I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
The business response was lengthly and detailed so I have addressed each point in the attachmentMy response are in red type.Also attached are the A* *** ** *** complaints currently in process.On July 25, 2014, SureBuild Roofing, LLC inspected the roof located at*** ***, Cornville, AZ for water penetrationAt this time, SureBuild Roofing, LLC checked all seams and scuppers and inspected said roof looking for possible penetrationI,*** ***, brought up the fact that the parapet walls werevented with large gable vents in the same area where the leaks had occurredI was met with hostility over my suggestion that the water could be coming through the parapet venting systemNote that all the water penetrations into the home were below gable vents installed in the parapet wallsI did not want to argue with Mr*** at this point,I just checked the roof for any issues and had the drywall repaired.The leaks were not at the attic vents but some were at the scuppers and the roofer is responsible for making these leak freeThere were also seams that were not “welded” as you could slip your hand under themThis was were one of the major leaks wasIt was shown to the roofer and they checked all seams on the roofThere was a seam leaking that was in a place that was inappropriate and the seamcould have been in a better location to avoid a problemNot mentioned was the fact we are talking about two homesThe exact same home next door built months laterSame seam in same place and and same leaks as the first homeThere wasno hostility as he was fully cooperating to correct the problemHe was trying to indicate the vents might be a problem but they are designed to do the job and have been used on dozens of similar homes and none of them have a problemTwoother homes across the street have the same vents and I live in oneNo problemsThe leaks were at the scuppers.*** ***, the builder of said homes, insisted on painting the repaired drywall himself with paint left over from the original painting of the home.The roofer had the drywall in both homes repaired and the builder did the touch up paint and all repairs were acceptable.Please note that the above water penetration was in July of This new water penetration issue occurred in January We received a call from Mr.*** that there was a drywall problem at *** *** ***, Cornville, AZ.Again, there were leaks at this time in both homes, not just the oneAlso, again they were the only ones with leaks.We responded within hours and inspected all seams and scuppersOnce again, all water penetration was under the gable vents installed in the parapet wall venting systemI was once again met with hostility over my suggestion that the watercould and is coming through the gable vents installed in the parapetsAgain, no hostilityFrom either sideAnd once again above each leak was a scupper, not an attic ventRoofer mentioned he fired the guy whom detailed the roofs the first time because of this sort of thingIt was also reported that pinholes were found at some scuppers and fixed.Please note that from July of through January the monsoon season and the start of winter, the home had no water penetrationThe gable vents installed in the parapet walls in question are on the downhill side of the roof, and some ofthese vents are less then 6" from the modified bitumen roof system.None of the vents are below 6” and all are over 8” above the roofThis of course can be physically verifiedThey are also no different than any of the other dozens of similar homes we have built, without leaks.The snowfall of this January event was or more inches. The snowfall was 6” I measured it myself and meteorological records will also bear this out.The wind blew the snow against the gable vents installed in the parapet wall and when the snow melted it simply ran into the open ventsIf the gable vents would have been installed on the outside of the parapet wall, then there would have been no snow build up and the vents would have worked the way they were designed to be installed.Again they are installed and functioning properlyThis is just obfuscation on the part of the roofer.To answer the alleged statement, "SureBuild roofing's owner stated he does not like these roofs because of this and cannot get employees that can do them well", I do not recall this conversation.The statement was verbatim “I hate these roofs” Followed by the statement “it is hard to hire people to do them well”I agreed it was hard to get good help hereWhat I do recall is stating thatI prefer the elastomeric fabric roof systems and/or the double layer modifiedbitumen system over the single ply modified bitumen roof systems, which • are more expensive systemsPlease note that I did not meet with the owner, *** ***,I met with his son Mr*** at the home in questionOnce again we are talking about two homes that both leaked twice.In this complaint it is stated that my employees did the repair in an unprofessional mannerPlease note that I have had a General Contracting license in three states and have a valid roofing license in the state of ArizonaI also hold a real estate license in the state of ArizonaI am still actively general contracting in the state of Arizona and have full time carpenters and painters employed in my company.More obfuscationWhat’s the point pointThat’s not a defense.I had been pre-warned from two of my employees, *** *** and *** ***, thatMr*** had come into the home and had insulted my employees over the fact that they did not use the paint stored in the garage*** *** had gone to *** in Cottonwood, AZ and had bought new paint matching in colorAt this point, Mr*** took my employees into the garage