this company had a guy to come out they gave misleading information by telling us that a contract was just an estimate.
they had an employee to come out because we have an issue at our house that we need a remodel of our kitchen we asked the employee Carlos that works for them that we need an estimate to show us the layout of what he plans to do he told us to sign a paper to receive an estimate he had us to sign a document that he stated was just if we wanted to hire him as a contractor he did not explain to me and my husband that it was a contract he misled us into believing that in order for us to get an estimate that we would have to sign a paper and he would be able to email us the information regarding the estimate a week or two later we received a invoice from our insurance saying that he had submitted the paperwork in to them and we still have not heard back from him and we found out that in the paperwork it was more than just for receiving an estimate it was saying that we would have to pay them a 10% fee if we choose not to use them as a contractor which we never knew because they gave us misleading information by telling us that this was for we can receive an estimate we never agreed to hire him as our contractor but rather he gave us misleading information when we contacted the company owner mr. R he had a very nasty attitude and he laughed at us and told us we didn't know what we were signing and that his contractor did nothing wrong and this company is very misleading and they try to get over on new homeowners who they know don't know that this estimate is a contract which is not fair I do not normally like to file complaints on anyone but I do not like the owners attitude towards customer service and also they haven't done any work at our house and there are already trying to tell us we're going to pay them to 10% and I told them I'm not going to pay them anything because they gave misleading information that the estimate is a contract which we were not aware of.
The resolution that I am seeking for this company is that 1 people should know that they give misleading information to their clients and also we ask them days ago about breaking the contract because they haven't done any of the work to our house and we do not want them to do any work to our house because they gave us misleading information we will not work with them because if they are honest business people they should not be having someone to sign something and telling them that it is for estimate and then turn around that it is a contract. And also when we spoke to mr. C he agreed to my husband that he was wrong that he gave us misleading informationand that he was going to have his supervisor to break the contract now after we keep contacting him his supervisor calls us and he's very nasty and rude and tells us that he is not going to break the contract and then we're going to pay him 10% no matter what very unprofessional

We apologize for any confusion that may have occurred. Sunshine Construction and Restoration is a construction company specializing in Insurance Restoration Claims. It is Sunshine construction and Restoration's goal to advocate for our clients and work closely with insurance carriers to return our client's properties to pre-loss condition as soon as possible. Our expertise in construction methods and extensive experience with working closely with over 52 Insurance Carriers allows us to extend the highest level of service to our clients in their time of need. We would like to address a few of your stated concerns. On May 22nd, Mindy with corporate contacted you to schedule Carlos I, our licensed adjuster, to come out to your home on May 29 to inspect the reported damages, take photos, measurements, and collect any /all necessary data needed to prepare a comprehensive report for submitting to your insurance carrier on your behalf to return your property to its pre-loss condition. It is Corporate Policy that before we can perform any/all duties pertaining to the rebuild process of your property loss, including any/all inspections and/or generation of any reports to be submitted to insurance carriers on your behalf, that we have the appropriate and insurance carrier required documentation signed and submitted. We require that all clients receive and sign a "Work Authorization and acknowledgement of Services" before the property can be inspected. (see attached) We require that all (Insurance Loss) clients receive and sign Our contract for services, giving permission for us to submit an Xactimate Estimate (Insurance Developed/Approved Software) to your carrier. This contract for services must contain the name of your carrier, your Insurance claim information, the name and contact information of your insurance carrier's adjuster, and the email where the estimate for repairs should be submitted. This contract for services also is required to have initials of our client acknowledging the terms within including, but not limited to, pricing, Payment schedule, Notice Of Cancellation (Fee Free), and the associated Fee for cancelling the contract if cancelled after Xactimate Estimate has been submitted to the Insurance Carrier. (Please see attached). Once we have received a signed Work Authorization, we require our licensed adjuster(s) collect any/all info, measurements, pictures, and or statements necessary to generate a comprehensive report of the damages to be submitted on our clients behalf. We require a signed contract before generating such a report, as all insurance carriers require a signed contract for services before they will work with a contractor or discuss an insurance claim with anyone other than the insured. As part of our Standard Operating Procedure, we require all of our licensed adjusters who meet with the client(s) for the inspection/consultation, spend not less than 1 hour on site with the client to answer any/all questions, explain the rebuild process, walk the client through the "Rebuilding After Your Property Loss" packet that our clients are given (See attached) that explains all of their next steps. In the spirit of complete transparency, we offer our clients their own "Owner's Portal" that they can sign into our Project Management Software anytime to track their project, including pricing & payments, pictures, Change orders, construction schedules, etc. Sunshine Construction and Restoration strives to give our clients the best stress-free project management experience available. We try to incorporate all these tools towards this endeavor. We apologize if we have fell short of this goal somehow and you have not had this perception so far. Sunshine is more than happy to honor our contract by continuing to advocate on your behalf with your carrier, provide all materials, labor and supervision necessary to return your property to its pre-loss condition, or release you from your contract for services once the cancellation fee has been paid.
