T-3 Financial Smartchoice Agents Program

In August of this year I refinanced my home with Mr. C and used Title *** as the title company. A bill for my homeowners insurance was issued July 30, 2019 for the amount of $1216. At closing on August 27, 2019 a check was issued to T-3 Financial in the amount of $1216 for the homeowner's insurance. Despite reports that Mr. S did not receive or process any check, he signed and cashed the check which cleared on October 1, 2019. Despite the check having been cashed on that date, I received a warning notice on October 8, 2019 stating that my policy would be cancelled because payment was not received. At that time, my lender issued a check to *** in the amount of $1216 to ensure that the policy wouldn’t cancel, however had Mr. S forwarded the funds that he received to *** my policy would not have been in jeopardy of being cancelled. To date, *** reports that they are only in receipt of the payment sent from my lender and that Mr. S never forwarded the funds that he received to them. *** also reports that Mr. S is required to issue me a refund in the amount of $1216 for the money that he collected for my insurance because he did not use the money to pay my insurance and it has since been paid by another party. As a result of this, my escrow account is short and I am currently being charged well over the amount of my actual mortgage to get it caught back up which is at no fault of my own.
