I purchased a product that later the same day was determined to harm my eye, but was not allowed a refund. I have a product I cannot use.On 11/27/15 I purchased 2 products from Supreme Cosmetics at their cart at Cary Village Mall, Cary, NC. I was stopped while walking by with my granddaughter, who is 3. I asked about a product for my son-in-law, but was shown a product for me. The product is a cream for the eye. It was applied to my right eye with a lot of fanfare; employees were noting how amazing the change was with two products applied. I was shown a mirror and was unsure of the effect, but hoped it was true. I was kept on one side of the cart the entire time. My granddaughter was kept busy by two other employees. Price was reduced several times and then a second jar was added free to give to my sister for Christmas, as I had noted that I couldn't spend the money, it was for Christmas presents. I accepted the offer, feeling pressured into it but hoping it was as effective as all of the employees cheerfully noted. I paid $300 with my debit card.The same evening at home my right eye, the same eye the product was applied to, was irritated and red. I had told sales reps I have sensitive eyes and was skeptical about product. I attempte to return product 11/30/15. Told to call a man named [redacted] in FL. I spoke with him at XXX-XXX-XXXX after an employees finally reached him on my phone. He said to email him at [redacted]@gmnail.com. Sales reps said he would allow them to refund my money. I emailed him on 12/1/15. On 12/2/15 with no response I called all numbers given to me by sales reps when I asked for them. The result was unsuccessful; also called [redacted] himself at same number "not in service." Earlier, [redacted] had stated he had a no refund policy. However, I explained to him that this policy was printed on his receipt AFTER I purchased the product, and was noted on a small card behind the computer (whose screen had to be moved in order to see the policy) on the opposite end of the cart from where I was kept during the sale. At that time I asked about the return policy and was told they would easily be able to find me a product to use, and then I was distracted by other sales reps and my granddaughter, causing me to divert my attention elsewhere. I again returned product (unopened) to mall and was told to go to the mall office and they would direct the sales reps to refund my money. Completed form for mall and was told when mgmt would be there. On 12/3/15 I left messages for both asst and mgr. On 12/4/15 spoke with asst mgr, [redacted] (919-467-0145 ext227) who stated the mall couldn't tell them to refund money. She stated she would email [redacted] and ask him to call me, and that his business was up for review by mall mgmt and she will consider this complaint as she has had more complaints about them recently. She stated he was not in Florida but was local. On 12/4/15 [redacted] called me and we discussed my situation; he stated his no refund policy and I explained the above. We spoke back and forth and he did not care about the mall review, just kept repeating his return policy. On 12/8/15 spoke with my sister about a possible friend of ours helping me, as I felt a male might get further with [redacted] than a female. On 12/17/15 our friend said he could help me (he had had a second transplant surgery and it was unsure whether he was well enough)and wanted to talk with [redacted] in person. Per [redacted] he was evicted from Cary Mall. Stated he still has carts at Triangle Town Center and a kiosk at the Streets of Southpoint. Called Triangle at XXX-XXX-XXXX and Southpoint at XXX-XXX-XXXX. Left message for [redacted] asst mgr at Triangle and for [redacted] mgr at Southpoint. On 12/17/15 received a call from [redacted] asking angrily "What do you want!?" I did not ask him to call me again, but I stated that my friend would be calling him and he angrily stated his policy again, and that the manager from Triangle had contacted him. When asked, gave same number to contact him. As I am disabled, it sometimes takes me longer to complete things, which is the reason this is filed at this time.Desired SettlementI am seeking a refund of $300 as I feel the refund policy of this business was purposely kept from me by the distraction of the sales reps during the conversation about it, the printed policy on the receipt after purchase, and the lack of the policy noted at the cart in a place where consumers can easily see it. Since the product was harmful to my eye, I don't feel I have a product I can use at all. The product was never opened. I do not want an exchange as this business has this one product for eyes. I have no interest in other facial products. Even if they had other eye products, I don't believe they would be any safer for my eyes than this product.