and gave them a galloncan of paint, marked as "stain" and told them to put a 3rd coat over the *** paintMy employees did just what Mr*** told them to do.Mr*** returned only to tell them that the paint did not matchMr*** told Mr*** that the paint was still wet and needed to dryAfter this encounter with Mr***, my employees packed up their tools and left.No insults were given to anybodyIt does not help get a job doneI showed up just as they were finishingIt was their first visitTo do the job properly and professionally the repairs would need to be primed and at least two coats of paint applied with the required drying time between coats taking at least two days and trips.It was obvious this was meant to be their only trip as they said they were doneTo do this they applied the paint very heavy in one coat leaving an obviousheavy texture that did not match the rest of the finished surfacesThey also put the*** vent on directly to the wet paintAlso completely unprofessionalI asked them to immediately remove the vent so it would not be glued to the ceiling.This was obviously the “insult”I showed them the original paint can that had the label clearly on the top of the paint can showing the distributor, paint color and typeI asked that they come back the next day and apply a coat of this paintAnother insult? They did but the texture from the day before was really bad and it did no good to re coat the damaged areas. I then met Mr***, not *** ***, at the property and walked the home with Mr***We met in the kitchen/ dining room area and Mr*** had used some white patch material around the heating and cooling vent and stated that my employees' had done a poor job of painting this area and I agreed seeing the patch materialAt that time, I did not understand that Mr*** had installed the patch material after my painters had left.When they removed the vent a piece of drywall mud fell off and when they replaced it there was a visible gap were the drywall mud had fallen off.Mr*** then suggested that he use his own painter to touch up the paint and blend it in to match with the existing paint and I did agree to thatNote, "blend it in to match existing ceiling paint", not paint the whole bouseOnce I received the billing for painting the entire home, I told Mr*** I would not pay the billMr*** told me I would need to talk to Mr***I called Mr.*** and told him I would not pay for the whole houseThen Mr.*** then told me that the paintwe bought from *** did not match and that was the problemI then infonned Mr.*** that Mr*** bad .given us the interior paint thatwas in the stain can to useMr*** then told me that paintwas not good as it had frozen.On the first visit that was not arranged they did not find the paint and took it upon themselves to get the paintA simple phone call would have avoided the problemMy number is known and also posted on no less than signs outside and on flyersin the homeI pointed out the can after they were done the first dayThe paint was stored indoors and with our climate, that means it would never freeze no matter what term anybody uses.Also, please note that I brought my flashlightinto the home and flashed the walls pointing out that the paint job was questionableMr*** told me that they had painted the home themselves by hiring individual to help them paintMr*** said they did not make that mistake on the second home and that they hired professional painters.Both homes were painted by licensed contractors without our “help” I was not happy with the level of service and communication with the painter of the first home but the job was acceptable if not perfectDocumentation can be provided on the painting contractor upon requestSo I obviously did not say we painted it or helped to paint it.I also talk with the owner of *** *** ***, Mr.***, who Mr*** had come back to the property and do textUre touch up all over the homeMr*** told me that where there had been water penetration, at the most it was 20% ofthe work he did in said homeMr*** was upset over having to do so much additional work to the drywall due to the fact that Mr.***, up to January 2015, had neverheated or cooled the home, which had a negative affect on thedrywall."With all of this being said, the simple fact is that there were three areas of water penetration: Penetration !(guest bedroom), Penetration 2(master bedroom), and Penetration (dining area)All penetration areas were under a gable vent installed in a parapet wall on the interior of the roof system where the snow built up above said gable vent.Once again if you look outside where the interior damage was you will see a roof scupperIt is the roofers job the ensure there are no leaks at all penetrations.The drywaller did do some additional repairs and most were due to a poor drywall finish job and the drywall contractor is well aware of this. Mr*** had stated to me that SureBuild Roofing, LLC was still their roofing company.YesAt this point *** had taken full responsibility for the leaks and was taking care to make things right.I had only agreed to pay to repair the areas of water penetration in the tbree areas, ceilings only, as a way to resolve the problem, for future work.Three rooms in one home and four in the other homeNot only ceiling damage but also around the windows were the water also came down the window header and did paint and drywall damageThe whole interior of the homes was not repainted but extensive painting was required so that the paint matchedIt’s hard to find a stopping point and these are brand new homes that required being brought up to that level after the damageThe ceilings alone would be over sq ft of materailThe painter discounted the price because it