNot only did I give him a substantial decrease from original bid rate, I also adjusted the payment plan to assist with his financial situation He was gratefulCustomer signed and agreed to my company’s written contract I went above and beyond to assist customer The final cost of the project with customer adding additional items and changes came out to be $28,823.00; customer was not charged this amount for jobDuring the years of my business, I never had a complaintI have finished the job as contracted Customer was present and hands on during multiple phases Customer would halt progress to measure, verify wall length and discuss job Customer was happy with resultsOn one occasion, customer did become irate, yelling and being very offensive I believe customer was trying to provoke me I maintained my professionalism, listened to what he had to say We had our discussion and customer walked away happyThe drain pipe is correct; we took it down towards the woods No rocks were left to cause a hazard I did use the quantity of straw blankets (customer refers to this as netting) that were agreed upon with customer in designated areasI made a recommendation to customer to use sod or additional straw blankets Customer refused to purchase either I generously put down an extra straw blanket at no cost to customer; customer was happyThe wall is correct length Customer measured wall during completion The wall length consists of new and existing stones We had to break down existing wall due to its condition, clean all existing stones by scraping to remove old glue and dirt, then stack existing stones to align properly with new stones.Even though customer continued to make multiple changes, I maintained the quality of my work at a high standard.During and at completion of job, customer stated to me and my crew of an outstanding job we did Customer was very pleased with the outcome.I have responded to his calls and letter We have spoken on phone and in person Once job was completed, customer was satisfied as he stated on last day of job and during a final walk through.Customer refused my preventive care recommendation to use additional straw blankets or sod and chose to leave an area open to the elements During the heavy harsh rain falls (Mother Nature/An Act of God) we experienced after the job was finalized and due to the customer refusing to add additional straw blankets or sod, light erosion occurredDuring a phone conversation and in person I explained to customer, since he refused my recommendation for this area, this is why the light erosion occurred I also reminded him there are no issues in the areas where we used the straw blankets and the water is draining accordingly.The customer is responsible for fertilizing and watering their property especially areas that are seeded.I have completed this job I have tried to discuss the issues over the phone and in person Customer doesn’t agree with my explanation and repeatedly stated, courts will settle it Customer had mine set from the beginning to pursue this in the courts.The issue customer is having has nothing to do with my quality of work The project was completed above 100%, in addition to me adding items at no cost to customer.I offered to put down dirt, seed and straw blankets at a reasonably rate Customer refused my offer and mentioned courts will settle it
