On January 7, 2020 I accepted a free introductory "stretch" that was being offered at my gym which was strenuous at the time it was done but generally nice so I signed up for a series of weekly stretches costing $169. However, later that day I had significant muscle pain and then experienced a back injury when I coughed (a compression fracture of a vertebrae) that caused me to have severe and persistent muscle spasms. It was unclear how the generalized muscle aches, the back injury and the muscle spasms were related. However, after a week of pain it was clear that I would not be able to use the stretches I had signed up for and I called to cancel my membership. I was told that I would have needed to cancel within 3 days for a refund. Here is an email I was told to submit on Jan 18, 2020
Hello ***,
As we discussed on the phone I have an injury that seemed to originate when I had an introductory stretch on Jan 7, 2002. I was initially aware that I ached all over. Later in the day I coughed and felt a9and heard) something snap in my mid back. This was very painful and the pain has progressively worsened. Initially I assumed I pulled a muscle and that would heal in a few days. I cancelled the stretch I had scheduled for 1/11, and cancelled all my game appointments for 2 weeks. The pain has not improved significantly and at this point I cannot lift even a quart of milk or reach with my right arm, twist my upper body, etc. It is even difficult to dress or tie my shoes. I clearly cannot use the stretched membership and am asking that it be cancelled and my payment be refunded. I am NOT accusing anyone - my back has had problems for years. But I don’t think I should pay for a service I cannot use.

I did not receive a contract at the time of signing up nor was I told about this 3 day cancellation policy.

This client purchased a membership at a pop-up event we held at her gym in ***. She filed this complaint before completing resolution with us. She had a signed agreement for the membership and manager needed more information to process. This has been processed BEFORE receiving this complaint. This has been settled to satisfaction and no complaint should be filed for us. NOTE: The gym was ***. We are STRETCHMED Studios.
