To Whom It May Concern, I have received the complaint made by the tenant and I am happy to respond to the matterI truly believe this whole matter was caused by lack of clear communication on both sides (myself and the tenant).On February 1st the tenant had sent me an e-mail stating that her
company had announced layoffs and that she would know her status within the company by the end of the monthShe had asked me to break down the costs for exiting her leaseI replied to her within two business hours, stating that we are happy to work with her to sublease the unit if she ends up getting laid offI explained that the subleasing fee is only $I felt that this would be the best situation for both parties, as a tenant can start subleasing a unit immediately, if they need to move-out right awayIt is also a very inexpensive optionI wanted to ensure that if she did get laid off or transferred that the transition would be as quick and smooth as possibleThe tenant replied shortly after stating,“Thank you Samantha! I really appreciate your understanding and working with us! I’ll be in touch once I know my status…is the subleasing fee a one-time fee or a monthly fee? What happens if we cannot find a subleaser?"This further indicated that she would be interested in possibly subleasing the unit, if she was affected by the layoffs that were happening in her companyI also responded within minutes, stating that we have never had a hard time renting these units and that we do not believe she would have any problem finding a sub tenant.On February 16th the tenant sent me an e-mail stating that her position had been eliminated effective March 1stSo, she was giving us her 60-day notification of termination of their lease agreementIn our previous e-mails she seemed very open to the idea of subleasing her unit, and had never dismissed this ideaSo, I sent her further information (on February 16th) about how to sublease her unit:“Please let me know if you would like any assistance in advertising your unit for subleasingI am happy to help with thatOnce you find a potential subtenant please let me know and we will move them through the application process as fast as possibleYou do not need to give a day notice to sublease your unitThey can moas soon as they pass the application process and sign the sublease.”The tenant responded by saying, “Thank you Samantha! Since my company is paying my relocation they may want to "buy out" my leaseHow much is that?”I responded by explaining that we would prefer to have them sublease the unit, but understood that they also have the option to terminate their lease earlyI also explained the cost of the early termination feeBy February 23rd I had not heard anything back from the tenant, so I sent over another e-mail:“Good afternoon, I have not hear back from you after I sent the last email over to you a few days agoPlease note that if you do decide to move forward with terminating your lease early, nothing is final until you have signed the early termination agreement and the early termination deposit goes throughHowever, I really hope you do consider subleasing your unit, as this would be the best option for both partiesAgain, I am willing to help in any way in order to get the unit subleased.”The tenant e-mailed me back later that day explaining that they had sent a letter to our office with their termination fee paymentI was puzzled as to why they had not let me know that they were sending these items over to our office, as we had always communicated via e-mailI office out of my house, so it is really nice to have a warning of letter that are going to the office, so that I can have the office staff look out for themI did not want this process to get delayed and I felt like the tenant had stopped communicating with my after February 16th.At this point the tenant started claiming that I was trying to stall this entire process to get an extra month’s rent out of themI again was extremely puzzled by this, as I have never tried to squeeze an extra month’s rent out of any tenantWe have always been happy to work with tenants who have situations in which they need sublease their unit or terminate their lease earlyWe simply had a lack of communication on both sides as to what the tenant truly wanted to do with the remainder of their leaseI should have communicated more clearly and asked them exactly what they wanted to do with the remainder of their leaseThe tenant also should have been very upfront and told me immediately that they had no interest in subleasing the unitAs, you can see from the e-mails above, the tenant seemed happy to consider subleasing their unit.It was not until February 23rd that I truly understood that they wished to terminate their lease earlyOn February 24th at 7:41am I sent them the Early Termination AgreementThe tenant expressed their frustration that their lease was not terminating until April 30thWhenever we work with tenants on terminating their lease early we always end the lease at the end of the monthWe have never ended a lease in the middle of the monthWe have found that most people are looking to move into a rental property at the beginning of the month and this has never been a problem for usI was very surprised that the tenant was so upset over this, as I have never had a tenant express any frustration over this matter beforeThis was a very new situation for me to encounter and I am still struggling to understand how it has led