Subaru defective short throw shifter

On 4/5/23 I was entering the gated community where I live stoped pressed remote to open gate then with clutch engaged shifted my wrx into first and the entire steel shaft broke at base where pin secures shaft to linkage this is a wrx sti short throw shifter pn C1010VA001 which is 445 dollar option which is supposed to improve reliability performance

The dealership Subaru of Ontario
told me the defective steel rod at shifter assembly was not covered under warranty and said that broken shat was caused by me and are price gouging/extortion a 300 plus dollar part that sells on their website to me for 1,200 dollars

Assuming the half inch shaft is medium steel with 0.5-0.6% C as per BS 970 STANDARD.IT
This has tensile strength between 500-800Mpa.1 inch diameter would take about 56,000 to 91,000 lbs. Subaru is saying after a year of 19kmi wear that the half inch steel shaft can easily be broken by a 59 year old seinor citizen such as myself

Basically Subaru is admitted that shifter is made of an unsafe material in which can be easily broken rendering the vehicle inoperable if on freeway the results can be catastrophic

That being said

Since subaru corporate doesn’t cover warranty I would like refund and parts sent to NHTSA where I filed report based on SOA saying the steel shaft is vulnerable to damage and should be of high tensile medium carbon steel

Revdex.com,

When the customer came in for his service he asked the service advisor to install the customer supplied parts, customer stated he left all the parts on the front seat of the vehicle. All the parts where not on the front...

seat of the vehicle, he left 2 of the parts (the tensioners to the timing belt ) in the back of the vehicle where you couldn't see them.. After finishing the job the customer came to pick up his car saw the parts still in the trunk and questioned the advisor why the parts where not installed and the advisor kindly explained to him that he only installed the parts that where left on the front seat and not the parts that are in the back of the vehicle, we don't go looking through customers vehicles for additional parts to install. The tech brought the vehicle back into the shop and proceeded to apart all the work he had just done to install the customers timing belt tensioner's that he forgot to leave on the seat as described on his invoice, which by the way was done for free even though the customer failed to put all the parts in one location for the tech to have. The customer then brought to my attention that there was a couple of very small scratches on his Aluminum radiator and one nick (does not affect the performance). I sent the radiator out to have scratches removed and the nick repaired, I also had to pay for the customers lower and upper radiator hoses even though only the upper hose was slightly scratched but can only be bought in pairs for some reason. I reimbursed him the cost of both radiator hoses $118.00 and paid to have the tensioner's installed that he failed to give us, cost me $225.00 labor. I paid to have the radiator scratches removed and polish the aluminum radiator 125.00. I told the customer if he didn't like it I would send to another shop to have them re polish and we agreed, then the customer calls me on a Sunday out of the blue 2 weeks later and demands that I pay for a new radiator that he can live with the simple tiny nick you can't see. I declined as this is not something that will cause the radiator to stop working. I again offered to send to have re polished and the customer said no I want a new radiator. I again kindly declined to do that, it is only cosmetic and it is not affecting the performance of the radiator. The customer and I spoke about the processes I would take and we agreed and now I believe he is taking advantage of my good nature. I have done everything for this customer I am going to do. I had the BAR out here investigating the case as well and he told the customer the same thing, there is nothing wrong with the radiator and the company did as much as they could do for you under the circumstances. Thank you.

Good afternoon! I have left a message for this customer. I do believe that we have resolved this already. I have not seen the customer come back nor a phone call. I will do whatever we need to do to make this right.
