This letter is in response to to complaint ID#*** it is our position that we are not at fault nor responsible for the items outlined in said complaintOur position in this matter is that we have bent over backwards for this client on two different occasions with two different very
inexpensive vehicles trying to help out someone who wanted a temporary vehicle until after the first of the yearThe client was informed numerous times through out the process that we as a dealer cannot guarantee this type of purchase if for no other reason that a mechanic cannot x ray every part on the car the safety check is visualIn the first case the vehicle was safety checked and the oil changed the customer took delivery of the vehicle and called back later that day to complain about a wobble upon acceleration of the carOur mechanic based on replacement cost to do the job properly said it would cost $dollarsLet us be clear this is an issue that the client is over exaggerating the name of the part is not a death sway that is a term that someone gave it on the internet but I guess it makes for better dramaThe proper term is rear upper control arm bushings or lower trailing arm bushings and there has never been a safety recall on this part from InfinityThe client took the vehicle to someone else and had the vehicle repaired, and a short time later the rear wheel did fall off the car and upon inspection that is the exact wheel that has a brand new trailing arm on itThe client denies that the wheel had never been off the vehicle yet claims that that problem was repaired for $but that is not correct as you would need to take the wheel off not to mention that the mechanic also told her that the car needed brakes again a diagnosis that requires removal of the wheelsAgain we are talking about an As Is Vehicle but to be helpful we picked out another vehicle a Santa Fe that we had one of our mechanics go though as much as humanly possible as far as doing brakes and even check everything to the point of changing window wipersI showed the client the complete check and how thorough it wasSo now the client is in a four year newer unit with eighty thousand less miles again explaining that with that in mind we still cannot x ray the vehicle and she would be better off getting something a little nicer that we could have better idea on its dependability but we would have to finance through a regular bank as we don't normally finance so we can only do the less expensive cars and the client refused saying that she had other things going on financially and did not want to go that route and wanted just a vehicle to get to and from work and again took deliveryOn 11/25/I was contacted that the vehicle was broke down on the south side of Chicago and to come and get it, now mind you we have no responsibility to do anything as we sold the vehicle as is and shown with no warranty! But again in the interest of customer service we spent $to have the vehicle towed because the customer refusedNow here is the ridiculous part, the client is the owner of the vehicle and had the car been impounded she would be responsible for all costs and since we are the Lein holder on the vehicle we could pursue legal enforcement against her for all costs of tow, impound, and all money owed on a binding legal contract for the purchase of the vehicle without even one payment madeBut again we have not done such as we are the ones being reasonable in this matterWe have tried to reach out on numerous occasions to try and settle this once and for all to no avail we cant even get her to return the keys to do a diagnosis on the vehicle as she just says she doesn't want the vehicle and a full refund of her down paymentLet us review the situation we believe it was her mechanic who left the driver side rear wheel lose causing the wheel to come off, we paid for the repair but the customer did not feel comfortable in the vehicle so we then forgave the contract on the first vehicle and paid repair costs plus applied all down from that vehicle to a four year newer vehicle with 80,less miles and never even received one payment, payed for tow from ChicagoIt is our stance we have gone above and beyond to help this person and now because of her inability to talk to us reasonably we due not owe a settlement of any kind, as a matter of fact the client owes us the balance of her purchase contract
