out by the customer for an annual package. She has agreed with me about that. I have never stated she signed a monthly contract (if she had we would not have this problem as you can read in the contract that she filled out and read and signed) monthly contracts are stretch sessions at a higher rate of payment and can be cancelled with a 30 day written notice. We have a large sign at the front desk that indicates in large font and bold there are no cancellations of contracts. the language in the contract indicates we will bill for 12 consecutive months no matter what. There is a clause at the end of contract which indicates 2 specific situations in which the contract will be cancelled/changed and those are death or injury with a doctor's note.

I offered to suspend her account while I looked into a suitable solution. The offer was refused. Instead she has posted on the internet that we have committed fraud. There is no fraud except by the customer that has received services and after payment has had the payment withdrawn temporarily. The next step for us as a business is to file a police report for theft and proceed with civil action.

The customer filled out, read, and signed the annual contract of 12 months of payments at $195 per month and we have billed correctly. We will take any and all legal action(s) necessary to collect payments owed us.

During a recent discussion with staff there. Apparently I did not respond to the 3 rebuttal from The customer on this complaint filed last summer.

We resolved the customers complaint and have her accepting the compromise in writing.

I tried to log back into the complaint but could not. Expired link

Review: On about August 10, 2014 I signed what I believed to be a an annual contract for $195 providing 16 stretch sessions over the course of a year. I noticed on September 6, 2014 that my credit card had been charged a second time in the amount of $195 on September 1st. I called the company that same day and was told a manager would call me back. No one did. I called again on Sunday and there was no answer so I sent an e mail and still received no response. I flagged the second charge as fraud with my credit card company on Monday morning September 8, 2014. Later that afternoon, someone claiming to be the owner of the franchise, Joe Horton, called me. I explained the situation and he said that I had signed a monthly contract. I said I signed a one time annual contract. He said he would talk with the salesperson I spoke with (Connor) and get back to me. On Tuesday 9th he left a voicemail asking for my e mail so he could send me a copy of the agreement. He sent the agreement and I had clearly checked "annual" and not "monthly" however the wording in the agreement is very misleading and uses the words monthly and annual in the same sentences. I pointed this out and explained to him that it was clearly my intent to sign a one time annual contract. My husband was standing next to me when I signed the contract and verified the conversation that took place between the salesperson and I. This Mr.[redacted] proceeded to bombard us with unprofessional and bizarre e mails and to claim that the contract was not cancelable or refundable. I asked that it be cancelled immediately. I have flagged both charges now with my credit company but continue to receive threatening e mails from Mr. Horton. I have explained to him that we are happy to pay for the sessions used but want no further dealings with his company because of this very unpleasant experience. When we researched this company online we found that the exact same thing had happened to other unsuspecting customers.Desired Settlement: Cancellation of the contract and refund of all money.

Review: I signed up for a package deal of $49 for 4stretches a month.I asked the person signing me up ([redacted]) if I could cancel anytime I wanted.she stated yes I could.I would have to go through [redacted] (Owner)he could help me. Due to my work schedule and location It would be difficult to continue to go to my sessions. When I called to cancel,[redacted] informed me I had signed a year contract and that there would be an additional fee of over $251 for services I have not received.I want out of this contract and be done with his establishment.personally I would think he wouldn't want me returning to his establishment. I felt none of the fine print issues were ever disclosed,or I certainly wouldn't have signed up.Desired Settlement: I would like the contract terminated and my $49.00 back..My promise in turn is never to return to his establishment.
