I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[Mrs*** *** never told Superior Restoration that she had a leakShe is not a plumber and would not know if there was a pipe leak. It was the technician *** that stated she had a major plumbing leak that was causing mold growth. She ask Superior Restoration for an evaluation of the situation in the downstairs bathroom/bedroom due to mold reported by the tenant on shoes left in a downstairs closet ***'s denial of stating a plumbing problem is a lie. If *** is not a plumber and can not evaluate a leak then he must a be a tile expert because he said there was a problem with the shower not being sealed and required all of the tile to be removed. This is evident by the quote for the removal. The tenant mold report was inconclusive as to cause of the mold growth on clothingThere was no elevated mold counts in the downstairs bathroomMrs*** never received quotes from any other company and was persuaded by *** to do the work because of the extreme health hazard cause by the leak The contract signed by Mrs*** was signed under duress and pressure from *** to get started before the situation got worse She is requesting a refund of $6109.00]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
We have gone to small claims court over this matter because Superior Restoration is making false claims and statements

On November 21, 2014 [redacted] contacted Superior Restoration. She stated she had a leak inher home and her tenant had mold growing on her contents due to this leak. Ms. [redacted] requestedSuperior Restoration come to the home to perform an inspection and provide an estimate for...

theremediation. When Superior Restoration arrived to the home, Ms. [redacted] asked our technician if she had anactive leak. The technician stated that we aren't plumbers and she would need to contact aplumber or leak detection company to determine if there was an active leak causing the moldgrowth. Our technician did identify some cracks and water seepage in the shower tile grout. Hedid not say it was from a leak, but the shower was not sealed properly and could be an area ofconcern.
The tenant living at the property had a mold test performed prior to our inspection, and the reportidentified elevated mold spores. When the technician wrote up the estimate, he wrote it based onthe mold report provided by the tenant. There wasn't visible mold growth on walls andcabinetry; however, there was visible mold growth on the tenant's contents including pictures, clothing, bedding, furniture, etc. The estimate the technician provided the homeowner was forsetting up contained areas, placing dr[redacted] equipment, as well as placing negative air machines, inorder to clean and remove mold spores and moisture from the air. The estimate also included adisinfecting and cleaning of all the contents in the affected area. This type of cleaning is verydetailed and labor intensive. The estimate also included packing and storing the cleanedcontents, as well as the unaffected contents, in a rented, onsite storage container.
Ms. [redacted] got several estimates over the course of several days and she called Superior Restorationon December 1, 20 14 requesting Superior to do the work. Our original estimate was in theamount of$9244; however, Ms. [redacted] asked if we would be willing to give a discount for theproject if she chose Superior Restoration. The homeowner signed the contract in the amount of$8,000 on December 1, 2014. Superior Restoration began work the following day. We beganthe project by placing containments, air cleaning and dr[redacted] equipment. Then we began theextensive cleaning process. On December 5, 2014, Ms. [redacted] decided to discontinue services withSuperior Restoration. Because Superior Restoration had already been cleaning and packingcontents for two full days, we had to bill her for work already performed. There was a storagecontainer that was rented by Superior on behalf of Ms. [redacted] already being packed. Of the $8000contract $6,392 of work had already been performed by the time the contract was terminated onDecember 5, 2014. Ms. [redacted] was aware that by terminating the contract she would still beresponsible for the work already performed, and she signed paperwork stating she was aware andalso signed a "Hold Harmless Agreement" due to removal of Superior Restoration from theproject prior to completion. Ms. [redacted] had previously issued Superior Restoration a check in theamount of$8000 on December 1, 2014. Once Ms. [redacted]'s check had cleared the bank, SuperiorRestoration then issued her a refund in the amount of$1608. The majority of the work andcleaning had already been performed by the time Ms. [redacted] had terminated the contract, so a thirdparty coming in for a second opinion at that time is unable to offer accurate, unbiasedinformation based on what was there previously and what was found on the job site during hisinspection.
It is Superior Restoration's desire to not have any negative reviews, and we believe thiscomplaint is not valid as we have a signed contract as well as a payment from the homeownerprior to our work beginning.
For your convenience I have included copies of the signed contract, as well as the other signeddocuments from Ms. [redacted].
Sincerely,

SUPERIOR RESTORATION IS AN EXCELLENT COMPANY TO DO BUSINESS WITH. I HAD A MOLD PROBLEM THAT WAS AFFECTING MY HEALTH, I CALLED 3 DIFFERENT COMPANIES TO COME AND CHECK ON MY PROBLEM AND SUPERIOR WAS THE ONLY COMPANY THAT CARED ENOUGH TO CALL ME BACK THAT SAME DAY AND I AM VERY PLEASED TO SAY THE PROBLEM WAS RESOLVED. THE GENERAL MANAGER MR. [redacted] AND HIS STAFF ARE VERY COURTEOUS AND RESPECTFUL, IN FACT THEY TEND TO GO ABOVE AND BEYOND WHICH IS ADMIRABLE. THE TEAM WAS ALWAYS ON TIME,IN FACT IF I WAS TOLD THEY WOULD BE ON SITE AT 8AM THE DOOR BELL WAS RINGING AT 7:58, IF THERE WAS A PROBLEM WITH TIMING MR, [redacted] WAS CONTACTING ME. AT THE END OF A WORK DAY EVERYTHING WAS CLEANED UP AND THE JOB SITE LEFT AS NEAT AS COULD BE POSSIBLE. THE WORK ETHICS OF MR. [redacted] AND HIS TEAM ARE EXCELLENT. I AM VERY PLEASED WITH THE WORK DONE ON MY HOME AND SO ARE FRIENDS THAT SAW THE BEFORE AND NOW SEE THE AFTER, THEIR COMMENTS ARE POSITIVE AND TO SUM IT UP IN ONE WORD THEY SAY “WOW”
