We wholesaled a Bobcat Sskid steer loader to our customer and sold it as is. The skid steer had just come in and we
discounted it $5,and threw in a new $1,bucket. The customer contacted us after taking delivery and would like us to send him $2,for some repairs, but we told him that we already discounted the unit substantially in selling it to him wholesale, and further that the unit was sold as is.
We also contacted the outside trucking firm that we hired to ship the tractor to this customer in Ohio, and talked to the actual driver that hauled it. The drivers response to us was that he had no trouble loading the skid steer at our lot. Then he went to his next stop to pianother piece and he unloaded our skid loader, loaded the other piece, and then loaded our skid loader again. He said he noticed that the door had to be firmly shut, otherwise the safety switch on the door would not allow the skid steer to move. Other than that he noticed no problems. When he delivered the skid loader to our customer in Ohio, he said he did not have any trouble unloading it off of his truck nor did he see the customer have any trouble driving it up the customer’s long driveway. He did tell our customer to make sure the door was firmly shut and our customer seemed fine with the skid loader before he left *** ***President

To the dealer: I find it necessary to say that it is not the correct way to hold on to a customers money for a week and a half that was due to him after you had his lawnmower . I would not advise anyone to deal with a business that does this type of deal and find it only correct to say that an immediate transaction would have been appropriate .

Yes, I signed the "as is" paperwork after receiving, in writing that the skidsteer "...was used in paper co light use…. Has new bucket looks and run good….”
Trusting them to be honorable since I couldn't see the unit, I accepted the paperwork. Therefore I recognize that I'm stuck. Swiderski Power does not live up to the grand slogans that they publish on their web site.
As far as their reply, I'm well aware that the driver thought the issue of the interlock and drive stoppage was due to the door. However, my local BOBCAT DEALER verified that was NOT the issue. I sent them solid proof from the BOBCAT DEALER that the skidsteer had problems before they took it in, and that they passed it on to me after telling me "it runs good."
I paid the price they asked with no questions because that's the price [redacted] stated. If his boss, [redacted] was unhappy with that price, that's not my fault. I expected a running machine, and that's not what I received. BTW, that bucket is not a $1000 bucket.
In closing, I maintain that Swiderski Power did not deliver what they stated in writing, regardless of their "as is" protection.
It's an expensive lesson for me, but a long lasting black mark on their reputation, and I hope others will learn from this. Don't buy from Swiderski Power.
They pride themselves on coming from old horse traders, and I can now see why they say that. I trusted them since I couldn't see the unit prior to purchase. I bought an old broken down mare that they described as "...light use...and runs good" The word of the horse trader is worth nothing.

We have mailed a check to Lee today in the amount of $1200 and the rest of the refun will come directly from GE.
We also request that Lee no longer comes into our store or property.
