attached a section of the law that requires the agent to have the agreements signed prior to showing the property. .Mike W*** from our office called me and said that a man *** called. He told Mike that he wanted to see the
*** *** property as soon as he could.When I called back, *** answered and said that he was
calling on the behalf of his finance, ***. I asked him if she was
working with a realtor, he said noI also asked if he was sure that she hasn't
signed an agreement with anyone because this is a requirement now . He
said no again and further said that they went to the property but did not get
inside and they really wanted to see the inside the house.I explained to him that it was a short sale and that the
house needed paint and carpet and a new refrigerator. I asked him if he
thought that would work for ***? He said they'd like to see it so I
said that my husband, who is also a Realtor, and I would show itto them. I like to be
safe and follow protocol. *** and I set a time of o'clock to view the
house with his finance, *** and himself. ***, my husband, came along and we meet this couple at the
Cobblestone property*** brought her young childrenWe introduced
ourselves and handed *** our business card and started having conversation
about the property while still on the outside*** walked around the house with *** to show him all the
things that had been done to the property.
I shared with *** the buyer broker agreement on the back side of the
propertyI sat the papers on top of the ac unit to explain them to herShe
was holding her daughter was in her arms. I shared with *** the
pieces of papers about what a buyer broker agreement was and that it was
designed to protect the buyer and lay out who does what, how things are done
and any fees and how we as agents get paid.I told *** the agreement was a template and that we just
fill in a few in the blank spacesThose items include her name, my brokerage,
my name, what the purpose of the representation is for Residential property and
for how longI said that it was for months that this was standard for me to
do months yet sometimes people just do for a specific property or just for a
dayShe said, " Ok, that's fine", when I shared with her that this
agreement was for months. She then inquired about the internal processing fee of
$I shared with her that t was a fee that we charged to process the
transaction. Then I had another form that had buyer and agent things
that she as a buyer should do and things minimum that I will do for her while
representing her I shared with her again her internal processing fee and she
acknowledged and signed that form as well. I shared with *** that I
would get her a copy when I got back to a computer where I could scan it in and
send to herI do when I meet clients for the first time out of the office.By that time, *** and *** had made it around the house
after looking at the hot water heater closet located outside the deck in the
rear*** informed *** about all the work the had been done . We were
outside for about 15-minutes speaking about the buyer broker agreement while
*** and *** discussed the outside features.We all went around the front of the house and wentWe told
them how large the family was that had lived in the house as tenantsWe
explained again that the house needed paint and carpetWe also talked about
the steps that needed some repair. We went upstairs for awhileMy husband, ***, was
downstairs at the point. We finished up the showingWe went outside and
proceeded to the end of the sidewalk by our van*** had her daughter in her
arms and *** was by her side*** was in the drivers seat. We had a
conversation about the property again We
reminded them that the property was a short saleWe told them that the bank
had accepted and where the house was priced now.*** said that she liked the house and that she wanted to
make an offer on the house. I asked her when she would you like to do so?
She said that she was flexibleWe suggested after work Monday around 5:00pm or 5:30pm *** said she would like to meet at lunchI
asked if 12:or 12:would work for herShe agreed to that timeI told *** that I would write up the offer at the 160K
and ask for 3% in closing costsWe agreed to review everything on Monday when
we met. *** said,"Ok I'll see you then"I asked her for her
email address so that when I got back to a computer where I could scan
the buyer broker agreement I could email
to over to her. She gave it to meWe also spoke about her lender
preapproval letter She said that she would just have to call the lady and get
her to get us a copy.She was RD qualified she said because we spoke about the
house having to qualify just not you as the buyerThe house must be located in
a certain area I offered to double check for her but she said no I know its
good.We all left and I wrote up an offer on Sunday so that it
would be ready for *** on Monday at 12:when we were scheduled to meet.When I arrived at the office on Monday morning, I received a
phone call while in my team leaders office, Mark G*** He teaches the Real
Estate classes so he knows protocol. It was *** stating that she
didn't know what she signedShe stated that she hadn't received a copy of the
agreement. She said that her finance,
***, has an agent that she's working with She stated she did not want
to be in an agreement I shared with her
that she signed the agreement and that if she shared with me who she was
wanting to work with that we could work something out with that other Realtor.She hung up on me and proceeded to the front office
receptionist and say things that were not true about me and about the house *** proceeded to call my broker, Richard P***
(NOT Robert). Richard was not in at that
time. *** left a message for him. I spoke with Richard and we both sat down in his office that
morning within minutes of *** leaving that message Richard called her back but she did not answer
Richard left a message stating that he and I were together and that we wanted
to resolve the issu. Richard said he never received a phone call back.*** has made accusations about the previous tenants,
whom I did NOT represent! I had never heard anything about them doing or
having drugsThey had young children, dogs, cat and a guinea pig.
I never saw any cats under the house nor did I ever have a conversation about
this to ***. The majority of what *** has stated is and I
would like her complaint to be deleted because it is ALL hearsay and this lady
does not have any facts to back up what she is saying.I will release *** from her agreement with me because
this is what she is requestingHowever I do NOT agree with what she has said
about me and the complaint needs to be retractedI have a reputable business
and do things the right way and don't appreciate people like ***
manipulating a situation and making statements, not only about me but
about other people including the past tenants.Both buyer broker agreements that *** *** signed are

Review: I met Barbara J[redacted] and her husband [redacted] on Saturday, November 21, 2015 at 3:30 pm to view [redacted]. Barbara informed me the information she has is what a realtor is supposed to do since this is my first home. She then stated she had a form for me to sign which was the disclosure about the property because it was being sold as is, it had no electricity, and if I wanted to purchase and have an inspection I had to have the water, electric, etc. turned on. Barbara stated it was only for that home so I trusted her and signed. I called her this morning; Monday, November 23, 2015 at 9:14 am to inform her I did not want the property because of the issues she did not tell me such as previous tenants illegaly sold drugs, cats housed under the home in the insillation which my daughter has a severe allergy to cats, and other issues with the house she failed to speak on. She was the leasing agent to the tenants who rented the property who was forced to move prior to showing the home. Barbara then emailed me a broker agreement which I was not given nor told about. She covered the last two pages and said it was only the property disclosure of what is not being fixed, short sale, etc. I informed Barbara I did not agree to her being my broker. Barbara informed me I could choose any realtor but have them call her. If I can choose any realtor why need to forcefully be under contract with her I said. I then called Robert her broker and left a message, I didn't get a call back. I feel Barbara forced herself and a contract on me I did not know anything about.Desired Settlement: Remove/terminate the so called "buyer agreement" that I had no knowledge, agreeance or given detail about.
