I FIRST MET WITH [redacted] AROUND THE BEGINNING OF JULY WHEN HE STOPPED BY ONE AFTERNOON AND ASKED ME TO TAKE A LOOK AT HIS CAR WHICH I DID PERSONALLY. HE WAS TELLING ME OF A ISSUE WITH WHEN... YOU PUT GAS IN IT, IT HAS STARTING ISSUES I IMMEDIATLELY KNEW WHAT THE CONCERN WAS I GRABBED ONE OF MY TECHNICIANS WITH OVER 30 YEARS EXPIERANCE AND WE BOTH HAD THE SAME RESPONSE. THE SUZUKI HAS A 3.6 LTR V6 GENERAL MOTORS ENGINE WITH A TIMING CHAIN WHICH WAS STRETCHED OUT AND LOOSE CAUSING THE TIMING TO BE OUT WHICH IS THE CAUSE OF THE HARD START AND ROUGH IDLE. I INFORMED [redacted] RIGHT THEN AND THERE IS WASNT WISE TO DRIVE IT COULD CAUSE FURTHER DAMAGE TO THE ENGINE. HE DIDNT HAVE THE MONEY AT THE TIME SO WE RAN A 3 PART FUEL SYSTEM CLEAN THROUGH IT AND IT BROUGHT POWER BACK TO THE ENGINE BUT WASNT A PERMANENT FIX. BEFORE HE LEFT MY STORE I QUOTED HIM A PRICE OF $1800 TO DO THE TIMING CHAIN SET AND ADVISED HIM THAT IF BROKE WHILE DRIVING OR KEPT DRIVING IT WOULD POSSIBLY CAUSE MORE DAMAGE TO THE ENGINE. HE ADVISED ME HE WOULD BE BACK IN TOUCH WITH ME. MY NEXT CONVERSATION WAS WITH HIM ALMOST 3 WEEKS LATER WHEN HE STOPPED BY AND INFORMED ME HIS WIFE WAS DRIVING IT AND IT QUIT RUNNING WITH THE MESSAGE OF "LOSS OF POWER" COMING UP ON THE DASH. HE ADVISED ME IT WOULD BE TOWED TO MY SHOP THE NEXT MORNING. WE THEN HAD THE CONVERSTATION WITH IT NOT RUNNING IT HAS A 50/50 CHANCE OF HAVING FURTHER DAMAGE TO THE MOTOR ONLY WAY TO TELL FOR SURE IS TO REMOVE THE CYLINDER HEAD AND CHECK WHICH IS ROUGHLY 1000 IN LABOR. OR WE COULD GAMBLE AND JUST GO AHEAD AND DO THE TIMING SET AND HOPE FOR THE BEST. DECISION WAS MADE JUST TO HOPE FOR BEST AND GO FOR THE TIMING SET. PARTS WERE ORDERED WE TORE INTO IT WITHIN MATTER OF 5 DAYS HAD IT TAKEN APART, REPLACED AND PUT BACK TOGETHER THAT WAS A LATE FRIDAY NIGHT AROUND 6PM [redacted] HAD CALLED I ADVISED HIM WITHIN A MATTER OF 30 MINUTES IT WOULD BE READY FOR START UP. WHEN THAT TIME CAME WE HIT THE KEY AND THE WORST HAPPENED STILL A NO START BUT WOULD CRANK. PERFORMED A CYLINDER COMPRESSION TEST NOW THAT WE ACTUALLY HAVE CRANK AND CAME UP WITH 80 PSI ON CYLINDER 2,4, AND 6 WHICH SHOULD HOLD AT 160 PSI. WHICH TELLS US THE VALVES ARE BENT BECAUSE IT CAME SO FAR OUT OF TIME THE VALVE TRAVELED FAR ENOUGH TO HIT THE TOP OF THE PISTONS. THEN I INFORMED [redacted] THAT IT WOULD BE A SIMPLE FIX AND WOULD TAKE THE PRICE UP ABOUT ANOTHER 2000. FOLLWING MONDAY I CALLED TALKED TO MACHINE SHOP THEY SAID THEY COULD FIX THE HEADS IF I COULD FIND THE PARTS WHICH I TRIED ON 3 OCCASIONS AND FAILED ON 3 OCCASIONS. 8-20-2015 I HAD LEFT THE SHOP ON A PERSONAL MATTER AND JUST RETURNED LAST TUESDAY WHEN IMMIEDTLY I GOT [redacted] SUZUKI BACK ON TRACK AND DONE. THERE WERE MANY COMPLICATIONS IN MY ABSENCE AND THAT IS 100% OUR FAULT HOWEVER THE PHONE WORKS BOTH WAYS I INFORMED HIM AND EVEN THOUGH BRANDON WASNT THERE IF I WAS HONESTLY THAT CONCERNED ABOUT MY CAR I WOULD HAVE BEEN THERE AT THE BUISNESS TALKING WITH THE OWNER AND MAKING SURE IT WAS BEING DONE. ALSO I HAVE A BILL WHICH YOU WILL FIND ATTACHED THAT IS FINAL AND ITEMIZED WITH ALL THE CURRENT PRICES AT OUR NORMAL COST THERE IS ANOTHER BILL ATTACHED WITH 2000 LESS THAT WILL BE THE ONE [redacted] WILL OWE FOR WHICH IS MY COST OF 3800. MY ARGUEMENT TO [redacted] IS IF WE WOULD HAVE FIXED IT AT THE BEGINNING OF JULY LIKE BURNETTS SUGGESTED WE WOULD NOT BE HERE TODAY HAVING THIS CONVERSSTAION TRYING TO GET SOMETHING FOR FREE. ANY OHTER SHOP IN TOWN WOULDNT HAVE GONE TO THE LENGTHS WE HAVE TO MAKE THIS HAPPEN. AS A BUISNESS WE STILL HAVE TO GET OTHER CARS IN AND OUT BUT ALSO NOT PUT OFF OTHER CUSTOMERS BUT EVERY ONCE IN A WHILE YOULL GET A PERFECT STORM WHICH IS WHAT WE HAVE HERE AND THE CUSTOMER IS JUST AS RESPONSIBLE AT THE BUISNESS.

From a credibility standpoint we would like to point out that we are the current "Business of the Year" through the Greater Kokomo Chamber of Commerce. Also, we were recently voted as the "Best Auto Service" business
and "Best New Business - North Location" by the readership of the Kokomo Tribune. These two wonderful awards show the amount of respect our fellow business community and the general consumers have for our business! That being said we are very active in our community and strive to make our customers happy at all levels. While we have made mistakes which were easily remediated by open communication this is not one of those cases. By receiving this open case from your organization it shows proof that Mrs.