The pop up drain was moved once already since the original installation It had been installed exactly as described in the bid, but I extended it an additional 3-fttowards the street in an attempt to appease the customer It has positive fall towards the street Pop up heads are designed to sit low as to not interfere with lawn mowers. When I was there extending the pop up drain, I could not find any cracks in the concreteIn regards to the SE sidewalk, it is at the only elevation that it can be at without flowing the water back in the house The old sidewalk was actually dumping the water down to the house The new sidewalk now directs the water away from the house The contracted work did not include changing the grade of the yard between the walk and the streetThe original bid states that we would "Remove asphalt retained by wall and dispose" We ended tearing out an asphalt drive, a concrete drive that required equipment rental, and a cobblestone drive - all of which required multiple haul out trips by a disposal company

I am rejecting this response because:
I reject the reply from TBA Construction from April 11, for the following reasons: 1. At my request, the pdrain was moved once since the original installation. The problem was only moved approximately feet and it still does not “exit toward the street”. This did not solve the problem of the water pooling around the pdrain and causing the ground to sink. According to the contract, the downspout was to be “underground, exiting toward the street.” Moving this feet did not solve the problem, it just moved it feet away2. The crack in the concrete is located in the NE corner3. Most of the new sidewalk directs the water away from the house. However, in the SE corner, the new sidewalk does NOT direct the water away from the house. The water pools in the SE corner during and after any rain storm. 4. I know the contracted work did not include changing the grade of the yard. I am not asking for that work to be completed I am asking that all new concrete should be poured so that it dumps the water away from the house. This is not happening in the SE corner. 5. I selected TBA Construction for this job because of their A+ rating from the Revdex.com and their low bid out of companies. It is not the customer’s fault, if TBA underbid the work. It is the responsibility of the business to provide the customer with an accurate bid that allows the job to be properly completed
Sincerely,

1. At my request, the pdrain was moved once since the original installation. The problem was only moved approximately feet and it still does not “exit toward the street”. This did not solve the problem of the water pooling around the pdrain and causing the ground to sink. According to the contract, the downspout was to be “underground, exiting toward the street.” Moving this feet did not solve the problem, it just moved it feet awayA: The downspout runs underground and exits towards the street as described in the original bid. It drains properly
2. The crack in the concrete is located in the NE cornerA: As explained in original response, no cracks were visible at the time the drain pipe was extended 3-feet, which was done to appease the customer
3. Most of the new sidewalk directs the water away from the house. However, in the SE corner, the new sidewalk does NOT direct the water away from the house. The water pools in the SE corner during and after any rain stormA: The pooling of water has nothing to do with the concrete sidewalk but rather the grade of the ground between the walk and the street. The grade of the ground was not the responsibility of TBA Constnor was it ever addressed by the customer
4. I am asking that all new concrete should be poured so that it dumps the water away from the house. This is not happening in the SE cornerA: It is not physically possible to keep the pool of water off of the walk without changing the grade of the yard between the walk and the street. Changing the grade of the sidewalk would actually cause water to dump towards the house

The original bid states that we would "Remove asphalt retained by wall and dispose".  We ended tearing out an asphalt drive, a concrete drive that required equipment rental, and a cobblestone drive - all of which required multiple haul out trips by a disposal company.
