History of events: The home owner filing the complaint is an old man living in an old house adjacent to a new house ( [redacted] ) I am constructing He expressed his dissatisfaction for the fact we were building a large new home next to his small old home He told me he thought our modern house was ugly He complained about his fence starting to lean over as a result of the dirt from the trenches being dug for the utilities I told him we would take care of it when it was all over with He also complained about the mortar splatter on his brick when my masons were bricking the second story of our home Resolution of issues: When getting ready to build our fence, I offered to build him a brand new fence out of the same material and in the same way that his was built He said he did not want that He said he wanted his fence repaired We had him point out which post he wanted reset and which pickets he wanted replaced (He personally built his existing fence and was emotionally attached to it) We reset new post where he wanted them and gave him new pickets to install (he wanted to install them himself.) We cleaned the mortar splatter on his house After both these issues were resolved I asked him if they were done to his satisfaction and said yes....grudgingly Then he was quick to point out that the tree that is on our property but overhangs his, had some roots cut when the utility companies had to dig the trenches for the sewer line and electrical line He then went on to say he was going to document it and inform the new buyers what happened He then began to complain about the water from our property coming on to his since our house is built to current code and is higher then his I told him that was my concern also and why I wanted to remove his old fence entirely and give him a new one...it would allow me to redo the grade between the houses to help direct the water away from his....but again he refused His house has a wing wall on it that extends almost to the property line Where it stops, he has shrubs that extend to the property line I told him my second option was to take the our new fence line close to where we normally put it and I could have had a retaining wall built at the bottom like the rest of the fence but if I did that, he would not be able to access his side yard because his wing wall and shrubs block his way Instead, I stopped the fence short of where I normally do it so he could gain access to his side yard I told him my only option now was to put in a small retaining wall....he immediately said "no, I dont want that" I told him what other choice do I have? After a few minutes he finally realized that what I was saying was accurate With my fence guy there, we cam up with a plan to put a small retaining wall in so we could try to contain the water and direct it to the front or back of the property and avoid getting on his side yard This would allow him to cross onto our property to gain access to his house which is what he had to do before He was fine with this He should be or needs to send a letter retracting his previous complaint We have gone out of our way to make him whole or better then it was but was limited because his lack of trust or inability to understand what we were trying to do Let me know if you need anything else Thanks Best Regards, [redacted] Regal Homes Stone Ridge Homes ###-###-#### [redacted]