*** *** is following through on one of her many threats to our business. While we are unable to get into specifics due to "pending" litigation we can say there are plenty of screen shots of the "pleasantries" Mrs*** sent us that will have been forwarded to our Attorney *** *** (765) 461-4003. Instead of handling this through open lines of communication or possibly through mediation Mrs*** has taken it upon herself to wage a social media blitz in our community. With no previous complaints to your organization regarding our business and with the aforementioned awards and community stewardship you can imagine the impact her actions could have on the reputation of our business. Having said that we have asked our Attorney *** *** to send a copy of the definition of Libel and Defamation to Mrs*** since she is bound and determined to injure our reputation and therefore our business stature in the Kokomo community. Libel - Indiana code 34-15-defines it as "harmful remarks, made in writing, that might injure a person's reputation" or in this case our business. Defamation - "is a statement or communication about another person that causes emotional or financial harm" in this case both have happened. In regard to Mrs***'s claims: her Volkswagen was brought to our shop with wires hanging from the Osensors which was kicking engine codes. According to Mrs*** "her daughter had hit something pulling the wires out of these sensors". We notified Mrs*** of this upon noticing it and she did not want to fix them as "she was selling the car anyway". Happy to report that we did fix the sensors (on our dime) as we could not let it be sold to her "buyer" in that condition. Also, I think there would be no objection that we did change the fuel filter with no issues. We also installed a battery that Mrs*** purchased and no labor was charged for doing so. Now we come to the point that Mrs*** has issue with! When bringing the vehicle to us it was stated that the oil light was on prior to coming to our shop. It was also noticed upon pulling the car into our bay that the car was approximately 1/quart low on oil. We originally changed the oil with our standard weight oil and the light persisted. We then decided to drain the oil and add a synthetic blend oil for the added viscosity which seemed to work. The light was cleared and the customer was notified. Here is where it gets a bit unclear to us - the ***'s picked up the car that evening and turned it over to their "buyer". The buyer took possession and the next thing we know the turbo was blown. If this is the case the issue we would think would be between the new buyer and the ***'s. The only thing we are guilty of is fixing "other issues" (i.eOsensors, wiring, etc.) that the ***'s did not want fixed. Upon letting the "new buyer" take possession and the subsequent blowing of the turbo the same car was then brought back to our shop. We ran diagnostic tests and found there was no compression. Further testing led to the discovery that the turbo had been blown on the vehicle in question. At this point we notified the ***'s that the turbo had been blown and this is when the accusations of "putting in the wrong oil" began. The ***'s asked us "what are you going to do"? We indicated that we could change the motor for them and found a used one for $and our labor of roughly $(plus incidentals, shop supplies, etc.) would have brought the total to approximately $1700 . Phil Hale (senior service technician), upon giving them this total, was informed that they thought it was our fault and we should "take care of it". Phil informed Mr*** that we were not at fault but that he would speak to me about the issue at hand. When Phil spoke with me I asked if we had made a mistake and were we at fault? He said with his years of experience that there was no doubt in his mind that we were not at fault and at that the ***'s (or possibly their new buyer that took possession) had blown the turbo. Based off of the several conversations with Mrand Mrs*** and the feeling that they were going to institute a "social campaign" I instructed Phil to offer to them that we would put in the motor if they would buy the used motor. It is important to note that this was not admitting guilt in any way but an attempt to help a customer that was obviously frustrated. It was an attempt to alleviate a situation which is likely to cost both sides many thousands of dollars in litigation (i.eoriginal suit, counter-suit, libel/defamation suit, etc.). We had hoped that they could have seen their car of 170,000+ miles was on the brink and that a simple oil change was not the cause. We would have hoped that in their "rush" to unload this car to their "new buyer" all of their car's issues would have been addressed. We would have hoped that they would have addressed the blown turbo with the "new buyer" that had taken possession and driven the car on the evening in question instead of making accusations against our character. