This is [redacted] , Owner & Founder of Superior Exterior Fence LLC in Tacoma, Wa The complaint submitted by [redacted] is more than inaccurate [redacted] signed a contract with me on 10-04-( scope of work as follows) install 94' of 6' black chain-link including barbwire/ motion light system with 20' roll gate & 4' walk gatesThe amount agreed upon was $6,with a $4,down & $1,upon completionThe expected start date for this project was 10-10-2016, due to our current weather situation here in Washington we were unable to start on the date expectedI received multiple voice mails from [redacted] expressing his concern with my companies ability to perform what was agreedI returned ***s call to update him on our current weather forecast, and explained exactly why we don't install chain link fence on top of concrete when its raining( Superior Exterior Fence offers a 10yr maintenance free warranty on all services) performing an install of this caliber is this weather is asking for trouble11-04- [redacted] sends me a message at 11:pm asking for a full refund, and threatening to contact the fraud division, and even call the cops if I refused to return ( The money thats was agreed upon in our contract) Thats is Breach of Contract Asking for a refund Threats Not following terms of contractThose three things were enough to pull the plug and request this situation be settled in small claims courtI still was very polite despite the harassment and ***s inability to understand the obvious liability he was proposing and how this might affect his warrantyThen as I wake the following morning to find yet another text message concerning the start date( while its still pouring rain) I explained that there was no need to argue or harass me, I will not perform these tasks in this weather [redacted] continued to harass me as well as his significant other, they then double teamed me to explain to me how I am running my business in a fashion that does not meet there immediate needsI then explained number telling me I don't meet there needsExhaustingly I realized there was no getting through to *** [redacted] claims I have his money when the money [redacted] has paid no longer belongs to him as it has been filed with Superior Exterior Fence , And materials have been purchased, which must now be returned with a 20% restocking fee, Time associated in and around this project have been calculated in the amount I will not Disclose due to Contractor privacy terms and agreement, loss of opportunity is another factor calculated, & last but not least ( Breach of Contract) fees and Tax claimed and filed as of Oct 30th as we have surpassed the date the quarter ended***, the situation we are currently now in is unfortunate on both partiesThere is no need to slander my company on-line( as I write my statement, It is still raining outside.)

Complaint: [redacted]I am rejecting this response because: 1. Contractor NEVER showed up and NEVER offered a schedule for the work. I have two cancelled checks that he cashed and would never offer a schedule to do the work. After a month we became frustrated and got nasty threats from him but no offer to make good on the work. He needs to either do the work OR refund in full.
 
We paid $1,525.00 on Oct 5th and $3,050.00 on October 6th and written that he would show up by October 10th with all parts fabricated.
 
When he didn't show up for 4 weeks, I asked to see the schedule, or work in progress. He stated that, "his fabricator was in jail" and he couldn't show me anything. He never offered a date he was going to show up. I said if he wasn't going to show up, then return the deposit. I NEVER UNCALLED THE CONTRACT. HE SIMPLY HASN"T PERFORMED OR OFFERED A PROFESSIONAL EXPLANATION FOR ANYTHING.
The weather service said there was sun on 11 days the last month I looked and yet he didn't show up then or offer a schedule.
IF ANY fab work is done, why can't we see it? 
Contractor says not to text at 11 yet texted us after midnight.
Contractor says he was going to send us a schedule - never sent.
Contractor says he was going to block our phones but continues to text us.
Contractor says in writing he was going to send email, and documents several times over last few weeks, but has sent nothing.
Contractor is full of hot air. Only his professional performance with fencing and lighting and gates will satisfy this, and that, I am afraid, might be beyond his capabilities.
