I am rejecting this response because: Mr. [redacted] response is not truthful.  Their was no monthly payment contract discussed.  What was discussed was: that my mother approved a headstone for my dad and my mother and my husband and myself told [redacted] that some of the family was going to pitch in when ever they can until paid in full for the headstone.  [redacted] advised my husband and I that he would need a $100 dollar deposit to secure the headstone from Houston.  We advised [redacted] that he may get money from other family members paid directly to the account for the headstone my mother agreed on.  I will go through the email that [redacted] replied with and state the discrepancies. [redacted] stated ,"On September 16, 2016, [redacted] came to my office and ordered a double Monument for [redacted] and L[redacted]." The discrepancy in this statement is that the date I came and ordered a headstone was May 26th 2016 which you can find on the order form that [redacted] uploaded. I never went to the office again after the initial consultation. I did not make another payment like [redacted] stated.   The next discrepancy is where [redacted] stated, " After missing three payments, I went to her home to see when she could pay." [redacted] went to my home a couple of times.  The first time was less than two weeks after the down payment was given.  At that visit [redacted] needed me to sign the order form as it was not signed at the office. [redacted] demanded more money and I told him if I had more money to put down on the agreed upon headstone then I would come by and put it on the headstone.   I told [redacted] that I uploaded a Facebook post on my family's forum so they would know where to pitch in money for the agreed upon headstone.  I can upload that Facebook post if needed.   The headstone that my mother and my husband and I picked out was never even set on the grave site.  Their were no financing terms in this order.  [redacted] never told me that a payment was due each month and that he would cancel the order after 90 days without payment.  This was never discussed at the consultation or when he would come to my home demanding money.  [redacted] never notified my mother, my husband, or myself of this cancelation.  [redacted] stated in his response, that he canceled my order six days after he already fulfilled a monument order for my father through [redacted] my half-sister.  My husband called in April 2017 asking for the down payment to be refunded.  [redacted] told my husband, that he canceled the order, because of non-payment.  I called [redacted] around an hour later that day.  [redacted] told me that my half-sister came in and bought a headstone for my father.  [redacted] stated that he gave my half-sister [redacted] my down payment as a credit towards the headstone that [redacted] picked out. So there fore I couldn't get my down payment back because it was credited towards [redacted] head stone picked without my approval.  [redacted] told me that why would he accept my contract when [redacted] came in and paid it in full.  I told him I will take him to court if he does not refund my down payment and [redacted] responded over the phone for me to stop being childish it is only one hundred dollars and have fun wasting around hundred dollars to file a suit in court.  [redacted] was on speaker phone during this conversation and my husband heard the entire conversation.  Mr. [redacted] continued lies about this show his continued unprofessionalism.   I attached the order form that [redacted] gave me at the consultation.  As you can see it was not signed, because he didn't have me sign it that day.  I didn't sign it until he came to my home less than two weeks later after the consultation.

After missing three payments, I went to her home to see when she could pay. She claimed she did not have any money to pay. I advised her that a payment was due every month, and if she went 90 days without payment, I may have to cancel the order. The contract was cancelled on September 25, 2016 for non payment.
