Sunridge Nurseries is a legally licensed nursery and participant in the Grapevine Certification and Registration Program, (R&C Program), in CaliforniaWe sell certified vines that have been released from this R&C program, and the diseases that are covered in this R&C program do not include Crown Gall! Our company contract, which Mr*** *** signed, clearly describes that the diseases listed in the R&C Program are covered, and that diseases that are not listed cannot be guaranteed in any wayAs a gesture of good faith, we offered to return his "deposit" even though the reason for rejection is invalidFurthermore, we believe that the test results from his local lab had to be flawed, because these vines were generated from recently acquired Protocol source material from UC Davis that did in fact test Crown Gall negativeOur intent was to bring the subject vines back to our site and have them tested by the UC Davis laboratory before deciding what to do with the returned vines
Crown Gall is a ubiquitous disease found in every agricultural growing region in the worldThat is why it is not covered in the R&C ProgramIt is impossible to guarantee something that is commonly known to exist in soils and plant material all over the worldPeople involved in agriculture know this , and understand that there is inherent risk in agriculture because we cannot control mother nature and weather conditions
Sunridge Nurseries is acting 100% within the regulations governing this ProgramWe desire that every customer is happy with our product, and have gone beyond the requirements of the program in an effort to make Mr*** happyIt was his decision to reject for invalid R&C reasons, therefore it is his burden to decide the financial alternatives and consequences of that decisionWe believe that there is simply a lack of understanding of the R&C Program which has lead to this situation
We still desire an amicable resolution to this situation, and continue to be willing to discuss a reasonable action to solve this problem