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.[Provide details of why you are not satisfied with this resolution.]Feb. 23 930 am dropped car of at Burnett’sTold them I want battery replaced fuel filterreplaced which I provide brand new, oil change, diagnostics for engine light on.We were doing this maintenance because we were selling and didn’t want to leavenew owner with a dead battery or any other major issues.  I informed them that on Friday my daughter was driving home from school and oillight came on …I was out of town so I told her to park the car and drive mine Ialso informed them that I checked oil and added a half quart of oil as itshowed a little low the oil light went away. Feb 25th 3pm I called and asked whatwas taking so long for my vehicle to be finished and Ansley asked me did we doa battery check on this Mrs.,. [redacted]… I said to her what are you talking about?She said we couldn’t get it to start the battery was dead… I said I know thisyou are replacing it for this reason. She then proceeded to tell me she wassorry and that she would get the car in. I called owner to complain that myvehicle has not been taken in the shop and it had been there since 9am Mondaymorning and that Ansley informed me she lost my work order. He told me the carwould be in ASAP…. I then get a call from Phil later this evening saying thebattery was going to cost $166 and didn’t know if I wanted to spend that muchon a battery since I was selling the car the next day also tells us the enginelight was O2 censors and said he disconnected wires. We informed Phil that wewouldn’t be replacing the O2 censors because the new owner was aware of thisissue.  Phil also informed me of a verysmall oil leak and said he fixed it.  SoI called around and found the battery for a cheaper price Phil said if theywouldn’t put the battery in for us he would since they had taken so long forsuch simple maintenance. We picked the car up and drove to O’Reilly for newbattery…they wouldn’t put it in so we drove back to Phil and he replaced. Wedrove car to my daughter at work and then after work she drove home. Feb 26Next morning at 930 am I picked my dad up to take car to possible new owner andtook him for a ride around the block he loved the car and wanted it. Droppedgentleman off and boom oil light came on when I went to 2000 rpms and carmaking funny sounds. I call Burnett’s and tell them I am taking car to northshop because I am close to there. North shop tells me to take to Phil so my daddoes. My dad sits in their shop for 3 hours while they revved the engine tryingto get oil light off. I came to pick up my dad and they were still revving the engine.Phil said he changed the oil again and the oil light was still on when car wentover 2000 rpms…. He said he was going to change oil again…my husband researchedand found that this type engine is very sensitive and requires 5 w 20 syntheticoil and that these issues have happened when wrong oil was used in this TURBOengine.  So I called and the shop to askthem if they used correct oil in my car Phil says yes…. Later I get a call fromPhil saying he did research and my husband was correct… that he did in fact putin the wrong oil 3 times and were flushing and replacing again only to findthey still used wrong oil 5W 30 synthetic when they should have used 5w20synthetic.  This whole time the oil lightwas still on and they revved the engine over and over. So I called Volts Wagondealer and asked them about the oil light and they told me it sounded light anoil pressure issue so I informed Phil of this He also told us that he stuck themanual gage on the oil pump and said we had oil pressure while revving theengine. So I called back to VW dealer and they said he should of drove it tomake sure not just rev the engine…. I inform Phil of this he says he did themanual gage and oil pressure was fine.  Myhusband and I picked up the vehicle because they said light was off. As Phildrives car out of bay he says the light came back on Phil reeves engine he saysthe oil light should go off as the 5W 40 oil is burned off…. He says he hasbeen revving the engine for 15 mins. And the light never came on until hepulled out of bay….so I ask him is this car safe to drive and he replies yesmam gives me  his cell phone number for meto give to new owner and to have him to call him and bring vehicle back nextday that they would take care of him.  Itake car to new owner and give him the mechanics number to call him in the amto take car back in. Friday Feb 27th the next morning he takes car forgas and it dies. I call Burnett’s and tell them car died Ansley says are youkidding me and I reply no I dead serious! They come tow the car from theMarathon on Markland which is 1 block from owners home. Later that day after myhusband get off work goes to the shop and they say to him they think it’s the O2sensors that could be causing all of these issues.  