I lived in Fulton Place Greensboro, North Carolina, apartment ***. I am writing this in regards to my short term lease, for which I have been inaccurately charged. The property manager is claiming that I must pay a “back-pay” amount which has been recently added to my account. My lease specifically says a one time fee of $75 for short term lease, yet they are charged me $375.I paid what was asked from me by the lease agreement of a one time fee of $75, but not the $300 back pay fee that I allegedly owe, due to fees that I was unaware of and that are not clearly stated in the contract. The remainder of the balance should be cleared and I should receive a refund for the $300. The contract does not clearly support the property manager’s claim that I was required to make monthly $75 payments; nor was this explained to me at the time of our agreement. Furthermore, the leasing agreement was written incorrectly; it states that the leasing term is 6 months but the dates written on the agreement suggest that the lease term was to exceed a year. The lease incorrectly states that I agreed to a lease from August 2019 to December 2020. This is clearly far more than a six month lease. I was told that the apartment complex does not even offer leases that exceed 12 months because this is a student housing. Based on the apartment management’s performance, one could argue that they have waived the right to receive payment of the alleged fee, because I was allowed to pay the same fixed rate which each month, with no mention of unpaid fees, and I also relied on this set payment as I budgeted my finances. I emailed corporate several times with no response. This company is taking advantage of students in this complex and stealing student’s money ultimately being a bully. When I addressed this issue, the manager that I spoke with reacted unprofessionally, which I feel is inappropriate. He continued to abruptly interrupt me, spoke on the phone with him, and ultimately hung up in my face. This has led me here.

My name is ***, and I recently lived in Fulton Place Greensboro, North Carolina, apartment ***. This is regards to my short term lease, for which I have been inaccurately charged. The dates on the lease are invalid, however, the manager was aware of the error and signed off on the lease to continue as a short term lease agreement. The property manager is claiming that I must pay a “back-pay” amount which has been recently added to my account for signing a short term lease. However, the contract states that I am only required to pay a one time fee of $75, which I was never charged for. By abiding by the lease agreement, I paid the $75 and excessive utilities fee on Jan, 9, 2020. But not the $300 back pay fee that I allegedly owe, due to fees that I was unaware of and that are not clearly stated in the contract.

Additionally, the release document that I received when I moved out is also incorrect because the dates say August 2019 through July 2020. I moved out on Dec. 31, 2019; therefore the release document should be changed accordingly. I brought this error to management’s attention, but no one in the office has yet to send me a corrected release document. I need a release document with the correct amount issued. The manager never responded to me for the appropriate changes needed. This issue was just resolved two weeks ago by a associate who had only worked their for 3 days and was not aware of how I was treated previously.

Also, when I addressed this issue, the person that I spoke with reacted unprofessionally, which I feel is inappropriate. He continued to abruptly interrupt me, as I spoke on the phone with him, and ultimately hung up in my face. This is very unprofessional behavior for a corporate employee. I spoke with Ben ***, who stated that he would resolve the issue by Monday, Jan. 6. However, he has yet to contact me. I have called multiple times to try and resolve the issue, but each time I have to repeatedly explain the situation and am eventually told that “we will call you back”. This ineffective communication has led me here. Please contact me at your earliest convenience to resolve this issue. Recently, I have paid the $300 dollars because they were not responding to any of my concerns or issues, so they could put me to collections. This is issue has caused much inconvenience in my move for my new job in Washington DC. The company continued to avoid all contact because they had the authority to make a derogatory mark on my credit. They are taking advantage of their authority position as a landlord. I would like my refund of $300. I have the cashier check receipt with the full amount. Thank you.

I am rejecting this response because:

The amount of $604 should have been paid one time due to the description of the short term lease fee. The charges of a short term lease is a one time fee of $75 which should have been paid only one time not consecutively. No where in the lease agreement does it say “consecutively” or “monthly” for a short term lease. The wording of “monthly fees” is worded in some descriptions;however, not apart of the short term lease agreement. The manager charged me consecutively for my ending statement which is not in my lease agreement that I signed. I paid the one time fee; therefore I would like a refund of the remainder amount of $300.