to a complaint being made.The tenant continued to say that I was stalling the process even though they had already signed the Early Termination AgreementI simply asked for them to mail the original document, so that I could send them a signed copyThe tenant again became very frustrated at this request, because according to her, we had never needed the original documents sent to us beforeI have proof from her real estate agent and personnel at my office that her original lease (before she moved into this unit) arrived to us via mailSo, we had every belief that we were receiving the original documentI truly did not think that this was an unreasonable request and it again was not stalling the process of terminating the lease early by any meansShe had already signed the Early Termination agreement and submitted the early termination fee, which means that she had nothing left to do, but move-out of the unit by April 30thAgain, I am very unclear of how this stalled the process of ending her lease early.Up until this point I felt as though we were working together to try to resolve the frustration the tenant was feelingHowever, the tenant then decided to responded to my e-mails be personally attacking meShe stated the following: “I would never do because you are a nightmare to deal with… why would I sign up for more of your spoiled little brat #daddy owns this business behavior!She also stated this: “you are bat st crazy!”Again, we are always happy to work with tenants and to resolve any conflicts that may ariseHowever, I think anyone can agree that they do not enjoy being personally attacked during a business transactionIt also makes it difficult to move forward to resolve any issueThis tenant was in good standing and we were really enjoying having her as a tenantWe are all working hard at SVK Development to ensure that something like this never happens again in the future, as we want our tenants and employees to have positive experiences.Since this may be posted on the Revdex.com’s website, I have left out any indication of the tenant’s name in this letterHowever, I am happy to provide further evidence to the Revdex.com that these e-mails were actually sent and received.In regards to her “desired settlement,” I have already signed and sent the termination agreement to the tenant quite a few days agoSo, I am confused by this part of the “desired settlement.” Furthermore, there really is no further communication needed between now and the time of move-outHowever, I am happy to have someone else in our office relay any messages to her.Thank you,SVK Development

I am rejecting this response because:  Ms. [redacted] has selectively submitted quotes from emails leaving out the portions that are unfavorable to her where she complains about how I have inconvenienced her life and chastising me for submitting documents via mail to terminate my lease after she would not give me what I needed to terminate the lease.  I stated on February 1st that I needed to know what steps to take to terminate the lease and she did not send me instructions rather she kept steering me to sublet even after I told her again on February 16th that I needed to terminate, she did not send me the instructions so I sent the termination fee and the termination request to the office hoping I would get more cooperation from someone else since Ms. [redacted] was not providing me with what I was asking for.  Ms. [redacted] is horrible to work with and other tenants have had similar bad experiences with her.  LeAnn [redacted] has approved me to let you know you could contact her @ ###-###-#### to corroborate Ms. [redacted]'s terrible erratic behavior. Ms. [redacted] left me voicemail messages that are inappropriate complaining about how I am inconveniencing her by breaking my lease early (my job in Minnesota was eliminated) due to her work schedule as a teacher at Eden Prairie.  She called repeatedly (6 time in a row) harassing me while I was working.   Ms. [redacted] claims that she was confused by my mailing termination documents to the office because we had done all of our communication via email but then later recants and says that I had sent her our lease documents (before we became tenants) via mail.   Ms. [redacted] did finally sign and return the lease termination document to me on February 28th after I told her it was unlawful for her to refuse to sign and return the document to me. After her repeated harassing phone calls and stalling to finish the termination process, and bullying to sublease I did call her "bat st crazy" .  I had just had enough of her lack of responsiveness and lack of professionalism.  I had just lost my job and I snapped.  I do have what I need to move on and move out of my lease.  I do not choose to have further contact with her and I am requesting a walk through before I move out to ensure that SVK or Ms. [redacted] do not attempt to claim damage above normal wear and tear that is not present in the unit.  I understand that they have already leased our unit to a new tenant and that tenant will move in on May 1st so the unit must have shown very well which would indicate we have kept it in excellent condition.  I also have saved all of my emails/voice mails from my interactions with Ms. [redacted].  I can supply them if you believe it is necessary.  I do consider this matter closed,  I have what I need to move out.  I did not have it at the time of my complaint.  Thank you!
