I am rejecting this response because: As you can see, I have attached pictures of the above mentioned driveway and tree. That is the current state of the drive way with chunks of concrete and washout remaining. Perin was to come out with in days to remove the extra concrete and I have heard no word of when that might happen. Along with the before and after of the tree and what was left over. The association clearly lied by saying the tree was cheaper to remove than to prune. Also, I have spoken with my neighbors, and they too, wanted just a pruning. As far as the Dutch Elm Disease, the contractor never mentioned the tree had an early stage of it. in fact, they indicated it was a perfectly healthy tree. Also, no report has been shown to prove there is any such instance of the disease. as far as working by the directions of the board, I have requested meeting minutes for the last months with no luck. I requested this originally on August 29, 2016, again on august 30, September 7, September 8, and September after I was told they will send the minutes after I pay for them based on a fee they will determine at a later time. I have yet to receive any further indication of what the fee will be (not sure if they can even charge me for public minutes), or when the minutes will be available

The consumer is an owner in a condo association governed by a board of directorsReserve Realty Management is tasked with
implementing the Board's directives
The owner called this office when the gutters were not cleaned as scheduled on the 10th due to heavy rains that would have made it dangerous for the contractor The community association manager for that property was not in the office when she called She declined to speak with the assistant and requested to speak with me I was on the phone at that time and she chose not to wait or to use voice mail
The gutters were cleaned and the 12th and 13th In point of fact, when she called the office the contractor was on site
Contractors do not always arrive as scheduled due to a variety of reasons and the owner, in this case, harbored unreasonable expectations of service
Initial Consumer Rebuttal /* (3000, 7, 2015/11/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
When the phone was answered at Reserve Realty management I knew I shouldn't have placed the call The person answered in an extremely nasty tone of voice When the person I asked for wasn't available I asked for the ownerShe wasn't available I knew from past experiences with this company that my call was uselessI pay a monthly fee for a service I can't use I was never given the option of speaking with the assistant or leaving a voice mailI do expect an apology
Final Business Response /* (4000, 12, 2015/12/07) */

I am rejecting this response because: I advised the car was specifically brought to Motor Motion to determine if a new transmission was required OR a simple fluid change because the transmission was slipping I did not need a diagnosis telling me the transmission was slippingWhen I returned to pick up the vehicle, I was told the diagnosis confirmed the transmission was slipping not if a new transmission or fluid change would correct the issue as requestedAdditionally, I was told due to time restraint the car would need to be returned for a second full day in order for the pan to be dropped to make the requested determination IF a new transmission was needWhen asked what was being paid for, I was told this include the diagnosis and service for the pan being dropped at a future dateWhen the car was returned there would be no charge as the fees had been paidWhen I protested for being charged for services not rendered, I was told this estimate was signed when the car was dropped offThe fee needed to be paid in fullI was under the impression the car would not be released until this was paidI paid to get my car returned unsatisfied with NO NEW INFORMATION OR THE REQUESTED DIAGNOSISWhen calling back to make another appointment, I was told the car would need to be returned in excess of a week due to a busy business scheduleI had to call the owner to complain again about the pre-paid service and being put off more than weeks to "drop the pan." He did accommodate with a sooner appointment; however, I did not keep the appointment as I am completely dissatisfied for the non-service and re-paying for services not rendered. My complaint is for not being provided the requested information, no repair being done and having to pre-pay and return the car in order to get the requested diagnosis: is a new transmission needed or would a fluid change resolve the slippingI was told the pan needed to be dropped for this determinationThis was not doneThe owner calling this a "free service" is RIDICULOUS!Please note, I took the vehicle to Jim's Transmission who completed the same work as Motor Motion - a computer diagnostic and test driveI was charged zero dollars for this service

The Board of Directors of Reserves of Aurora Condominium has turned this matter over to their attorney

On November 2014 [redacted] brought her car in, and requested a cooling system inspection because of a coolant leak, and a diagnostic test  because the  transmission warning light was on, we found hoses leaking at heater control valve, we replaced her heater and radiator hoses and thermostat...

based on cooling system inspection, she also requested we check sun roof inop, we removed her head liner to check the circuit, found a bad connection at no additional charge.
At that time we also performed an oil change, license plate bulb, brake light bulb, serpentine belt was replaced due to condition, PS fluid was replaced due to condition, battery failed the load test so we recommended replacing it.
In December2014  [redacted] stated her battery was going dead, [redacted] insisted on a different battery, at that time we found a draw on the battery, we performed testing to locate the source from the aftermarket radio, she declined replacing the battery.
March 2015 [redacted] came with the same complaint, we replaced alternator free of charge, there was also a coolant leak so we replaced the thermostat and gasket free of charge. We Battery again free of charge, We advised [redacted] to disconnect the hands free link and replace the stereo which she declined these repairs. We furthermore advised [redacted] that if the hands free link and stereo were not disconnected the battery AND alternator would likely fail again.
Between these visits [redacted] had numerous no show appointments, [redacted] would call and insist on a same day or next day appointment and then not show up. Since the Complaint was filed [redacted] called 11-18-19 to setup an appointment to fix this on 11-19-15, and did not show up for her appointment.
**It is important to mention that [redacted] did not pay for the work performed, her father did. Furthermore it is difficult to Communicate with [redacted] when she is not sober, multiple witnesses can attest that [redacted] was not sober during most of our communication with her**

The process we used on the 4 runner isn’t just test driving although test driving is also part of the diagnosis. We simply did not have time to drop the pan, and we had rescheduled a time that suited them, but they did not show up. We still will honor that but are not interested in refunding the...

money. At this point we have way more timer invested in the diagnosis than we are being paid for. So to be honorable we agreed to do the pan drop free of charge. Also we will be glad to provide a rental car for them for the day if necessary.  The following is what we did for customer’ TECH NOTES:  CONFIRMED CUSTOMERCOMPLAINT OF SLIPPING. TRANSMISSIONSLIPPING, TORQUE CONVERTER CHATTERS AT4TH TO 5TH GEAR. RECOMMEND DROP PAN FOR INSPECTION.  IFPAN DROP IS OK THEN FLUSH TRANSMISSION.IF PAN SHOWS SIGNS OF DAMAGE THENTRANSMISSION WILL NEED TO BE REPLACED.SUSPECT INTERNAL TRANSMISSION PROBLEM.CODES: [redacted] EVAP SMALL LEAK IN HISTORY [redacted]Motor Motion Automotive [redacted]