so my husband goes and buys them for $180. Getthem on not it.  I asked Phil many timeswhile speaking if he blew the engine in my car and his response was no.  Monday March 2nd Phil calls myhusband He proceeds to tell my husband it’s the timing and that the turbolooked fine but thinks the tensioner is bad then calls us and tells us the part(tensioner rear chain for cam shaft) is $600 so we look around and locate for $250….Philtells us not to buy the part quiet yet he wanted to try something else… TuesdayMarch 3rd husband goes back up to the shop and Phil proceeds to tellmy husband that he got the car back in timing and that it wasn’t the tensioner …somy husband ask him what the next step is and he replied I pulled of the turboand it looks fine …I will pull fuel injectors and do a Boris scope.  So later that day Phil called and told myhusband we need to talk and husband goes to shop and Phil tells him turbo isblown and it blew the engine. My husband says to Phil what you are going to doabout this… Phil replies to him you buy the new motor and I will put it in foryou for free. My husband tells Phil that’s not going to happen … so Phil says Iwill talk to Joey and we will go from there. My husband leaves. Never once didanyone give us prices for a new motor and labor or anything else nor did Joeytry to call and speak to us and make this right. Wednesday March 4rdhusband gets call from Phil saying that he spoke to Joey and they would not bereplacing the motor so my husband said we will be there to have car towed toplease have it ready. AFTER my husband had car towed on I did make a post on myFacebook page about what this business had just done to our car. Mr. K[redacted]writes that he told Phil to put motor in for free after I made post which is acomplete lie. I have proof that my post was made after car was towed fromBurnetts and Mr. K[redacted] never spoke to me after in regards to free anythingfurthermore the new owner of this car never drove it anywhere but to get gas …as he was at work the night we dropped it off at his house. I did give them abad review on their business page, and made a complaint on Angie’s list and acomplaint to you the Revdex.com. Never once have I threatened anyone or this businessin and violent manner. I did however tell him I would see him in court.  The owner has never tried to make this rightor to contact me or my husband I had to call him. Mr K[redacted] spoke to me on ThursdayFeb 26 after I left a message for him to call me. He proceeded to tell me I wastinghis time and he would take care of the problems with my car because he was losingmoney with my car in his bay. I then said to Mr. K[redacted] that my car hadnever had any of these issue till we brought it to his shop and I wanted my carfixed and he replied I know this Mrs. [redacted]. He then proceeded to speak to me ina very disrespectful manner so I chose to end of conversation. They would haveyou believe they didn’t give me a bill and volunteer to put the new motor inbecause of kindnesses but that is not true at all its out of guilt Phil causedthese issues and that’s why he is covering himself and blatantly lying. I dohave 3 mechanics willing to give written statements confirming that by Philrevving our engine while the oil light was on and using the wrong oil in ourcar at least 3 times is what blew this motor. As I wrote in the beginning wehad a diagnostics test ran and nothing came up about our turbo only O2 sensorsso by using the 170,000 and on the brink excuse would nothing more than anescape goat. To think that a 13 year old car that has been well taken care ofwith 1 previous owner besides us is old is ridiculous! Mr. K[redacted] hasaccused us of being in a “rush” to unload this car on the new owner… but he didnot stop to think that we put $300 into a car we were selling? Does that makesense if we were in a rush and unloading a car on someone?? NO is does not! Wewere making sure this car was up kept and running with a new battery so hedidn’t have to worry. We are good people and giving a broken car to someone whopaid me is completely wrong and not who we are. The car is sold we have beentelling the new owner we will buy back the car and he says no, that we willwait because he knows that we after all this we would not sell him a bad car sohe continues to wait. We have kept his money and refrained from purchasing ourchild another vehicle until this matter is resolved. If we were trying tounload a DEAD car on someone then I would have never replaced the battery!
