I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The response made by Stuart Landscape is of course not acceptable.  They offered a two year warranty on the trees that they sold us at an extremely high price. We thought by going with their company we would receive the expertise that they had to offer insuring that these trees would survive long term.  At this point four or five of the trees definitely need to be replaced and should be replaced under warranty.  We had trees that were planted three and four years ago by a company out of the valley who stood behind that product and replaced those trees as their warranty stated. I believe it is difficult to grow trees in this area because of the sandy content of the soil.  We are not tree experts and Stuart Landscaping say that they are.  We began watering when we believed that they needed watering and received no input from Stuart’s on when that should be even with the large investment that we made and the potential risk that they hadwith their warranty.  Of course, not much risk if you are not going to stand behind that warranty.  We will have no alternative but to take legal action against Stuart’s at this point which I believe we will eventually prevail.  It is unfortunate that it has to come to this but for the cost of the trees and the amount of work that we have put into our property it is our only alternative at this point.Even with the fertilizing that needed to be done we didn’t hear back from Stuart as to what we should be using and when we should be doingit.  I assume they have too many other proposals in the works to take the time to work on our project since we did notgo with them on the larger portion on the landscaping that was needed.  I wish there were an alternative to resolving this but unfortunately it appears there is not and the only ones that win in litigationare the attorneys.  But I guess that is what they are there for.  Thank you foryour help.[redacted] [To assist us in bringing this matter to a close, we would like to know your view on the matter.]

Review: Review: Late last year we purchased over $15,000 of developed Maple trees from Stuart Landscaping and Garden Center. When we purchased the trees we were told that the trees would have a two year replacement guarantee in the event that any of the trees died. These were planted late last fall just before the ground froze in 2014.

Beginning in the spring we noticed that we were going to lose 5 of the approximate 30 trees that were planted on our property. These are full grown 3-4” diameter trees. We contacted Stuart Landscape and their sales rep Brain [redacted]. Mr. [redacted] came out to view the trees and advised that he would be replacing the ones that were dying and we would have to wait and see how the others did over the rest of summer and possibly into the next year before deciding anything about those. At that time Mr. [redacted] advised that the trees likely needed some fertilizer and root stimulate which he advised that he would provide us with a plan and recommendations. We did not hear from him again after several inquiries for over three weeks and then received a letter from the owner on July 1st advising that they would not be guaranteeing their trees has they had stated both verbally and in writing that they would. Their feeling is that we lose the majority of the trees if not all of them and they’re blaming us for not watering the trees even though they were watered properly beginning in the early spring. I feel this is a case of “sour grapes”. Our entire landscape project involved extensive landscaping on our property and Stuart was not awarded the majority of the bid and they were clearly upset on one of the site visits where Mr. [redacted] visited us.

Stuart’s advised us in their letter that they had another expert come and evaluate our trees and tell us that we would lose all these trees and they would not stand behind them. The reason that Stuart Landscaping did not receive the rest of the contract is of their outrages pricing. We had gotten two other quotes and Stuart was 100% or more than one quote that we received and 200% more than another quote for the same landscaping project (A large patio with many extras).

Our new tree experts advises us that with the exception of the five trees that the trees are all likely salvageable with proper fertilizing and stimulation, which is the plan we never received from Stuart. At this point the only way we feel that this can be settled is to refund our money in full on these trees since Stuart feels they are all going to die and not stand behind them. In the letter they sent to us dated July 1st they advised that we did not water the trees properly even though in the same letter they stated that they had no idea when we began watering. There are various types of soil in our planting area with allot of sandy soil which they (Stuart) stated they are aware of. We watered all the trees the same even though they stated in their letter that we clearly watered two of the trees more which were a different type of tree in different soil and were all watered the same.

Stuart had recommended a specific type of waterer which is supposed to trickle water on to the trees, however in our internet research we found that there were many failures of this watering system. We spend even more money on a more sophisticated watering system to ensure the trees would have the best opportunity for survival.

Stuart needs to stand behind their product and their words (guarantee).Desired Settlement: Stuart needs to refund us for the entire cost of the trees or stand behind their guarantee as promised.