was so extensive and we did have him do some touch up while he was thereHe would be willing to verify thisAt known time, to the best of my recollection, did I ever state that the waterpenetration was caused by my installation of the roof system.If Mr*** would have not insulted my employees, they would have come back and finished the painting in a workmanship manner and this would not be an issue.His recollection is a mute pointThe unwelded seams on the first visit and the pinholes his employees found at the scuppers not to mention the time and money spent fixing the roofs, drywall and paint on two home two separate times speaks for itselfI’m thinking it was not charity..Mr*** is trying to extort money from SureBuild Roofing, LLC and myself, the owner of the company, *** ***.If we were trying to extort money we would throw out the paint invoices and try to charge him for the hours we spent resolving all of these incidences (I was told by the salesman I was entitled to this and bill accordingly) I did notWe would also charge for the month both homes were pulled off the market during our busyselling seasonThe hours the cleaning lady spent in both homes making them show ready again (lots of drywall dust and paint on carpet and floors after the roofers employees)Also the largest financial damage of now having to disclose to a potential buyer that both homes have already experienced roof leaksThis is potentially tens of thousands of dollarsAll we are asking for is to compensate for the painterA pretty good deal in light of all that.Once Mr.*** returned to Arizona, I, *** ***, and my employees *** *** and *** ***, met at *** *** *** ***, Comville,AZ, to try to settle this issueI did, at that time; offer to over pay for water penetration from gable vents installed in the parapet wall.More obfuscation again with the attic ventsHe did agree to pay the bill for one houseAgain, why offer to pay if it is not his problem? Why only one house?I had offered to pay 50% of what Mr*** had asked forAt this time I am rescinding this offer.It is unreasonable to state that the whole home had to be repainted including bedrooms, bathrooms, living rooms, closets, hallways and garage.And once again the whole of the homes was not repaintedThe garage mention is goodHe tried to blame that on something else alsoThe issue that caused that leak at that roof penetration is still there and was missed by the roofers both times they detailed the roofs to fix the leaksIt is available for inspection and would leak again if we have another 6” snowfall. The point is this was a roofing problem that to date seems to be fixed and has withstood several good rains (excepting the issue at the garage roof penetration)The roofer stepped up throughout the whole process, taking responsibility for the problems and correcting the damage up until the endI think he tired of the accumulating issues and expenses and finally stepped away and at that time tried to claim no responsibilityThis is hard issue for a roofer and even more so in a small town like ours where something like this will hurt id not close a business so it is not surprising the defensive responseAll we still ask for is due compensation for actual damaged and not all the other factors that far outweigh the two painting invoices

In response to *** *** most recent statements and/or complaint, I do not believe this back and forth argument of minute details helps resolve this issueSimply stated, regardless of the cause and/or source of these alleged allegations, I had agreed to pay for reasonable paint repair and have already paid for necessary drywall repairs that I do not believe were caused by any work that SureBuild Roofing didMr*** request of $to paint one coat of paint on ceilings in one home and ceilings in another is very expensive and extensiveMr*** states that each home had to be completely repainted because of water damage and drywall repair on said ceilings and as stated, said repairs that I do not believe were caused by any work that SureBuild Roofing did.I, *** ***, owner of SureBuild Roofing, had offered to pay 50% of said cost of each home ($1,950.00) to try to resolve this issue but my offer of 50% of said cost was rejectedMr*** has taken this complaint to the *** ** *** and they have dismissed said complaints as unfounded to the best of my knowledgeI feel Mr*** is trying to hold my company, SureBuild Roofing and myself, *** ***, responsible for invoices to paint the interior of two homes including the garages with no basis other than personal financial gain.If Mr*** continues down this path, I feel that Mr*** need to have a letter from his painter stating that our work was inferior and why it was inferiorMr*** also needs to have a licensed contractor and engineer write an opinion on said exterior roof/wall vents that I believe are not designed to be installed the way that they have been in said homesAt this point, all party’s can move forward with professional construction consultants and/or legal avenues to put an end to these issuesI also believe that the Revdex.com should not take any action against my company or myself without the additional information stated aboveAny action by the Revdex.com would be unfounded at this time since I did offer and tried to take care of said alleged damage that once again, I do not believe that SureBuild Roofing was in any way responsible

Once again, we wish to apologize for any inconvenience and wish to explain our side of the story. When Andrews phones came in we treated it like any other phones, we started heating the glass and started to remove it. However, his glue was not like other glues. It was tacky, sticky and so forth....

