to the above mentioned complaint.The complaint submitted by the home owners is very lengthy and mostly covers issues that have already been addressed or concerns they have already shared regarding their experience. To our knowledge, and judging by their correspondence, the only item they believe to be outstanding are the “dents and creases” in their garage door. In accordance with the suggestions for a response on your website, we are providing the below points to address the items we believe require our comments. In an effort to keep it objective, we are responding in point form.1. Garage Door Dents and Creasesa. Please reference the attached Construction Performance Guide from the Alberta Government’s Department of Municipal Affairs – these are the standards that are used to conclude what is a deficiency under the New Home Buyer Protection Act and what the appropriate fix is to rectify a deficiencyb. Please reference section 6.18 which is on page 146. The garage door issue that has generated this complaint was not document on the walk-through inspection. We believe it was not documented at that time as either the damage was not present at the time of the walk through or it was so minor that it was not even noticed.c. In either event, although it was not noted on the walk-through inspection, we offered the acceptable repair to the clients as noted on page 146 which is the filling and painting of the dents. Please see the attached one year inspection form signed by the owners where we have noted that the garage door would be repaired, not replaced. To my knowledge, we did not receive a response from the home owners on our proposed repair.d. According to the performance guide, these very minor dents do not warrant the replacement of the entire door. In fact, most of them are so minor it hardly makes sense to fill or paint them either. We have already extended the offer to fill and paint these dents which is the prescribed fix under the performance guide. This offer is beyond what we are obligated to do as it was not reported to us until after possession.e. In addition to our own interpretation of the performance guide, we also consulted with Alberta New Home Warranty who is in agreement with our decision on the issue2. Garage Door Operationa. There were some issues with the operation of the garage door which to our knowledge havebeen resolved.3. Garage Door Windowsa. The owners did pay the extra $575 for windows in the garage door which they did receive as canbe seen in the attached picture. Also, they did pay extra for the upgraded door opener whichthey did receive.4. [redacted]5. [redacted]6. [redacted]7. Lumber and Materials on Sitea. Construction materials are always present on a construction site. During that time we are theowners of the home, the lot and the materials. How and where materials are stored on a site canchange several times each day and while we try to mitigate any damage on site it still can occur.Our obligation is to turn a home over to our owners on possession date in accordance with ouragreement and the performance guide, not to be answering for where every piece of materialmay or may not be at any given time through the build. When damage occurs we note it duringconstruction or as part of the pre-occupancy walk through and then undertake the prescribed fixas per the performance guide to rectify the issue. [redacted]8. Meeting With the Home Ownersa. The complaint only noted that we refused to meet with them in our email dated November 5th,2015. What they neglected to mention was that we had already met with them three times,twice in our office and once on a weekend at their home while I was on site. During thosemeetings the owners were more interested in leveraging their negative experience in an effort toreceive new items or compensation in lieu of items as opposed to discussing the outstandingissues in a reasonable manner. Further meetings were declined as these earlier meetings werefound to be non-productive and the interactions during those meetings were deteriorating ourworking relationship. After those first meetings, and other inappropriate interactions withmembers of our team, we concluded the only way to stick to the facts and bring each item to aconclusion was to communicate by email.9. Our Owner Bindera. We are not sure why referencing our home owner binder adds any relevance to the complaintbut the statements found in that binder are not unfounded. We conduct third party surveys thatgo out twice to all of our home owners. Overall, our owners give us positive feedback on theirexperience. Please see the below link for our results:http://homeownermark.com/builder/streetside-developments-edmonton/While we are not perfect, an overall score of 8.3/10 on over 198 reviews puts us amongst thebest in our industry. We put a lot of pride on taking care of our home owners and it shows in theresults.In addition to the documents relevant to the points above we have also included a letter that was sent to thehome owners at the time of the one year inspection that includes more correspondence on the garage door aswell as some of the other items they have noted in their complaint.In summary, we believe that we have met or exceeded what is required of us by the purchase agreement we havewith the home owners as well as the performance guidelines set out by the Province of Alberta. To our knowledgethe only item the owners are saying is outstanding is the garage door to which we have already offered theappropriate repair with no reply. Our response to their complaint through the Revdex.com is the same as when theybrought the complaint directly to us, their concerns regarding the garage door do not warrant a new garage doorand because of that we will not be providing one or compensation in lieu of one. A significant amount of time haspassed since we offered the approved repair to which we received no direction and with that their file has beenclosed.
