Mr*** was sold a bed with a year limited warranty which only covers defects in labor or materials.The problem that Mr*** has is simply wear and tearHe bought this bed in ALL foam does get softer over time.The first contact that I had from Mr*** was on 8/26/and was a
phone conversationI did email him a response on 9/12/after checking with managementBelow you will see the email that I sent:Hi ***,My apologies for not reaching you this weekendI did not end up seeing MrStrobel on Friday evening. I was able to meet with him this morningHe had said if you unzip the cover you will probably see that it is the top layer that you will need to replaceThis just happens at times from wear and tearIt is not a defect in materials or workmanship.However, he can replace your top layer at the wholesale cost and give you free shippingThe wholesale cost on the 3" Premium Memory Foam is $535.54.I do have this in stock right now so let me know if you would like to have this processed right away.Looking forward to helping you!We have had a Federal Judge rule that this kind of issue is wear and tearYou can see the information below:Federal judge ruled foam not covered by warranty, but instead is wear and tear: UNITED STATES DISTRICT COURTSOUTHERN DISTRICT OF INDIANANEW ALBANY DIVISION Case 4:06-cv-00002-SEB-WGH Document Filed 09/12/2007 We have tried to resolve this issue as you can see. The only reasons it has taken this long for this issue to be addressed are that the selling dealer, and now the manufacturer, have stalled the process. To add insult to injury, the manufacturer is now attempting to hide behind a court ruling from another customer who actually went through the time and expense to take them to court.Mr Strobel's response is, or should be, an embarrassment.
