Dear [redacted]:The persons making complaint are leaseholders of Lot #8 whom where given approval to place their mobile home up for sale and have the home remain in the park where located under a new owner; in other words, their home was in a condition that park  management agreed could remain in...

the park under a new homeowner.  The above mentioned leaseholders are the owner of their mobile home, while we represent owners of the land lot that they are renting for their home under the Lease Agreement, a copy enclosed.Under our policies as specified within the Lease Agreement management must approve all prospective residents before a sale can be consummated or the new owners would be evicted and obligated to remove the mobile home from its location within the park.A local realtor called our office and requested a park application for a prospective buyer on April 22, 2017.  Weeks later we were advised by the seller that a buyer was interested in purchasing their home and they completed an application for park approval; however, the seller's agent never submitted the application to us for park approval processing.  On June 6, 2017, the realtor told us that she had received a copy of the Buyers application.  She also told us that "she thought the buyers sent us a copy of the application' which never occurred.  Our office finally received a copy of the Buyer's application, dated May 17, 2017 from the Realtor on June 7/17, 2017.Both Buyer and Seller were contacting our office to see shy a delay of a month.  We indicated to all parties that we had never received an application and could not give approval without it.  On June6, 2017 our office manager started asking questions of Buyer to see if she could assist with getting approval started since they wanted to settle on July 15, 2017.  It was during the inquiry at this time, that we inquired about income, number of persons to reside in home, pets, etc.  The office manager indicated IN MY HEARING that our Lease Agreement specifies that we cannot accept applicants that have aggressive breeds of pets (Rottweiler, Pitbulls, Doberman, Charpeis, Chows) or any mixed breeds with any of these breeds in our park for safety reasons.  Upon discovery of a pitbull pet, the office manager inquired of buyer expectation for their pet, knowing that our park rules and regulations indicated that pets must be indoors at all times, unless on a hand-held lease when outdoors to do its business.My office manager also IN MY HEARING instructed buyer not to proceed with settlement without checking with our management office again to be certain that all charges, rents, etc. have been satisfied with seller and management.  Our policy is to never provide any amounts or indication of delinquency to a buyer or any inquiry without permission from seller.Now we have several issues at hand... first the realtor never sent us an application for the buyers.  The buyers are upset because they need housing imminently while understanding that they need park management approval and now realizing that they have a dog that is not permitted within the part, meaning they cannot receive approval to obtain a lease for the home that they desire to purchase and the seller (leaseholders) are upset because they thought they had an agreement of sle with the buyers; and threatening us with a lawsuit.  ALL BECAUSE THE REALTOR NEVER CARRIED OUT THE PROCESS OF OBTAINING PARK APPROVAL FOR HER BUYERS.And it is, my understanding, from the realtor that the purchase agreement of sale was subject fo part approval.It I can be of further assistance, please contact me.STONEMILL PROPERTY MANAGEMENTIrvin H.
