"">Revdex.com Corporate Office [redacted] Austin, Texas [redacted] Attn: [redacted] RE: ID #[redacted] Dear Revdex.com: The claimants complaint is not validThe boat would not start because the safety lanyard switch was turned off causing the boat to not startWhen the boat arrived at the dock all we had to do was flip the switch to the start position and it started right upWe consider this to be operator error and nothing elseThere was no mechanical failureAccording to our contract she should have been billed an extra hour for the boat while in her possession considering the failure was due to operator errorIt is not our-fault nor equipment failure when someone turns off the safety lanyard switch and forgets to turn it back onSEE (6) UNDER RENTERS OBLIGATIONS (6) In the event of inclement weather including unsafe winds, malfunction of the equipment or if instructed by Sun & Fun employees, I will promptly return the equipment to the Sun & Fun launch area or do as otherwise instructedIf the equipment is returned for reason of inclement weather or malfunction of the equipment, I will be entitled to a prorated refund of my rental fee based on the amount of time the equipment was in my possessionNO refund will be made for return of the equipment for other reasonsIn good faith Mark offered a refund in the amount of $which included minutes rental time plus tax which was an additional minutes considering the distress call came in only minutes before the boat was due back at the dockThis offer was more than reasonable considering no refund was due because of operator errorShe thanked Mark for the refund offer on the telephone and mentioned that she was not upset with our company but rather American Express and then writes a letter to the Revdex.com stating otherwiseShe also mentions that we are lying to American Express when she is the one giving contradictory statementsHad this been a mechanical failure on our part the refund amount would be the sameConsidering the above statements and the fact that a good faith offer was made not only from us but from American Express as well, we ask that nothing is posted about this unjust complaintSincerely, [redacted] Sun & Fun Marine
