researched thoroughly and our records show that our management team had a threatening encounter with the tenant's son where he violated the lease requirement for the living stability for the property and our management staffOur management was threatened by the son and we were forced to call the police to calm the situation that had arisenA police report was filed and internal form has been included to describe the event when the police had to get involved We terminated the living arrangement for the tenant because paragraphs 11, and of the lease agreement was breachedI am attaching the lease agreement for review as wellThe collection balance that was appended for $correlates to fees that were included for unpaid rents, reletting fees, trash removal, repainting and repairs to kitchen appliancesAlso including unpaid utilities, various late and eviction fees, including collection fees added to the final balancePer the TAA lease: Paragraph 11: Liability of Reletting fee charge is still the responsibility of the tenant due to leaving the unit per clause "2) move out at our demand because of your defaultThis includes damages and inconvenience, paperwork, advertising, showing apartment, checking prospects, overhead, marking costs and locator-service fees"Paragraph 20: Prohibited conduct: "You and your guests may not engage in the following activities: disturbing or threatening the rights, comfort, health, safety, or convenience of others (including agents and employees) in or near the apartment community ..." Paragraph 32: Default by Resident: "You will be in default if (1) you don't pay rent or other amounts that you owe on time, (2) you or any guest or occupant violates this lease contract, apartment rules, or fire, safety, health, or criminal laws, regardless of whether or where arrest or conviction occurs; Termination of your possession rights or subsequent reletting doesn't release you from liability for future rent or other Lease Contract obligationsAfter property owned or leased by former residents, inspecting when immediate danger to person or property is reasonably suspected ..." *** ** ***Re: Complaint1D# *** *** *** (Apt #***)Dear Ms***,My name is *** *** and I am the property manager at Westwood Apartments and would like to reference the above complaintI have managed this property since May of 2017, so I will respond mainly using documentation in the complainant's file, upon the information we have. - A work order request was entered with our management office, which was completed in October, for a crack near the fireplaceThe crack was sealed, but upon my own inspection, it was not aesthetically attractive. -I spoke with the resident regarding pest issues and the resident confirmed she did not have any pest problems to address. -The resident was found to be responsible and liable for the bedbug infestation inside of the unit, per the resident's file. -We discussed the light fixture, which does need to be sealed better at the rim. -The resident's countertop was also inspected and is in good working condition. -The resident was not aware that the undersides of countertops are Formica.While reviewing the resident's file, it was noted that the resident has numerous guinea pigs encaged, and defecating on the flooringFor this reason in the past, some work orders were postponed, as it is unsafe for our staff to enter units when animals have not been properly restrained.Nov 2017 09:33PM HP FaxWestwood *** page 2Revdex.comMs*** ***"Page Two"While speaking with the resident and inspecting the apartment, I noticed the apartment has a long-term deficiency in housekeepingWe will not be able to replace the resident's flooring at this time, due to this issueHowever, the resident had with Westwood for years so we did extend the opportunity for a fresh start by transferring to a new unit when the current lease expires.I have scheduled all cracks and returning for this Wednesday, November 8, 2017.The contractor will also repaint the residents exterior door.Maintenance will complete the light fixture work and will replace an outlet cover in the bedroom tomorrow morning, November 7, 2017.I do believe this complaint to be fully resolved.Sincerely,*** ***Property ManagerWestwood Apartments