This puts a lot of strain on an LCD. After we removed it, we cleaned the glass and everything seemed to be just fine. We replaced the glass and he was out the door. Unfortunately, the strain cause the LCD to go black. We ordered a new LCD on our dime, it came in defective (out of our control.) Scrambling to get his phone up and running because he couldn't leave his phone, we refurbished a Preowned LCD and put that on his phone. We do Lifetime warranty on all repairs. So at any point Andrew is welcome to come in and get it fixed. But we do not do lifetime refunds. We will fix the problem, but we spend a lot of money during a repair. So we don't just give out refunds for no apparent reason. Even at this point with the damage Andrew has been attempting to cause us via social media and Revdex.com we still offer the lifetime warranty on repairs. The claims made about the owner saying "I wish we could see someone like you coming" we're true. Andrew harassed us and every post we put up including our customers. We tried to settle the matter correctly but ultimately it ended in him getting kicked out of a very popular FaceBook group as the admins found his behavior in appropriate. He has left bad reviews for many other businesses. Although we wish to fix his phone, we do not wish to do further business with this individual. Thank you for allowing us to reply to this unreasonable person.

Note, "blend it in to match existing ceiling paint", not paint the whole bouse. Once I received the billing for painting the entire home, I told Mr. [redacted] I would not pay the bill. Mr. [redacted] told me I would need to talk to his father. Mr. [redacted] stated,"I don't have a bone in this fight." I called Mr. [redacted] and told him I would not pay for the whole house. Then Mr.[redacted] then told me that the paintwe bought from [redacted] did not match and that was the problem. Also, please note that I brought my flashlightinto the home and flashed the walls pointing out that the paint job was questionable. Mr. [redacted] said they did not make that mistake on the second home and that they hired professional painters. I also talk with the owner of [redacted], Mr. [redacted], who Mr. [redacted] had come back to the property and do textUre touch up all over the home. Mr. [redacted] told me that where there had been water penetration, at the most it was 20% of the work he did in said home. Mr. [redacted] was upset over having to do so much additional work to the drywall due to the fact that Mr. [redacted], up to January 2015, had never heated or cooled the home, which had a negative affect on the drywall. Mr. [redacted] had also stated to myself and [redacted], one of my employees, that, "Mr. [redacted] is so cheap he has never heated or cooled the house,"I'm having propane delivered ASAP."
With all of this being said, the simple fact is that there were three areas of water penetration: Penetration 1(guest bedroom), Penetration 2(master bedroom), and Penetration 3 (dining area). All penetration areas were under a gable vent installed in a parapet wall on the interior of the roof system where the snow built up above said gable vent. Mr. [redacted] had stated to me that SureBuild Roofing, LLC was still their roofing company and stated that [redacted] are plagued with more problems ,than other types of homes. I had only agreed to pay to repair the areas of water penetration in the tbree areas, ceilings only, as a way to resolve the problem, for future work. At known time, to the best of my recollection, did I ever state that the water penetration was caused by my installation of the roof system.
If Mr. [redacted] would have not insulted my employees, they would have come back and finished the painting in a workmanship manner and this would not be an issue. .Mr. [redacted] is trying to extort money from SureBuild Roofing, LLC and myself, the owner of the company, [redacted].
Once Mr. [redacted] returned to Arizona, I, [redacted], and my employees [redacted] and [redacted], met at [redacted], Comville, AZ, to try to settle this issue. I did, at that time; offer to over pay for water penetration from gable vents installed in the parapet wall. I had offered to pay 50% of what Mr. [redacted] had asked for. At this time I am rescinding this offer.
It is unreasonable to state that the whole home had to be repainted including bedrooms, bathrooms, living rooms, closets, hallways and garage.

