Summers Towing and Repair, Inc(Summers) received the above-referenced customer complaint, and we appreciate the opportunity to respondSpecifically, the customer asserts that she was improperly towed from the visitor parking lot of [redacted] on Friday, September 9, 2016, at 11: a.mThe customer contends that because it was not a game day and before 12:p.m., Summers had no right to tow her vehicleHowever, the management of [redacted] contracts Summers to tow vehicles from visitor parking lot starting at 12:p.mon Fridays preceding a Saturday game dayIn fact, the visitor parking lot has two large signs that clearly state the lot closes at 12:p.mon Friday and reopens at 12:p.mon SundayWe have included pictures of these signs for your convenienceAdditionally, the management of [redacted] supervises the towing of vehicles from that lot and will not allow Summers to tow vehicles prior to Friday at 12:p.mWe have included a copy of our invoice, which states the customer's vehicle was towed at 12:p.mon Friday, September 9, 2016, per the instruction of [redacted] managementIf you have any additional questions or concerns regarding this matter, please feel free to contact me directly at (304) 599-3133, or [redacted] management [redacted] to discuss their towing policiesSincerely,

In response to the complaint filed with the Revdex.com, on the evening of September 11, we were contacted by a MonCounty Sheriff Deputy to remove a vehicle at [redacted] road that he stated was illegally parkedHe stated that the vehicle was blocking his cruiser in (for more than 24hrs) and that he was an agent of the property and had the authority to have vehicles removed that were parked illegally (at this time the landlord was also notified that the vehicle was going to be towed away and granted his permission as well)Once we arrived on scene the Sheriff Deputy signed and filled out our paperwork stating who the landlord was and that he (the Deputy) did have the authority to remove the vehicle (this paperwork can be produced if needed but it does have personal information on it such as phone numbers of the deputy, landlord, and other agents with the authority to remove vehicles that would need to be in kept from the public)Once we impounded the vehicle we were contacted by the customer, we gave them the price to pick the vehicle up but did advise them there was a daily storage charge of fifteen dollars that is set by the W.VPublic Service Commission (not an hourly storage rate)The customer chose to pick it up the following day and as the invoice reflects NO storage charge was applied to the billWe did advise [redacted] at the time the vehicle was picked up that she could take her receipt for the tow and speak to the landlord of the propertyUnfortunately [redacted] parked her car illegally by blocking in a Mon County Deputies cruiser and as the result she had her car impounded and had to pay an impound feeIf there are any more questions or documents needed please feel free to contact meThank you, [redacted] Summers Towing and Repair Inc

To Whom It May Concern: Summers Towing and Repair, Inc(Summers) received the above-referenced customer complaint, and we appreciate the opportunity to respondOn January 19, 2016, the customer was towed from the *** *** apartment complex for parking without a permitThereafter, the customer
attempted to retrieve his vehicle without the proper form of payment, which required an employee to come in after hoursThe customer was again informed of the proper form of payment and the after hours release feeLater that morning, the customer again called to pick up his vehicleAt that time, we were prepared to waive the second release fee of $and charge only $207.55, even though an employee again came in after hours to release his vehicleWhen the customer arrived he placed $on the counter and asked if the owner takes changeHe then proceeded to pay his bill in the form of an additional $in pennies, $100,in dimes, and $in nickelsThe customer seemed amused at his own behavior and the situation he created for the employeeIn fact the customer had his friend record an audio video of the entire exchange, without the employee's consentSummers accepted the form of payment but chose to charge the additional release fee, which the customer paid in the form of $in cashThe customer then uploaded the video publicly to *** describing it as a classic prankThe video had over 6,views, before he wrote a post that he was advised to take it downThe *** post stated the following: Despite the tremendous outpouring of love I received for my most recent prank, I have been advised by those in authority to take down the video! Sadly some people misunderstood a classic prank and instead are trying to turn it into something maliciousI of course don't want to reflect poorly on my friends, family, or professional community so it had to come down! Nonetheless, I hope everyone had as much fun watching it, as we did filming it!!... We have included a copy of the post for your convenienceThe customer asserts that he was improperly charged an additional $on his billHowever, the *** *** *** ** *** *** approves and sets our rates, and it provides for a $reopen fee after hours to release a vehicleWe have included a copy of this decision for your convenienceSummers sent an employee in after hours twice to release this customer's vehicle and the customer was informed of the after hours release feeAccordingly, based on the *** *** *** approved rates, Summers disagrees with the customer's complaintIf you have any additional questions or concerns regarding this matter, please feel free to contact me directly at Summers Towing and Repair, Inc(304) 599-Sincerely, *** ** ***

To Whom It May Concern: Summers Towing and Repair, Inc(Summers) is in receipt of the customer response to the above-referenced complaint and appreciates the opportunity to respondThe *** *** *** ** *** *** approves and sets our rates, and it provides for a $reopen fee after hours to release a vehicleThe customer contends that he was never informed of the $after hours release fee and, therefore, he should not have been charged the additional $to release his vehicleHowever, this contention is simply untrueThe customer came in after hours on two occasions to retrieve his vehicle and was informed of the fee each timeClearly, the customer was aware of the release fee as evidenced by bringing the exact change of the tow bill, $plus the original $release fee in the form of $in pennies, $in dimes, $in nickels, and an additional $Summers was prepared to waive the second release fee and charge $207.55, until the customer indicated he would be paying in all changeAt that time, the customer was told that Summers would not waive the second $release fee if he proceeded to pay in all changeThe customer stated that he wished to pay in all change and paid the second release fee in cashThe customer has an audio video recording of this exchange in which he can be seen laughing as an employee counts $in changePlease note, this employee came in after hours to release this customer's vehicle and was recorded audio visually without his consent for the customer's amusementThe customer himself described this as a "classic prank" when he publically uploaded the video to ***Additionally, the customer has recently written a *** review for Summers stating: "Trashed my car and wouldn't fix it." This is also untrueThe customer has never contacted Summers with any such claimWe have included a copy for your *** *** *** ** *** ***, Summers had the right to charge the customer a $after hours release fee on each occasionThe customer was aware of this fee as evidenced by him bringing the exact change when he came to retrieve his vehicle the second timeThe customer was given the option of waiving the second $release fee if he did not pay in all changeFor "prank" purposes, the customer selected to pay in all change and pay the additional release feeAccordingly, the customer's request for a refund is unwarranted. I have reviewed the response made by the business in reference to complaint [redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
While the letter from Summers towing is largely accurate, there are several falsehoods which underly the nature of my complaint. My issue with the transaction was and continues to be that:1) I was never informed of the $45 after hours fee before I came to retrieve my vehicle. I fully understand that this fee is legal per the law, but the business never informed me of this fee prior to arrival. Had I known of the fee, I would have waited until regular hours to retrieve the car.2) after a final price was quoted to me at $207.55, the employee became agitated with my form of legal tender, and decided to add an additional $45 to my bill, after the price had been agreed upon.  In no way is it legal to quote someone a price and then raise it on the spot simply because you are agitated with them.- I will again state that while the towing itself was legal, as were the baseline charges, the two additional $45 fees were both levied without proper warning, and after an agreed upon price had been set.
