We pride ourselves in providing our tenant with good, clean, safe and well maintained properties to rent We also strive to provide a great living experience for those that rent from us This situation occurred some time ago so I will try to piece together what I rememberJust to clarify- All of our leases are in writing We do not place any tenant in a home without a written lease Anything discussed as part of the negotiating of the lease become written into the lease We do not make any verbal agreement to initiate a lease ***'s assertion that there was both a written agreement and a verbal agreement (at the beginning of the lease is not accurate) They may be times when a tenant calls and asks permission to do something or needs something or needs to pay a day late and asks to waive a late fee and we verbally agree to things like this but not upfront and never when we are signing a lease The mention of the $deposit plus a "$fee for I still dont know what for" was written in the lease and explained to them at the time of signing (The $fee is a "lease initiation" fee that we charge in all of our leases In fact, the lease shows a $fee and it is crossed out and reduced to just $ So obviously there was a discussion about this fee upfront before the lease was ever even signed.I do recall that [redacted] needed to move due to a medical issue with his wife's pregnancy Given their situation, I wanted to be helpful so I allowed him out of his contract and future financial liability in exchange for him assisting in finding a replacement tenant so that no rent was lost If he would assist in this, he would be let out of his rental contract and the future rent liability left on the lease I did also mention to him that I should be able to return half of his deposit to him provided that no rent would be missed with the new tenant moving in Everything went according as we outlined He helped secure a tenant, I approved him and moved them inThere was a delay in sending him the portion of the deposit that I promised him as the owner did not want to release any of it In the end, I sent him a check for $to the address he texted to me which was a PO Box in Salt Lake City I want to be very clear that I was very surprised (is an understatement) to have received this notice His claim that he has been trying to contact me for the past months with no response is just not accurate It gives the impression that he has been constantly and consistently attempting to contact me over the past months The last text, email or phone call that I show on my phone from him is dated more than months ago I was not aware that he had not received his deposit check and that there was still an ongoing issue To receive something out of the blue when we did our best to treat them better than any other company would have by letting them out of their lease months early with no penalty and to even return half of their deposit to them, I was shocked to say the leastI dont know where you will find another company that will step up and show compassion for a tenant and let them out of a lease early just to help them out due to a medical condition and a strain on their finances And then go above that and agree to return to them half of their deposit By the way, the owner held tight to his claim that they are not entitled to any deposit refund as they ended their lease early and letting them out early was good enough So I ended up cutting them a check for $myself (from my personal account) because that is what I promised they would get back I dont know what else they need from me but want to make things right for them and to protect my company reputation and my personal reputation.Sincerely,Scott [redacted]

I am rejecting this response because: I am now aware of what Mr. Scott's point of view is on my case. I am not sure if he changed his phobe number for the past so called 15 months which he claims he did not receive any of my calls nor messages. But my intention is not to harm his company's reputation but to make him aware of where in the agreement we had agreed on had gone wrong. I also consider myself an honorable person to my word and agreements. Sadly, health, in this case came first and for most and had to end my contract but I did everything Mr. Scott asked me to do in order to transfer my contract as smooth as possible so his company would not suffer any damage. I appreciate their consideration and willingness to give back only half of the deposit ($200) which I never complaint because I knew a contract had been altered. But sadly I never received this check. And obviously was never cashed. I am sure Mr. Scott has a record of that. With that being said all I want is for Mr Scott to keep his work and to try to mail this amount he agreed on once again hoping this time will reach its destiny successfully. My family and I are expeting our second baby; if we trully didnt need this amount of money we wouldnt have done anything to get it back. Due to the circumtances this issue is very important for us to be resolved in the best and most respectful way possible.If Mr. Scott would be willing to do this for my family and I, I will leave my email address where he can email me to arrange a time and date he can make this possible and where I can give him my current address.
