A loan for a property I owned in Queens, NY was being funded by Superior Loan Servicing. I closed on my property (sold it) on July 7, 2017. I requested, via email, multiple times, a current payoff for my loan. It took this company over 72 hours to get me this documentation. While I was at the closing table, I called, my lawyer called and the title company agent called Superior Loan Servicing, to which they refused to give us any information over the phone. Because of the delay that this company caused, I wound up going into default and they rose my interest rate from 13% to 24%, and charged me an additional *** in fees and interest. I was trying to pay off my loan, in full on this date. However due to receiving the incorrect information from the company and for the correct payment amount, they cause me to default. Therefore, since they were the ones who delayed my closing and created this lateness, I shouldn't be punished and penalized for this, and should be refunded the *** in overages that they charged me.

Borrower fails to mention two important facts. He states he was waiting at his closing table for the payoff document which took a whopping 72 hours to obtain. Does borrower know that in virtually all states, servicers have upwards of 21 days to deliver a payoff quote from the time it was first requested? The 72 hours to get his payoff document was not the reason the lenders threw his file into default resulting in the 24% interest rate and the *** in extra interest charges; Nor is 72 hours an unreasonable time period to wait for such a document considering it must first be sent to the investor to approve.
He was placed in default because he had not made a payment since APRIL ! At the time he paid off the loan, he owed his May, June, July and 2/3 of his August payment. THAT"S WHY HE WAS PLACED IN DEFAULT. There was no other reason.

To discredit this bank again and their false statements, I made a payment in June 30, 2017 in the amount of *** which goes against what they allege of my non payment since April. I have proof of this payment upon the Revdex.com request.

Please examine the screenshot submitted which clearly details (highlighted text)that the Investor on the loan authorized us to accept a payment from the borrower for two months' payments (borrower was behind on the loan and in pre-foreclosure default). The Investor approved deferring the penalty interest portion of the payments until the loan paid off but insisted on getting a complete two payments and late fees pursuant to the billing statement WHICH THE COMPLAINTANT ATTACHED IN HIS OWN EXHIBIT CLEARLY SHOWING THE AMOUNT TO REINSTATE WAS OVER *** refused to authorize us to debit anything more than $6400 to reinstate his loan and get caught up. The notes clearly showed *** attempted to reach out to him to inform him that his *** was insufficient and would not be accepted.
It is incredible that he would submit to the Revdex.com proof that he attempted to have us debit his account *** to reinstate his account when he ALSO submitted a billing statement to the Revdex.com showing he owed *** We are merely the servicer and follow the strict instruction of the investor. This case is quite clear, The borrower had missed his June & July payments and refused to settle up properly.

Mr. *** of First Equity contacted me on behalf of Superior Loan Servicing (SLS) who advised me that an agreement was made that if I paid *** on the same date, that all late fees and accrued interest will be cleared from my account, and brought back into good standing. I complied and sent SLS an ACH deposit of *** Now SLS is back peddling and not keeping their end of the agreement which is what THEY offered. This was not something I contacted them for. Based upon the facts I've submitted, along with the documentation and a clear horrible and degrading demeanor that SLS has shown to me for months and currently in how they are responding in their correspondence, I believe that the Revdex.com should find in my favor, and request all overpayment ve returned to me forthwith.
