Review: [redacted] started an addition on my house on January [redacted] 2013. He verbally told me it would take 3 months, we are now at 7 months. He has walked off the job several times. This last time he's been gone for almost 2 months. I've paid $122,000.00 of the total balance due of $147,650.00 On 5/**/13 I gave him $10,000.00 then $5000.00 a few days later. He specifically stated in an email to me that he would come install the drywell and the steps and complete all tile work instead That Monday he came to pick up his tools and employees and left. He went to Aruba on vacation. Left the house in a very dangerous and hazzardous stage with no door or steps to the basement. Leaving us exposed to everything. No back steps just a landing with a big drop. When he poured the basement cement he accidentally cemented the black pipes trap now my basement floods from the bathroom pipes. Every single room is incomplete and he has no intention of returning.Desired Settlement: He needs to do the work he said he would do, or give me my money back.I have no heating, toilets, running water, doors, back steps, basement steps, inside steps, drywell, etc....Soon the winter will be here. that house in inhabitable in the stage it is at. But I have no where to go. I will freeze. He knocked down all the walls already but did not insulate or heat any of it. there isn't any electricity either. Please Help me.

On 1/**/13 we signed the contract that outlined the work to be done and the payment schedule. After some delays from weather, and getting a deposit, we were able to begin.After five weeks time we had the concrete poured and the frame of the extension erected and plywooded and papered. From the beginning the payments were falling behind and the work was getting done. At this point there was approximatly $55,000 worth of work done and only $35,000 was paid to date. After several meetings with her telling her she had to catch up with payments as agreed she did not and we were forced to stop. She would continuously add on work that is not in the plans and expects them to be done for free. [redacted] slowed down the completion of her job because of slow or non payment.Our orginal contract is for $146,650. Plus the extras completed to date,totaling $8700 for example building of a washer and dryer room with electric and plumbing, installing 2 skylites installing extra windows, painting to name a few. Plus all the additional work she wants done in the existing house like new staircases structural changes etc. totaling $27,000. To date she has paid a total of $116,750.This leaves well over $60,000 owed. My repeated attempts to contact her and resolve these issues either were ignored by her or her demanding that I come back to work without signing additional work orders and modifying the payment schedule.She claims I went to Aruba for vacation. That is another lie. Iwent to work for customers that pay as agreed. The work from the original contract is in the finishing stages, painting is halfway complete, bathrooms are 80% tiled. There is very little work left on our orginal contract.The jobsite is safe as indicated on the nyc building inspectors report. I have every intention of doing the work that I said I would do, but I will not do additional work for free either. All she had to do was meet with me and this would be resolved. She does not want to meet because she does not want to pay for extras, and sign additional work orders. I am enclosing a copy of my responce to the nyc dca. I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

There are too many discrepancies in [redacted]'s response. Below are some of the emails that I've written him in an attempt to resolve this issue. As to the padlock, it was his own lock thats on there that his employee has the key for, not us. He makes a statement of daily changes which is totally not true.

I have pictures and videos as proof of the exact date the job was started and a log of the days worked, what was done each day, the number of workers each day and start and end time of the workers.

We have no heat, water or electricity in the addition and part of the existing house My mom is elderly and with winter coming it makes this situation very dangerous to her health. We have no exterior door, only a piece of plywood. Also there are no outside steps leading to the basement or the backdoor, and a tree stump inside the house as a step.

Like I said in my original responce I am always ready to meet with miss avila and work out the completion of the job. She refuses to do this. Instead she makes up stories and lies and chooses smear tactics instead of good faith meetings. There is very little work left to do on our original contract like she has stated in several emails, but there is approximatly $40,000 owed on the original contract including the extras completed to date. We have also done thousands of dollars in extras for free and thousands of dollars in extras that she asked for, has been completed, and refuses to acknowledge and pay for. She has fallen behind in payments throughout the course of the job which is a breach of our contract and forces us to stop work until she catches up. She makes changes and additions to the additional contract on a daily basis. All I want is for her to meet with me in good faith and resolve these issues. As of last week I have recieved a letter from the attorney general and her lawyer stating that this issue will be resolved in court. That is unfortunate for both of us. All she had to do is meet and resolve these issues. My business has an unblemished record which I will fight to protect, and always will be run on an above board basis. I have never had a problem like this before with a customer. Any help you can provide me will be greatly appriciated.

[redacted] still has not contacted me, or returned to complete the job he was paid for. He left us with out heat, electricity, and water. He started this job almost a year ago. asked for cash payments in the begining, has all illegals working for him. I have no window in my kitchen because they broke it, no doors ... the list is so long of the thing wrong.

This case is far from settled.
