The agreement that Cain made was to come back and do the job correctly per the contract.  We are not willing to move on this and want to pay for the job in full when it is completed per the contract.   Thank you, [redacted] and [redacted]

We are not satisfied with the response and want the job done per the contract.  At the time of the work being done, no one ever asked if we would be okay with a delay (which we would have been).   They made a decision based on their needs not the consumer.  We will pay for the job in full when it is completed correctly.

[redacted] Here are the details and documentation that may help provide some background. We installed the driveway last September. The original contract was for $4,920 and Mr. [redacted] requested an additional area be expanded, which costed an additional $500, which he agreed to. After completing the driveway Mr. [redacted] complained that the driveway was poorly done and that we caused cracks and pits in his concrete floor when bringing our asphalt roller into his garage. I met with Mr. [redacted] in the fall of last year to discuss his problems with the project. After reviewing his issues my professional opinion was that he noticed areas where stone was a little more noticeable but were properly compacted and within industry standards. He also pointed out areas where there were lines or seams. These areas were we matched one pass of asphalt with the next (the pave can't lay more than 12 feet wide) or a seam where we stopped and need to take off again after getting a new load of asphalt dumped in the paving machine. These are all things that have to happen and will be seen on a typical asphalt paving job. I explained the process to Mr. [redacted] and he accepted that there was no additional work to be done on the asphalt portion of the driveway. My professional opinion that the cracks and pits in the concrete driveway were not caused by J.K. Meurer. We must roll into a garage to properly compact the asphalt and we pave near 300 residential driveway per year and this is our standard process. The cracks did not look like anything that was caused from weight rolling in the front of the garage and the in over 30 years of business we have never had a complaint that a smooth roller caused pits in the concrete. Furthermore there were pits that were in the back half of the garage that he said we caused and our equipment would never have been that deep into the building. I would be comfortable with any reputable concrete contractor going to his house to inspect the floor to give an opinion on the cause of these issues. It is clear to me that the cracks and pitting is typical of the age of concrete that he has. Mr. [redacted] did not accept that we were not to blame for these issues. He refused to pay for the work completed. In an effort to simply move forward we accepted no responsibility for the concrete floor, but offered a discount of $420.00 to Mr. [redacted]. Mr. [redacted] accepted that discount in exchange for resolving the complaint and thus paid $5,000 for the completed project. Please keep in mind we offered this discount despite the fact our contract clearly reads that even if we were the cause of a crack, we can not be held responsible for any damage as we must access with heavy equipment and trucks. On top of the good faith negotiation which we did not need to engage in per our contract, the fact that Mr. [redacted] has included the concrete floor as part of the complaint is a violation of the agreement we made.Mr. [redacted] contacted us again this year in the winter and stated he had further concerns with the driveway. We do not work with asphalt in the winter, so I told him we would need to revisit in the warmer months. I met with him on 7/20/16 and he had three complaints. Complaint #1, he was getting some water in the corner of his garage. I explained that his drive lane was higher than his garage and had nothing to do with the asphalt we installed. He would need to install a drain if he wanted to remedy that issue. He accepted that explanation and no further action was requested. Complaint #2 - There were 2 or 3 thin cracks on the driveway that he was concerned about. These separation cracks are typical and can happen with changing weather or ground movement. Our attached contract clearly states that these are not covered by our warranty and are not within our control. However, in good faith, I told Mr. [redacted] that since he hadn't sealed the driveway yet, we could re-heat the asphalt and close those cracks. He was satisfied with that response and we have since completed that work. He also kept my foreman a significant time longer to work on other imperfections (in his opinion) on the driveway that was not agreed upon during our meeting Complaint #3 - Going to submit form before time runs out and will send more information on another form.

Review: It has come to my attention that the electric meters for [redacted] have not been replaced since being destroyed. I have been receiving estimated and extremely high bills from Con Edison based on the previous tenant since moving in October 2012. SW Management has failed to facilitate the appropriate measures for Con Edison to generate an accurate and true billing statement in a timely manner. My lease with SW Management will be coming to an end soon and the likelihood of ever receiving an accurate bill and credit from Con Edison is slim.Desired Settlement: For management to pay Con Ed bills until they facilitate proper repair, I receive an accurate bill and am able to receive a credit.

Review: My boyfriend and I applied for apt [redacted] at [redacted] on Saturday through SW Management (even though they had an applicant ahead of us, they did not put the apartment off of the market and allowed multiple applications at the same time). We got the call on Monday that the application ahead of us didn't go through and therefore we were next in line. After providing every single document proving we, as well as our guarantor, had excellent credit, landlord reference, ample money in checking/savings account, and letters of employment showing gainful income, our broker was told they still needed more information. Examples of specific documents we provided: my checking/savings statement, landlord reference, and ID -- my boyfriend's checking/savings statement, pay stubs, letter of employment, ID (he makes an income, whereas I am a student) -- guarantor's checking/savings statement, ID, and last 2 years of tax returns (because the guarantor is self-employed). Throughout the process, SW Management continued to ask for more documents they never specified from the start, as there is no list of requirements provided on their website. By Wednesday morning, my broker and I were baffled -- we provided SW with everything I had provided my current management four years prior. The 48 hour window closed and despite us giving them "proof" in the form of multiple documents that we were responsible, employed tenants, they rejected our application. Furthermore, SW wouldn't give a reason for us not getting the apartment and is currently in possession of our private documents (they refused to return them to our broker because we weren't with her, even though the documents were originally sent to her and then passed on to them). Our broker, [redacted], who has an excellent track record, was asked to leave their office because she asked why we were rejected. When my father and step-mother (who is a lawyer) attempted to call SW in order to follow up, they both spoke with [redacted] who refused to provide information and has yet to return additional phone calls.Desired Settlement: We paid $300 in application fees and would like this back as we ultimately had no control over the process, nor were we given a specified list of documents to provide them with at the start. My interpretation of the experience was that they collect application fees, "process" potential tenants' applications and then allow the process to reach the 48 hour window before fully explaining what else is needed from the applicant in order to make a profit.
