Review: Strictly Mobiles sold my mobile home. Escrow closed 1/23/14. [redacted] was aware that the home was to be sold "as-is". When he wrote up the paper work it included a home warranty for $345.00. There were 2 pages and I did not see the home warranty when I signed the paper work. When I saw the home warranty fee in the escrow papers, I contacted [redacted] to let him know I didn't agree to it. [redacted] showed me via email that I signed the 2nd page and this fee was on the first page. I told [redacted] it was not my intention to pay for a home warranty because the selling price of the home was extremely low. [redacted] agreed to pay for 1/2 of the home warranty. He said he would mail me a money order right away. My brother and sister-in-law lived in the home and paid their park rent at the beginning of January for the whole month. [redacted] said if escrow closed before the end of the month, there would be a pro-ration. [redacted] said there is an amount due to us of $82.00 (the difference between the overpayment of rent and the ending utility bill). This is a total due us of $254.50.I have called [redacted] and left approximately 20 messages. He does not call back. Sometimes he will text me and say he's busy and will call me back and that doesn't happen. I am extremely frustrated with this entire process. Not only the money he owes, but also, he didn't follow through with phone calles, most of the time he would send potential buyers to view the home without being with them. I would like the money due and I would like this to not happen to anyone else. Thank you for your help!Desired Settlement: Reimbursement for 1/2 of the home warranty of $172.50 (agreed by phone conversation and text messages).Reimbursement of $82.00 (pro-ration) The difference between park rent paid and utilities due.

Hi My Name Is [redacted], and I have been working with Strictly Mobiles for over 3 years now and have been in the Mobile / Manufactured Home sales industry for 15 years plus. This is will be the first time I have had to respond to a complaint to the Revdex.com. So needless to say I am shocked. Furthermore that it is this particular client/ deal that I am having to answer too. To make this is as easy as possible I am attaching signed documents by [redacted] and/or her buyer for 1750 W. Lambert Rd #120 La Habra, Ca 90631 "View Park". Please note: there is no language that says "as-is". anywhere. In addition , in every escrow the Owner of Record has to sign a document called a "Beneficiary Demand-Registered Owner" for purposes of Closing Escrow. Attached herewith is a copy; You will note [redacted] signature on several lines. One of which acknowledges the $345 made payable to BPG Home Warranty for the one year home warranty . [redacted] mentions a "[redacted]", [redacted] Brother who has been residing at the address of the home Sold and that is registered to [redacted]. Only the registered owners can sign these legal documents. [redacted] has asked that I would consider offering half of the BPG Warranty money, because she says she cannot afford this and had to pay back to [redacted] her brother. I am highlighting this particular action because it is only out of an Act Of Kindness that I offered to help [redacted], and I had mailed her a check in the amount of $173, just a little more than half the overall cost of $345 dollars.

In terms of the $82 dollar refund eluded too in [redacted] complaint . How parks handle the pro-ration on space rent and /or utilities depending on what day escrow closes and what day final meters are read. Parks vary on how this issue is handled. Many place their own Pro Ration Demand into escrow so that escrows pays for this, and others like View Park here like when Buyer/Seller work out the details with the Managers assistance. This is not an area that a Sales Agent represents or focuses on. A Sales agent may inquire and inform buyers and seller to contact the Manager " [redacted]" . Which is the case here. I believe because [redacted] The Registered Owner who does not live there and has not lived there for many years and [redacted] Brother, [redacted] who has lived there and is not on the Loan or Registration may have not felt comfortable dealing direct with management, but this would not prevent [redacted] from being able to call management as instructed.

I [redacted] am under no obligation financially with respect to the BPG warranty amount or the final Pro Ration of Utilities. Again it was only an act of Kindness. In terms of complaining about calls and returned calls . In light of the fact that [redacted] lives in Tennessee and was not interested in traveling to California to handle the sale of her home, for what ever reasons. I made it clear that we would have additional challenges on signing paperwork, and much of it would be emails, faxes, overprinting etc.. [redacted] and I have had substantial conversations vie phone calls , emails, texting, and some communications thru her brother [redacted] who lives here in California. So what is offensive here and skirts slandering is he fact that she wants this money she believes is due her, and it was only a kind gesture, that the calls or messages that she says were as much as 20 to my phone is an exaggeration and literally is only an attempt to get more money out of me. As mentioned I mailed a check in the amount of $173 dollars.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I was assured that at the close of escrow there would be a proration of the utilities and park rent. I was asked by [redacted] in a text message if I thought my brother (who lived in the home) would let the $82 go. I told [redacted] "no". It was an overpayment and was due him. [redacted] said he didn't want to have to eat that money. After I wasn't able to get the proration from Strictly Mobiles, I went to Santiago Homes, Park Management Company and was told that was between me and the buyers. Since Strictly Mobiles was the representing me and the buyers, I went back to [redacted] and as of yet was not able to get this resolved.