I did not want to argue with Mr. [redacted] at this point,I just checked the roof for any issues and had the drywall repaired.The leaks were not at the attic vents but some were at the scuppers and the roofer is responsible for making these leak free. There were also seams that were not “welded” as you could slip your hand under them. This was were one of the major leaks was. It was shown to the roofer and they checked all seams on the roof. There was a seam leaking that was in a place that was inappropriate and the seamcould have been in a better location to avoid a problem. Not mentioned was the fact we are talking about two homes. The exact same home next door built 6 months later. Same seam in same place and and same leaks as the first home. There wasno hostility as he was fully cooperating to correct the problem. He was trying to indicate the vents might be a problem but they are designed to do the job and have been used on dozens of similar homes and none of them have a problem. Twoother homes across the street have the same vents and I live in one. No problems. The leaks were at the scuppers.[redacted], the builder of said homes, insisted on painting the repaired drywall himself with paint left over from the original painting of the home.The roofer had the drywall in both homes repaired and the builder did the touch up paint and all repairs were acceptable.Please note that the above water penetration was in July of 2014. This new water penetration issue occurred in January 2015. We received a call from Mr.[redacted] that there was a drywall problem at [redacted], Cornville, AZ.Again, there were leaks at this time in both homes, not just the one. Also, again they were the only ones with leaks.We responded within hours and inspected all seams and scuppers.. Once again, all water penetration was under the gable vents installed in the parapet wall venting system. I was once again met with hostility over my suggestion that the watercould and is coming through the gable vents installed in the parapets. Again, no hostility. From either side. And once again above each leak was a scupper, not an attic vent. Roofer mentioned he fired the guy whom detailed the roofs the first time because of this sort of thing. It was also reported that pinholes were found at some scuppers and fixed.Please note that from July of 2014 through January 2015 the monsoon season and the start of winter, the home had no water penetration. The gable vents installed in the parapet walls in question are on the downhill side of the roof, and some ofthese vents are less then 6" from the modified bitumen roof system.None of the vents are below 6” and all are over 8” above the roof. This of course can be physically verified. They are also no different than any of the other dozens of similar homes we have built, without leaks.The snowfall of this January 2015 event was 8 or more inches. The snowfall was 6” . I measured it myself and meteorological records will also bear this out.The wind blew the snow against the gable vents installed in the parapet wall and when the snow melted it simply ran into the open vents. If the gable vents would have been installed on the outside of the parapet wall, then there would have been no snow build up and the vents would have worked the way they were designed to be installed.Again they are installed and functioning properly. This is just obfuscation on the part of the roofer.To answer the alleged statement, "SureBuild roofing's owner stated he does not like these roofs because of this and cannot get employees that can do them well", I do not recall this conversation.The statement was verbatim “I hate these roofs” Followed by the statement “it is hard to hire people to do them well”. I agreed it was hard to get good help here. What I do recall is stating thatI prefer the elastomeric fabric roof systems and/or the double layer modifiedbitumen system over the single ply modified bitumen roof systems, which • are more expensive systems. Please note that I did not meet with the owner, [redacted],I met with his son Mr. [redacted] at the home in question. Once again we are talking about two homes that both leaked twice.In this complaint it is stated that my employees did the repair in an unprofessional manner. Please note that I have had a General Contracting license in three states and have a valid roofing license in the state of Arizona. I also hold a real estate license in the state of Arizona. I am still actively general contracting in the state of Arizona and have full time carpenters and painters employed in my company.More obfuscation. What’s the point point. That’s not a defense.I had been pre-warned from two of my employees, [redacted] and [redacted], thatMr. [redacted] had come into the home and had insulted my employees over the fact that they did not use the paint stored in the garage. [redacted] had gone to [redacted] in Cottonwood, AZ and had bought new paint matching in color. At this point, Mr. [redacted] took my employees into the garage and gave them a 1 galloncan of paint, marked as "stain" and told them to put a 3rd coat over the [redacted] paint. My employees did just what Mr. [redacted] told them to do.Mr. [redacted] returned only to tell them that the paint did not match. Mr. [redacted] told Mr. [redacted] that the paint was still wet and needed to dry. After this encounter with Mr. [redacted], my employees packed up their tools and left.No insults were given to anybody. It does not help get a job done. I showed up just as they were finishing. It was their first visit. To do the job properly and professionally the repairs would need to be primed and at least two coats of paint applied with the required drying time between coats taking at least two days and 3 trips.It was obvious this was meant to be their only trip as they said they were done. To do this they applied the paint very heavy in one coat leaving an obviousheavy texture that did not match the rest of the finished surfaces. They also put the[redacted] vent on directly to the wet paint. Also completely unprofessional. I asked them to immediately remove the vent so it would not be glued