While it is unfortunate that the transmission has developed a problem, it is not anything we knew of. We had complete confidence in this vehicle, so much so, that before the customer purchased the vehicle he used it for a few hours to show his wife, test drive it and could have had any mechanic look...

There were no leaks from under the vehicle, no signs of shifting problems and he was given the opportunity to purchase a warranty to cover problems in the first 90 days, which was declined.      This is noted as an "Advertising Issue", however, I am confused how we mis-advertised the vehicle. The vehicle was sold as-is and we go above and beyond by voluntarily offering a Carfax report on every vehicle we purchase to help customers get a sense of the history of the vehicle.    The customer also used the term "lemon". I think there is a misunderstanding of the term. Lemon's don't have 150,000 miles on them and make it 11 years on the road, used cars do.    The customer had the vehicle for hours before the purchase, bought the vehicle as-is and unfortunately the car has develop a problem. We have offered to assist in finding cheaper repairs using shops we work with. This letter is in response to claim ID#[redacted], submitted on 3/29/2016. We did talk to [redacted] around the middle of March. He called in and asked about the Rav4 and also asked about financing. The vehicle was originally priced at $3700, then $3500 and now $2990. Since we do not offer in-house...

finance we told him we could ask and see if one of the banks we refer people to would like to finance it. He was told that the out the door price would probably be around $4000 as the car was originally priced higher and we do not have taxes and title fee’s included in the price. In addition, sometimes the bank will require an extended warranty, GAP or a GPS unit to be purchased in order for certain cars to qualify. [redacted] never officially applied for the vehicle and we never talked actual numbers, it was all quotes to see if he wanted to move forwarded. In Colorado, per the state, we do not have a cash or finance price, they are the same, nor do we offer financing on every vehicle. We rarely ever do financing at our lot and the Rav4 at $2990.00 is not a vehicle we will finance with the parameters he requested. Our ad says to ask about our financing, but it is through a third party and may not work on every specific vehicle. We don’t know how things work with the bank until someone fills out an application. We never officially approved or denied [redacted] on this vehicle at ANY price, as he never officially applied. Selling the car at $2990, someone should budget at least for $3500 to cover taxes, doc fees, etc, so our quote for our out the door pricing was not far off. Again, it was a verbal quote not actual numbers.We apologize if he feels mislead, however, we did not change the selling price and we have not reached out to him to continue selling him this car, nor has he applied to buy it. Our ad is compliant with all state laws and nothing in there is misleading.
