Actually she is right. It has only been one year since we installed the plants. I responded off the cuff in the last email that I certainly wasn't going to replace these plants after two years, after having replaced the dead plants already. In actuality I was paid on this job July
2015.The situation is this: I do landscaping for the builder. We install the irrigation systems and the plants. Yes, we warrant the plants for one year. The warranty is simply against a dead plant. We do not provide maintenance and we don't do chemical applications. The state of Texas requires a separate license to apply herbicide and pesticides. I get all of my plants from a reputable grower here in Corpus Christi and all of the tropical are lush and healthy and free from disease at the time of plantingWe do not replace plants that are suffering from any pests or acts of nature. These are the responsibility of the owner. I informed her that as an absentee owner she should have a maintenance company that is a licensed chemical applicator service her property on a monthly basis. She never did this.I did replace the gold lantana that were dead. This was approximately 8-gallon plants. Her housekeeper was there the day I replaced them. She let me in the garage to check the controller. Over the course of time they have died again. These were the only plants that were replaceable under warranty. Just because a plant is showing signs of stress from lack of proper maintenance is not grounds for replacement under the warranty.She did call a couple of weeks ago and asked to meet to see the dead plants. I never called her back because the plants had already been replaced, and at some point the homeowner has to take responsibility for their own property. However, I did go by and walk the property after, and was surprised to see the landscaping in quite good condition. The plants had all been cut back properly, and everything was looking really good. Yes, the lantana had been removed. I am prepared to plant gallon gold lantana around the palms trees at no cost in compliance with the warranty. *** ***

I have not been contacted regarding the corrections. We had some issues with this job originally. To my knowledge they were corrected. We do warrant our work. The customer did not contact me to correct any deficiencies that they had subsequent to the initial follow up last year. While I might...

perform the necessary work to correct deficiencies,  I do not refund payment to another contractor, especially without being contacted prior to the work being done. I will not get into the difficulty we had with this customer prior, during, and after the work was completed. This is complaint number three of over 1500 transactions. That is an acceptable percentage to me. I try to please everyone.  However,  that is an impossibility.  Case closed as far as I am concerned.  But not for these folks I assure you. I wonder if they have ever complained about any other company, contractor, babysitter, cake decorator, or hat-maker?