to the ceiling.This was obviously the “insult”. I showed them the original paint can that had the label clearly on the top of the paint can showing the distributor, paint color and type. I asked that they come back the next day and apply a coat of this paint. Another insult? They did but the texture from the day before was really bad and it did no good to re coat the damaged areas. I then met Mr. [redacted], not [redacted], at the property and walked the home with Mr. [redacted]. Not only ceiling damage but also around the windows were the water also came down the window header and did paint and drywall damage. The whole interior of the homes was not repainted but extensive painting was required so that the paint matched. It’s hard to find a stopping point and these are brand new homes that required being brought up to that level after the damage. The ceilings alone would be over 2200 sq ft of materail. The painter discounted the price because it was so extensive and we did have him do some touch up while he was there. He would be willing to verify this. At known time, to the best of my recollection, did I ever state that the waterpenetration was caused by my installation of the roof system.If Mr. [redacted] would have not insulted my employees, they would have come back and finished the painting in a workmanship manner and this would not be an issue.His recollection is a mute point. The unwelded seams on the first visit and the pinholes his employees found at the scuppers not to mention the time and money spent fixing the roofs, drywall and paint on two home two separate times speaks for itself. I’m thinking it was not charity..Mr. [redacted] is trying to extort money from SureBuild Roofing, LLC and myself, the owner of the company, [redacted].If we were trying to extort money we would throw out the paint invoices and try to charge him for the hours we spent resolving all of these incidences (I was told by the salesman I was entitled to this and bill accordingly) I did not. We would also charge for the month both homes were pulled off the market during our busyselling season. The hours the cleaning lady spent in both homes making them show ready again (lots of drywall dust and paint on carpet and floors after the roofers employees). Also the largest financial damage of now having to disclose to a potential buyer that both homes have already experienced roof leaks. This is potentially tens of thousands of dollars. All we are asking for is to compensate for the painter. A pretty good deal in light of all that.Once Mr.[redacted] returned to Arizona, I, [redacted], and my employees [redacted] and [redacted], met at [redacted], Comville,AZ, to try to settle this issue. The garage mention is good. He tried to blame that on something else also. The issue that caused that leak at that roof penetration is still there and was missed by the roofers both times they detailed the roofs to fix the leaks. It is available for inspection and would leak again if we have another 6” snowfall. The point is this was a roofing problem that to date seems to be fixed and has withstood several good rains (excepting the issue at the garage roof penetration). The roofer stepped up throughout the whole process, taking responsibility for the problems and correcting the damage up until the end. I think he tired of the accumulating issues and expenses and finally stepped away and at that time tried to claim no responsibility. This is hard issue for a roofer and even more so in a small town like ours where something like this will hurt id not close a business so it is not surprising the defensive response. All we still ask for is due compensation for actual damaged and not all the other factors that far outweigh the two painting invoices.

Review: Sure Build Roofing was hired to install roofs on two new homes about six months apart. The new roof on the first home leaked in several places causing drywall and paint issues. Sure Build Roofing detailed the roof to make sure all leaks were eliminated and paid for drywall repairs and we did the paint repair. Approximately 6 months later they installed a roof on another new home next door. That roof also leaked in the same way the first home did also causing damages similar to the first and it was resolved in the same way. After the first of the year about 3 days after a 5 inch snowfall we discovered roof leaks in both houses in 3 rooms. There was again a good bit of drywall and paint damage. Sure Build Roofing had the drywall repaired and sent two of their employees to do the paint touch up. The paint touch up was done in an unprofessional manner and in such a way as to do it in one trip. The drywall patches were not primed as they should be and one very heavy coat of paint was applied and left a very rough textured surface that contrasted with the rest of the surface and caused the drywall patch underneath to bleed trough in several places. In one home they could not find the original paint that was available and without contacting us took it upon themselves to match and purchase paint for the job. Without knowing the color, brand or type of paint that was used. This caused the paint to not match. After having the owner of Sure Build Roofing come see these repairs he agreed they were not done properly. I told him we would have a professional painter come and resolve the problem at his expense. This required extensive interior painting to both brand new homes. The painter even discounted the price because it took so much time to accomplish. The paint repairs came in at $1,950.00 per home and Sure Build Roofing has refused to pay for the repairs.Desired Settlement: We desire Sure Build Roofing to compensate us for the $3,900.00 painting bill to fix the problem correctly. This price does not reflect the 4 weeks the homes were taken off the market while the repairs were being done. The unquantifiable damage that is caused by now having to disclose all of this to any buyer of these homes as required by law. My time spent having to deal with all the people and problems this has caused. The time and money spent cleaning the homes after all the repairs.

