The Attorney ([redacted]y) was hired to handle my chapter 13. After a year due to health issues I decided to convert my chapter 13 into a chapter 7. The total amount that was needed in order to convert was $1400.00, $700 down payment the rest was paid in four installments. I received a letter from chapter 7 stating that my case was missing Debtor Certificate 341, I reach out to my Attorney no response. Then afterwards I received a letter stating my case was closed not discharge. I sent an email to ftwquestions, in which is Swindell & Associate email regarding questions it takes 48hr in most cases for a response. However, I have waited over a week in some cases to get an response. Finally I receive a call from one of the associates at Swindell, stating that my case was closed due to the 341 debtors Class. She then stated to email her to advise, if I attend the class. On 7/26/2013 I responded to Swindell & Associate advising that I did attend the class on 11/16/2011. I was told that The Trustee & my Counsel will be sent a copy. I receive an response stating [redacted]y will be in the office to answer my question on 8/01/2013. I did not receive a response, so I called on 8/6/2013 left a message then sent an email. Finally on 8/8/2013 I receive a response via email stating that We need you to get another copy of the Certificate of Debtor Education from the trustee's office. We will have to reopen your case to get this certificate filed. Our fee for that is a court fee of $265. Once we have the certificate and the fee of $265, we can ask for your case to be reopened for the certificate to be filed. I still puzzled on how this is my fault and why I need to pay additional fees in order to clean up the mistake that this law firm made. It was [redacted]y duty to make certain it was a completed file, when we both met in 2013 in front of the chapter 7 Trustee.
