In June of 2015, Susie Nelson started contacted me incessantly about joining in on a program that she was doing to promote my personal business to the next level of leadership. In this program, she guaranteed, in writing, that if this promotion did not happen by the end of 2015, she would issue a full refund of the payment by January 31, 2016. After going through the program fro 6 months, and her not holding up her end of the bargain with many contractual items, my promotion did not happen. During several Facebook message and email communications, starting on January 1, 2016, Susie assured memore than oncethat I would have my refund by, or before, January 31st. The evening of January 31st, Susie emailed me to let me know that she would have to issue the refunds on increments over the first week of February. I then asked her to give me dates and amounts that would be refunded throughout the wee and I have not heard anything from her since. We have a contract that needs to be refunded in the amount of $4,997.00 immediately.Desired SettlementI want my $4,997.00 that you took from my account and agreed to pay back on January 31, 2016.Business Response Prior to her filing this claim and other actions, I was willing to issue Ms. [redacted] a refund - even though I don't feel she lived up to the requirements of the program (in fact, I now believe it was her intention all along to use this to get 6 months of free coaching and training). As Newton's Third Law says: "For every action, there is an equal and opposite reaction." I have a high tolerance, but Ms. [redacted] has successfully [redacted] me off. Ms. [redacted] claimed she was planning to take me to small claims court. Although I have not yet been served paperwork, I have prepared a 10 page document, and supporting documentation including links to recordings and attendance records from the bi-weekly group calls; a summary of my notes from our weekly group coaching calls (including specific tasks I recommended implementing), my notes from individual and 3-way calls with team members, a summary of my notes from a transcript of our group text messages, and copies of the training outlines I provided for her use.I am looking forward to seeing her in-person at small claims court, presenting all of my documentation to the Magistrate, and reviewing all the details of this program. Until that time, no refund will be issued.Consumer Response To address the first paragraph, it is documented in the report that I submitted throughout the entire month on January Ms. Nelson agreed that she would be issuing me my refund. Then on January 31st at 11:03pm she sends an email asking for more time to submit small payments throughout the first week of February. When I asked for her to give me dates and amounts for that week, she went completely silent. As far as me utilizing this program to receive free training, that is absurd. I have spend lot of money over the years with Ms. Nelson for various training programs. This particular program was something she came up with last spring and constantly badgered me about for weeks about signing up for (even sending me Facebook messages at 2:00 and 3:00 am). I told her on several occasions that this was not a program that I could afford at the time, but she kept persisting given the money back guarantee and offered a payment plan-which I agreed to. It was not until after all payments were made, in August 2015, that I was contacted by a former student of hers that was still waiting for a refund for a program that Ms. Nelson never delivered upon (that program started in January 2015). As of last week, that refund has still not been issued to that former student. I did everything that was asked of me in this program and spent countless hours away from my family due to this. Ms. Nelson claimed in the contract that she would be traveling to our area each month to meet with our team mates. During this 6 month course, she only traveled to our area once (and that was just to get people to sign up and pay her more money). During the bi-weekly team connection calls, she did nothing to coach or help these girls (as was indicated in the contract) and they quickly lost interest and were no longer engaged. It is interesting to note that in Ms. Nelson's self published book, From Drowning in Debt to Financial Freedom, she openly talks about how she had money problems in the past and was borrowing from Peter to pay Paul even though she was making over $100K per year. It is my belief that she got herself back into this financial situation and needed my money to get her out. She has paid back debt with my money and has nothing left to be able to issue the refund promised.As for small claims court, that will be done in due time. In the meantime, I am utilizing another method first (that should be in my best interest). I am very happy that she has all of her documentation ready, as do I, because a contract is a contract and I did everything that was required for this program.