Once again, all water penetration was under the gable vents installed in the parapet wall venting system. I was once again met with hostility over my suggestion that the watercould and is coming through the gable vents installed in the parapets. Again, no hostility. From either side. And once again above each leak was a scupper, not an attic vent. Roofer mentioned he fired the guy whom detailed the roofs the first time because of this sort of thing. It was also reported that pinholes were found at some scuppers and fixed.Please note that from July of 2014 through January 2015 the monsoon season and the start of winter, the home had no water penetration. The gable vents installed in the parapet walls in question are on the downhill side of the roof, and some ofthese vents are less then 6" from the modified bitumen roof system.None of the vents are below 6” and all are over 8” above the roof. This of course can be physically verified. They are also no different than any of the other dozens of similar homes we have built, without leaks.The snowfall of this January 2015 event was 8 or more inches. The snowfall was 6” . I measured it myself and meteorological records will also bear this out.The wind blew the snow against the gable vents installed in the parapet wall and when the snow melted it simply ran into the open vents. If the gable vents would have been installed on the outside of the parapet wall, then there would have been no snow build up and the vents would have worked the way they were designed to be installed.Again they are installed and functioning properly. This is just obfuscation on the part of the roofer.To answer the alleged statement, "SureBuild roofing's owner stated he does not like these roofs because of this and cannot get employees that can do them well", I do not recall this conversation.The statement was verbatim “I hate these roofs” Followed by the statement “it is hard to hire people to do them well”. I agreed it was hard to get good help here. What I do recall is stating thatI prefer the elastomeric fabric roof systems and/or the double layer modifiedbitumen system over the single ply modified bitumen roof systems, which • are more expensive systems. Please note that I did not meet with the owner, [redacted],I met with his son Mr. [redacted] at the home in question. Once again we are talking about two homes that both leaked twice.In this complaint it is stated that my employees did the repair in an unprofessional manner. Please note that I have had a General Contracting license in three states and have a valid roofing license in the state of Arizona. I also hold a real estate license in the state of Arizona. I am still actively general contracting in the state of Arizona and have full time carpenters and painters employed in my company.More obfuscation. What’s the point point. That’s not a defense.I had been pre-warned from two of my employees, [redacted] and [redacted], thatMr. [redacted] had come into the home and had insulted my employees over the fact that they did not use the paint stored in the garage. [redacted] had gone to [redacted] in Cottonwood, AZ and had bought new paint matching in color. At this point, Mr. [redacted] took my employees into the garage and gave them a 1 galloncan of paint, marked as "stain" and told them to put a 3rd coat over the [redacted] paint. My employees did just what Mr. [redacted] told them to do.Mr. [redacted] returned only to tell them that the paint did not match. Mr. [redacted] told Mr. [redacted] that the paint was still wet and needed to dry. After this encounter with Mr. [redacted], my employees packed up their tools and left.No insults were given to anybody. It does not help get a job done. I showed up just as they were finishing. It was their first visit. To do the job properly and professionally the repairs would need to be primed and at least two coats of paint applied with the required drying time between coats taking at least two days and 3 trips.It was obvious this was meant to be their only trip as they said they were done. To do this they applied the paint very heavy in one coat leaving an obviousheavy texture that did not match the rest of the finished surfaces. They also put the[redacted] vent on directly to the wet paint. Also completely unprofessional. I asked them to immediately remove the vent so it would not be glued to the ceiling.This was obviously the “insult”. I showed them the original paint can that had the label clearly on the top of the paint can showing the distributor, paint color and type. I asked that they come back the next day and apply a coat of this paint. Another insult? They did but the texture from the day before was really bad and it did no good to re coat the damaged areas. I then met Mr. [redacted], not [redacted], at the property and walked the home with Mr. [redacted]. We met in the kitchen/ dining room area and Mr. [redacted] had used some white patch material around the heating and cooling vent and stated that my employees' had done a poor job of painting this area and I agreed seeing the patch material. At that time, I did not understand that Mr. [redacted] had installed the patch material after my painters had left.When they removed the vent a piece of drywall mud fell off and when they replaced it there was a visible gap were the drywall mud had fallen off.Mr. [redacted] then suggested that he use his own painter to touch up the paint and blend it in to match with the existing paint and I did agree to that. Note, "blend it in to match existing ceiling paint", not paint the whole bouse. Once I received the billing for painting the entire home, I told Mr. [redacted] I would not pay the bill. Mr. [redacted] told me I would need to talk to Mr. [redacted]. I called Mr.[redacted] and told him I would not pay for the whole house. Then Mr.[redacted] then told me that the paintwe bought from [redacted] did not match and that was the problem. I then infonned Mr.