My signed signed an addendum to the lease, paid rent by the date stated on it, but was still charged a late fee.My son signed a promisary note(which I too should have signed as the guarantor, but that is not my issue), which clearly states "this is an addendum to the lease" that allowed him to wait for his student loan refund to pay for August rent. This addendum states rent is to be paid by August 31st and January 31st and if any installments are late that he is subject to late fees and or eviction according to his lease contract. This has been paid by Aug 31st and he has still been charged a late fee. According to the assistant manager, this addendum was only to protect against eviction and legal fees and the fact that the leases states August 6th makes this payment late. I disagree since an addendum over rides the lease and states August 31stDesired SettlementI would like the late fee to be refunded, and it not show he was late with this payment.Business Response Our company provides the Financial Aid Addendum option as a courtesy to our residents that receive financial aid. We do understand that financial aid is not received until the week before or week of classes. With this in mind, we allow the rent to be paid late, however, it does not negate the obligation of the lease, including late fees. In addition to the courtesy of allowing resident receiving financial aid to pay late, we also do not take legal action on those residents who sign the Financial Aid addendum so they will avoid costly legal fees and/or eviction typically associated with such proceedings. The Financial Aid Addendum is intended to relieve the financial burden of having to pay rent before receiving financial aid. It is not a mandatory requirement, so in order to avoid the late fee in the future, we would advise our customer to pay the installments as agreed upon in the lease agreement and not agree to the terms of the Financial Aid Addendum program.Consumer Response This has been their position but the addendum states must be rec'd by Aug 31st and an addendum legally over rides a lease and the date that is in it. I will no longer be using the addendum for future payments, will make sure all rent is paid on time but still feel this late fee should be refunded.
