I hired Mr. Straub to complete an extensive remodel job for me in Orange Beach, Alabama. The project includes tearing off/replacing plywood/house wrap/siding, caulking/painting, replacing 2 sets of stairs, replacing some plexiglass Windows, replacing 2 roof areas and replacing an upper level deck and decking around a pool. We are approximately 9 weeks into the project that was supposed to take 4-6 total. We currently have about 70% of the siding complete, one roof partially done, one set of stairs completely gone and the only access to our home is up a partially dismantled set of steps to a chicken-coup like walkway and jumping over a hole on a second story deck where part of the decking has been removed. We have had leaks into the house where siding and trim were torn off an area about two weeks ago that have not been replaced. We have had to replace lighting and repair wiring where nails were driven into the electrical. We have Sheetrock damage. We requested pictures of all framing after old plywood was removed and before new installed to verify lack of rot and they just would not supply them. There is currently exposed wood where roofing material was torn off and not replaced. 90% of flashing has been installed incorrectly. Siding has obviously been installed by a crew with no experience. The quality of work is beyond inferior. Multiple items have had to be torn down after completion and redone with materials at my expense. Currently there are multiple areas incomplete with areas left uncovered and exposed to the elements allowing for a huge potential for water damage. My pool was used to support heavy lumber and scaffolding. The weight of the scaffolding plus the weight of at least 2 men on that scaffolding has caused my metal coping around the pool to bend and dent and the liner to slip. I have multiple pictures supplied from the builder showing considerably unsafe building practices including a ladder being used with the feet resting on board across the pool. I can supply pictures.

Thank you for giving us the opportunity to respond to Mr. in a professional manner. We are saddened and sorry that Mr. has decided to take this route with his claim.

We have been in business for 30+ years ,three different types of business without a single complaint to the Revdex.com.

In fact, my customer make statements such as "Thank you for being apart of our construction project. We are sitting here admiring and enjoying the work you completed especially for us. You were easy to work with and went above and beyond to make it perfect for us."

Mr.' house was very dilapidated at the time he purchased the home and when we became involved in the project. We start working on the house just to replace the siding. It became more apparent the conditions of dilapidation as we removed the siding. The wall to the outdoor kitchen fell over on it's own; simply by taking off the siding. The previous homeowner made "improvements" to the home without concerns to building code standards or if they would hold up over time. My team made a special request with the city for the two outside building to remain as they were not permitted with the city.

As we have been working on the house, The neighbors and city are very impressed with the work we have completed. We've heard multiple statements to the effect of "WOW! This place was quite dilapidated before you started working on it. I can't believe how nice it's turning out. You have guys over here working on it all the time even on weekends and really doing a nice job. Thank you for helping improve our neighborhood and city."

We have continually worked with the City of *** inspection team, 3rd party home inspector and the homeowner throughout the project to ensure the project was done to building code and customer satisfaction.

Received approval from City of *** for the duration of completed work and received City Approval for all work completed.

Received approval from 3rd party inspector for all completed work after each stage of completion. Paid for by homeowner.

Provided homeowner with 300+ pictures of current condition of original material before work started and completed work via text/email/hard copies.

We are currently in the process of placing a mechanics lien of $39,704.00 to recoup the investment we have in Mr.' vacation home. *** states "We currently have about 70% of the siding complete". He failed to mention approx. 20 other bullet points (ie. demolition and restructuring down to studs, remove & replace installation, install house wrap, restructuring of stairwell, hauled off all debris to city dump, removal & installation of three doors, raising & leveling of a building, installation of hurricane straps ,etc..) of work completed per our contract. Plus, 9 extra items above the stated contract; In which the homeowner agreed to pay at an additional cost.

Mr. has only paid 6% of the total contract including the extra's. Our contract states "payment will be made within 48 hours of request". At one point, he provided us with a check for $5,640 that bounced. We made several request in early April for payment which have not been resolved. On 4/29/19 we provided Mr. an invoice requesting $39,704.00 which has not been resolved.

We would like to move forward in a peaceful manner and recoup the investment we have made in Mr.' vacation home.

Let me first start by saying there is a huge difference between a check bouncing and payment being stopped for non-performance of agreed upon work being completed by a certain date. I gave Mr. a check with the agreement that the following day a certain issue would be completed. I have cameras on the premises and was able to verify they never showed up the following day. At that point, I stopped payment on the check. Once the correction was made, I released funding. We have actually paid Mr. over 22% of the total contract amount. There are no change orders to the contract.
Next, we have a written 10 page contract signed by both parties that includes his scope of work. The items that he calls "extras" are in his scope of work included in the contracted amount. At no point throughout the process did Mr. state that there would be additional charges or request change orders to the contract.
As far as the neighbors being pleased, they took a man lift that we had rented and a dump trailer into our neighbor's finely manicured yard. The neighbor was not happy and several phone calls were made. They were asked not to reenter the property. Also, the repairs do look nice from the end of the driveway. It's once you get up close to house that you see the inferiority of the work.
We hired a third-party inspector to take progress pictures and help us access the percentage of work complete since we are not local to the area. They gave no approval to *** at all. Their documentations will be supplied to our attorney if this goes to court. They even provided us with a reference to replace Mr. with once we saw he had no intentions of fixing and completing the project.
I will agree that Mr. sent us multiple pictures. Most of them were of areas that were not of concern and were unimportant. We were not provided pictures of the areas we requested to show there was no rot before installing new plywood in certain areas.
I have addressed his statements, but please note that in his response he never addresses and responds to the claims we made about the quality of his work or his safety practices. His response is typical of dealings with him and is all "fluff". He never gives a straightforward response. If I told him that the siding nails completely missed the studs (which I have pictures to support), his response would be to ask if we had selected a paint color yet.
Our house was definitely in need of work when we purchased it, that's why we hired Mr.. For the contract price, which was in line with other contractors we got estimates from, we expected to have the work performed correctly with attention to structural integrity and with an acceptable cosmetic appearance. Of the 70% of siding they completed, we are having to pay another contractor remove and replace over half of it because of flashing and siding that has been installed incorrectly. During our last walk-through Mr. acknowledged these deficiencies and blamed them on his employees and sub-contractors. I would be more than happy to supply pictures to support my claim of sub-par workmanship and safety issues.