[redacted] that Mr. [redacted] bad .given us the interior paint thatwas in the stain can to use. Mr. [redacted] then told me that paintwas not good as it had frozen.On the first visit that was not arranged they did not find the paint and took it upon themselves to get the paint. A simple phone call would have avoided the problem. My number is known and also posted on no less than 4 signs outside and on flyersin the home. I pointed out the can after they were done the first day. The paint was stored indoors and with our climate, that means it would never freeze no matter what term anybody uses.Also, please note that I brought my flashlightinto the home and flashed the walls pointing out that the paint job was questionable. Mr. [redacted] told me that they had painted the home themselves by hiring individual to help them paint. Mr. [redacted] said they did not make that mistake on the second home and that they hired professional painters.Both homes were painted by licensed contractors without our “help” I was not happy with the level of service and communication with the painter of the first home but the job was acceptable if not perfect. Documentation can be provided on the painting contractor upon request. So I obviously did not say we painted it or helped to paint it.I also talk with the owner of [redacted], Mr.[redacted], who Mr. [redacted] had come back to the property and do textUre touch up all over the home. Mr. [redacted] told me that where there had been water penetration, at the most it was 20% ofthe work he did in said home. Mr. [redacted] was upset over having to do so much additional work to the drywall due to the fact that Mr.[redacted], up to January 2015, had neverheated or cooled the home, which had a negative affect on thedrywall. ."With all of this being said, the simple fact is that there were three areas of water penetration: Penetration !(guest bedroom), Penetration 2(master bedroom), and Penetration 3 (dining area). All penetration areas were under a gable vent installed in a parapet wall on the interior of the roof system where the snow built up above said gable vent.Once again if you look outside where the interior damage was you will see a roof scupper. It is the roofers job the ensure there are no leaks at all penetrations.The drywaller did do some additional repairs and most were due to a poor drywall finish job and the drywall contractor is well aware of this. Mr. [redacted] had stated to me that SureBuild Roofing, LLC was still their roofing company.Yes. At this point [redacted] had taken full responsibility for the leaks and was taking care to make things right.I had only agreed to pay to repair the areas of water penetration in the tbree areas, ceilings only, as a way to resolve the problem, for future work.Three rooms in one home and four in the other home. Not only ceiling damage but also around the windows were the water also came down the window header and did paint and drywall damage. The whole interior of the homes was not repainted but extensive painting was required so that the paint matched. It’s hard to find a stopping point and these are brand new homes that required being brought up to that level after the damage. The ceilings alone would be over 2200 sq ft of materail. The painter discounted the price because it was so extensive and we did have him do some touch up while he was there. He would be willing to verify this. At known time, to the best of my recollection, did I ever state that the waterpenetration was caused by my installation of the roof system.If Mr. [redacted] would have not insulted my employees, they would have come back and finished the painting in a workmanship manner and this would not be an issue.His recollection is a mute point. The unwelded seams on the first visit and the pinholes his employees found at the scuppers not to mention the time and money spent fixing the roofs, drywall and paint on two home two separate times speaks for itself. I’m thinking it was not charity..Mr. [redacted] is trying to extort money from SureBuild Roofing, LLC and myself, the owner of the company, [redacted].If we were trying to extort money we would throw out the paint invoices and try to charge him for the hours we spent resolving all of these incidences (I was told by the salesman I was entitled to this and bill accordingly) I did not. We would also charge for the month both homes were pulled off the market during our busyselling season. The hours the cleaning lady spent in both homes making them show ready again (lots of drywall dust and paint on carpet and floors after the roofers employees). Also the largest financial damage of now having to disclose to a potential buyer that both homes have already experienced roof leaks. This is potentially tens of thousands of dollars. All we are asking for is to compensate for the painter. A pretty good deal in light of all that.Once Mr.[redacted] returned to Arizona, I, [redacted], and my employees [redacted] and [redacted], met at [redacted], Comville,AZ, to try to settle this issue. I did, at that time; offer to over pay for water penetration from gable vents installed in the parapet wall.More obfuscation again with the attic vents. He did agree to pay the bill for one house. Again, why offer to pay if it is not his problem? Why only one house?I had offered to pay 50% of what Mr. [redacted] had asked for. At this time I am rescinding this offer.It is unreasonable to state that the whole home had to be repainted including bedrooms, bathrooms, living rooms, closets, hallways and garage.And once again the whole of the homes was not repainted. The garage mention is good. He tried to blame that on something else also. The issue that caused that leak at that roof penetration is still there and was missed by the roofers both times they detailed the roofs to fix the leaks. It is available for inspection and would leak again if we have another 6” snowfall. The point is this was a roofing problem that to date seems to be fixed and has withstood several good rains (excepting the issue at the garage roof penetration). The roofer stepped up throughout the whole process, taking responsibility for the problems and correcting the damage up until the end. I think he tired of the accumulating issues and expenses and finally stepped away and at that time tried to claim no responsibility. This is hard issue for a roofer and even more so in a small town like ours where something like this will hurt id not close a business so it is not surprising the defensive response. All we still ask for is due compensation for actual damaged and not all the other factors that far outweigh the two painting invoices.
