Absolute fraud!
We went to purchase our 2020 Nissan Pathfinder on Jan 12th of 2020 at the Sutherland Nissan Cape Coral store on pine island road. The sales negotiation went as you would expect with the song and dance between the salesman and sales manager. We came to an agreement on price fairly quickly and sat down with the finance manager, where the fraud started. I told the finance manager up front I was not interested in any of the programs he had to offer including the extended 100K mile warranty or the maintenance plan. The finance manager then proceeded to tell us about a Lee County program where if you are members of *** club, Suncoast bank, and employees of our place of employment, we qualify for a Lee County rebate program that will cover the cost of the extended warranty and maintenance program. In disbelief I quizzed him on this county program however he made a convincing sales pitch that I agreed to with the caveat that we would only take them if it would be no expense to us. When it was time to sign the sales contract, I started to review the numbers and the finance manager stated, 'why are you reviewing the sales contract, my number are always correct'. Stupidly I trusted him and signed the contract. When I got home I reviewed the sales contract and found that he charged us for both the warranty and maintenance programs for $4877. A couple of searches on the internet revealed my worst fears, there is no such Lee County rebate program. At this point I knew that I had been defrauded by this dealership. I researched online that Florida does not provide a cooling off period for auto purchases but does have many state statutes that protect consumers from deceptive sales practices.
The next day my wife and I took off work and went into the dealer ship to confront the finance manager about his deceptive sales practices and charging us for these programs. As we approached his office the look on his face confirmed that he was indeed caught. We sat down and told him that he charged us for these warranties and there is no county program that will pick up the cost of them. I had written down all the legitimate charges that we agreed to pay, purchase price, tax, tile, etc. and told him that he needed to make our financed balance reflect my number, which was minus the two warranties programs. He stated, 'I can't bury the cost in the car because there is not enough room left and the dealer would be taking a loss on the sale'. He sat there for 20 mins trying to figure out how he could make the deal work with the correct numbers and finally said the only way to correct this is to cancel both the warranty and maintenance programs. We signed the cancelation of both programs to which the finance manager stated that it will take anywhere between 4 weeks to 4 months to receive our money back. It has been 4 weeks and I have not seen the reversal of this charges to our finance loan.
I wanted to open this case for two reasons, one to track this issues through an official channel. At this point I have no trust in these shysters to live up to their business obligations. I have talked to others that have canceled the same programs and the majority have said it only takes a few weeks. Second, I want to warn others not to fall victim of this deceptive sales practice that is going on at Sutherland Nissan of Cape Coral. I will be forwarding a copy of my complaint to the Florida State Attorney and ask her office to investigate this dishonest and fraudulent dealership.

After we received the customers request on 02/10/2020, the policy was then cancelled on 2/17/2020 after it was sent to the companies on 2/10/2020. It takes about 3 weeks to get the refund check. Its only been 2 weeks so far since the items were cancelled. Which he should be receiving any day now.

I do not accept this statement from the dealership as the cancelation of the extended warranty policies were submitted the day after the purchase on 1/13/2020. In retrospect, they sat on the paperwork for an entire month before they even submitted it. Again, lies and deception is what this dealership is about. I have included a pic of the cancellation request form for the extended warranty that they stated was received on 2/10/2020. It shows the policy was actually received on 1/13/2020 which is clearly another lie on their part.
We have since received the refund however, their statement did not address the predatory and fraudulent sales practice they stated to us regarding the programs was at no charge to us as part of a county program. No such program exists and at this point I have asked the Florida Attorney General to investigate this dealership for fraud and deceptive sales practices.

We followed all procedures and rules. We presented the customer his options, to which he accepted and then cancelled. He received his refund as stated in his response and only indicated in his resolution that he wanted to know where his refund was. He has since received his refund and based on his desired resolution that is all he wanted
