Review: The business conducts improper billing practices. I am also due a refund due to overpayment.

The business is a long-term health care facility (nursing home).

The point of contacts are [redacted] and [redacted].

Customer (patient) was my father who received Medicare/Medi-Cal and was temporarily a resident at the facility.

We received a bill (8/30/2013) more than a year after my father was transferred out of the facility (4/15/2012). The bill previous to the 8/30/2013 bill was received 6/30/2012 and paid in full in a timely manner. The business claims that they conducted an audit and discovered a balance due on my father's account. I notified the business by Certified USPS mail (11/7/2013) that, based on my receipts, bills and paperwork, I was disputing the bill. I never received a response -- only more bills and a letter threatening litigation. Upon further research, I discovered that not only did we not owe the business money but the business owed us money due to overpayment. The business may state that they required documentation from me showing that the Medi-Cal Share of Cost (SOC) obligation of $1082 had been met. But I will contend that the burden of proof is on the business. They are the ones with access to the Medi-Cal Eligibility online system which allows them to look up an individual's SOC balance. When I spoke to [redacted] initially, she was reluctant to investigate my claim. Only after a visit to the local Medi-Cal office and having them corroborate their improper billing practices, did they take my claim seriously. Very soon after, [redacted] sent me a fax saying that, indeed, the SOC had been met and that the account was settled.

I would also like to point out that the itemization of their bills is confusing and incorrect, which probably led them to billing me improperly in the first place. Finally and most importantly, I would also like to make a general complaint against their billing practices. I may not be the only one they overbilled. They were essentially billing us more that our legal obligation -- the Medi-Cal SOC. Someone not as savvy may have just paid the bills.Desired Settlement: At the very least, I would like a refund of $620.97 due to overpayment. I would also like an external audit performed on their billing practices -- especially on their Medi-Cal patients.
