However, as I stated in my earlier response, "The vehicle was repossessed on 5/22/15. The payment was 15 days past due, That was the reason for the repossession — not that he had moved out to state." Now it appears that Mr. [redacted] is upset that Sunstar did not repossess his vehicle sooner. As I stated previously, "With each move, he came up with a different excuse as to why his payment could not be made on time." The moves and the failures to pay on or before the due date each constituted a breach of contract, the remedy for which includes repossession. We tried to work with the customer with no success. He paid four months and then the account was paid off by his insurance company.Sunstar purchased his current vehicle installment sales contract from a local Albuquerque automobile dealer_ The customer signed the contract on September 27, 2013 — not 10/7/2014 as he stated. When he signed the contract, he agreed that he "will not permit the vehicle to be permanently removed from New Mexico without our prior written consent." By violating this promise, he is in default, the remedy for which is repossession. Sunstar did not enforce this right as a result of the customer moving out of the state.Mr. [redacted] first violated this covenant when he moved from New Mexico to Kentucky without Sunstar's prior written consent. Then he was in Chicago, Memphis, and Vicksburg. Next he moved to Denver. A few months later he moved to Las Vegas, NV. He was advised that these moves, without Sunstar's prior approval, were a breach of his contract. With each move, he came up with a different excuse as to why his payment could not be made on time.The move to Michigan was the final straw. On 5/8/15, Mr. [redacted] called Sunstar and left a message that he could not pay until 5/20/15. His payment was already past due. Our collection supervisor returned his call and explained in no uncertain terms that Sunstar would not accept another delayed payment and would enforce its rights under the contract if he did not make his payments as agreed.The vehicle was repossessed on 5/22/15. The payment was 15 days past due. That was the reason for the repossession — not that he had moved out to state. Although he claimed that he was not late on any payments, of the 17 payments he made, only 6 were on time. [redacted] If I was in the wrong with all the places I moved and lived, why wasn't the car REPOSSESSED then?  My credit reflects report has none of these late or non payments that Kenneth S[redacted] (who is the first I heard of now).  Why wait til I made 17 payments on the vehicle and then be concerned.  This company ruined my job with  [redacted], as I was a traveling employee who was required to work in 14 locations all over the united states.  Ask Kenneth to prove my late payments.  I requested to the Sunstar Capital that they moved my monthly payment to the 20th of each month.  Justin who always accepted my payment when my direct deposit came in, never told me I was going to get repossessed for moving to MICHIGAN.  This is a free country and I should not be forced to stay in any state.  Also they knew when I purchased the SECOND car from them what job I had.  They knew the circumstances of my job requirements.  I am going to sue them.
