January of 2011 I hired sweet building to remodel my only bathroom. upon completion I called him and complained the tub he installed was creaking when in it he came back cut holes in the basement ceiling under the fiberglass and and added spray foam it was ok for a little while then the noise came back I called again he came and removed the foam and told me it was the floor said he could reinforce it in the basement which he charged me another 175.00 dollars. that worked for a bit then it was back I called him again he told me it was a plastic tub it is going to make a little noise.now the noise is worse the ever I hate to step into it.this hasbeen going on for 3 years.Desired SettlementI would like the matter fixed he stripped the floor down to the sub floor.Business Response In response to Mr. [redacted]'s complaint , This project was a partial bath renovation, meaning fixtures, paint and flooring, electrical, plumbing. Some items were supplied by the customer. I supplied the tub unit which Ive been using for 10 plus years without a problem or complaint. Customer did not want to pay for a full renovation and was also given a $ 503.00 discount from the original contract price. The project was completed end of 02/2011 and the project warranty expired the end of 02/2012.The first contact from the customer regarding his concern about a noise coming from the bottom back side of the tub was 07/2011. I personally went to the job and determined that there a squeak under the tub coming from the existing sub structure. I choose to drill multiple holes in the existing floor sheathing that the tub was sitting on and install spray foam under the tub to bond and disburse the weight of the tub over a larger area of the old floor system. This was done at my expense. This did help at first but the problem came but in much smaller degree. The customer contacted me on 07/16/2011 regarding the issue again. I revisited the site again and after examining the existing floors and floor framing I explained to the customer that all the floors in the entire house squeak. I informed him that we could try some solid blocking in the basement under the bath but informed him that there was no guarantee that it would take away the problem. He agreed to have me do this at his expense. This was completed on 08/10/2011 and the customer OK'd the repair and said he was satisfied. There was no further contact from the customer regarding this problem until 09/04/2012. I again explained to the customer that the floor system is under sized by todays building standards and that the tub we removed was a steel tub that has minimal flexibility. When entering the tub the existing floor system has deflection in it and this will be transferred to the tub and will cause the tub to have deflection in it as well.There was no further contact from the customer regarding this issue after my explanation until I was notified by the Revdex.com 09/04/2013 exactly 1 year from the last date of contact with the customer. As a contractor of 28 years and a proud Revdex.com member I take great pride in my projects and customer relations. I run a respectable and honest business and I can't understand why this customer wouldn't contact me directly regarding this issue. I haven't heard from him for one year. But there also seems to be a pattern developing here where this customer has had a complaint every 12 months regarding this project that has been completed for 31 months. If he had contacted me directly I would have given him the respect of at least a phone call and I would have met him at the job to take a look AGAIN at the issue. Now he is asking to have the floors removed??? I don't know what this would resolve. I can almost guarantee that with enough persistence that this problem could have been resolved with additional structural work on the basement side and would have been more than happy to accommodate the customer at his expense. I have been back to this job site at least 5 times since completion. I do not ignore issues or customers complaints and feel this customer is unreasonable and no matter what we or anyone else does he will still complain. This squeak he is complaining about could not even be found unless you bounce around the back of the tub and cause the floor system to have deflection.This customer needs to fix the floor system issue to make this problem go away.The customer said that we removed the foam and that I said it was a plastic tub in his complaint. This is not true. We did not remove the foam and it is not a plastic tub.
