Stutts Trucking company promised refund for incorrect delivery for 23 commercial truck tires for our export in August 2014 to [redacted]Stutts Trucking company switched out the tires I originally paid for without calling or making me or my Director sales aware of it, he took it upon himself to switch tires out stating that it was the same, my buyers in [redacted] did not buy the merchandise that was sent because of the condition of the used tires, pictures were sent to me, the tires were not 315 80r 22's and plus wires were sticking out of the tires, the tires were not sell-able and have damaged my relationship with my [redacted] business partners. I made payment of $8,625.00 to Stutts Trucking account via direct deposit through my payroll once the order was placed for the tires. Once the tires were delivered in [redacted] I called [redacted] and we discussed a plan and he stated that he would refund me $1955.00 for those incorrect tires, I emailed him and also spoke with him regarding what he needs to do and to deposit the money in my business account, [redacted] Stutts was continuously making excuses regarding the deposit and eventually he stopped taking my calls. I sent a certified letter with signature on Jan 12, Mr. Stutts signed the letter and a signature card was sent back to me, again Mr. Stutts failed to make a deposit in our business account or send a certified check to me . I have a copy of the invoice regarding the tires which said 315/80R 22 with the pricing and the amount of tires to be delivered. We had to incur cost of shipping which was greater than $5000.00. Legal matters will take place if this is not resolved immediately. I have given Mr. Stutts more than enough time to refund my money back. I even called him and stated for him to pay half of what he owed and the other half the following month, but no response.Desired SettlementI am seeking my refund back of $1955.00 plus shipping cost of $5085.00. The tires are just sitting in [redacted], [redacted] because they cannot be sold, due to the damage that Stutts Trucking company has caused for [redacted] Mr. Stutts also stated that he received the email with the Banking instructions on there.
