re: complaint#***Dear ** ***:As per the request of ** ***, Swim King Pools, will offer to install a 4’ x 8’ precast drywell with a flat cover to satisfy this claim and to satisfy the Town of Southold Engineering Department In our defense, the information we received from the Town of Southold Building Department was incorrect We were told after the permit was issued that a drywell was required for construction of your poolWhen we asked about the size of the drywell, the building department employee informed us that the drywell was not subject to the engineering department’s specifications because the property was not subject to storm water management guidelines We have since been informed that the information was incorrect and that a ’x 8’drywell is required. The new drywell to be installed is intended to handle pool backwashing (approxgallons of water in a typical minute backwash cycle) Drywells are not designed to handle the capacity of an entire pool nor is it typically able to handle the draining of rainwater that collects in the pool The maximum capacity of a 4’ x 8’ precast drywell is gallons Swim King cannot be held responsible for any effects of overfilling the drywell (ground settling, etc.)Swim King will install the 4’x 8’ drywell requested and will plumb lines to the multiport valve No plumbing will be installed under the current patio Conditions of the drywell installation: Homeowner agrees to provide ingress and egress to and around the area of the pool site for all Swim King’s vehicles and equipment Homeowner shall be responsible for any obstructions or items interfering with the installation of the drywell Some obstructions include but are not limited to: damage to grass, planting beds, Belgian block, curbs, sidewalks, driveway, sprinkler lines or any other buried lines. Swim King Pools cannot and will not be held responsible for current patio settlement The drywell that was originally installed, as per Town of Southold Building Department, was not intended to handle more than the gallons of water that is typically discharged during a five minute backwashing cycle Upon acceptance of these terms by ** ***, we will arrange a date convenient to the Newman’s and to Swim King Pools to install a ’x 8’ drywell in place of the presently installed drywell.Respectfully, Swim King Pools

The pool was sold June and excavated 7/**/A drywell for backwashing was installed at this time. Walls were poured 7/**/15Plumbing lines installed 7/**/15Backfilling was 8/*/15The pool was started running with all work completed 8/**/which includes the straight run line to the
drywell.A demo of equipment was given 8/**/15It was winterized in the fall of The drywell line is not pressurized nor does it hold water.The pool ran without issue all of the season.Someone else opened the pool for the Season . In the customer contracted a company to have a patio built Heavy duty machinery, trucks and mason supplies are used to prepare and construct the patio It is our assumption that this work may have caused their problemWe were not the contractor.It would be the homeowner’s responsibility to contact their mason to have the patio removed and also their responsibility for any repairs since this was their work area. When our job was completed all was in working order Our pool construction was completed and in running order in The patio & wall work was done in . It is since the patio work that their problem developed. To answer the warranty issue of *** ***, case#***The desired resolution is to take up their patio and examine understructure We did not install the patio so cannot do that As per regulation by Southold Township there is no requirement for a pool drywell if it doesn’t fall into storm water management criteria This pool DID NOT fall in that category The pool drywell is for backwashing purposes The customer used the drywell to remove excess water from pool due to a rain event, overflowing the capacity of the drywell which could have led to patio settling Warranty does not cover use beyond requirements

My first request was as follows on or about 11/*: "If Swim King cannot or will not look into the possible line problem that this may have caused (by having the wrong size dry-well) than I am asking that the incorrect dry well be replaced with the correct sized dry well per town codeThis has been confirmed with the town, the dry well has been exposed and is absolutely the incorrect sizeIf they cannot do this I am demanding my money back in the amount of $that they charged me outside of my contract for the wrong sized dry well." Why, if after further discussion and confirmation with Southold Town Engineer, would they not be obligated to finish the job by installing the correct size dry-well? The final demand of the $refund was only if they could not replace the incorrect dry well with the correct sized dry well, which is what rightfully should be doneA settlement of $would only satisfy if Swim King had refused to take any further action, however they have by contacting and discussing the matter with *** *** ***Please advise if Swim King is willing to do what should have been done initially, install the correct size dry-well and redo plumbing outside of the decking area from the pump to the new dry-well.
