Complaint: [redacted] I am rejecting this response because: it's contradictory and confusingMr [redacted] states there is no proof for this complaint to qualify as a complaint needing resolution, yet he then proposes mediation to resolve the issueHe quite definitively states there is no merit and therefore nothing to resolveWhy then propose mediation with that attitude? Also after reading guidelines from this Revdex.com website it is not my understanding that Mr [redacted] propose the mediation and time, but more so that a Revdex.com staff member overseeing this complaint propose a next step.In a separate email yesterday Mr [redacted] in an effort to "resolve" the issue proposed, for what he calls at cost, $a pier, their company will install concrete footings with rebar under the block and baseI would first have to pay the $I've refused to pay, so for an additional $3000, for a total of $I could get these thirty new block and base piers to sit on firm substrate. One problem is that's a lot of money, too much money, way too much money to call that offer a resolution, second I've now got the skirting and tons of earth graded away from the skirt in the way, the third problem is how could I ever have the crew I've had so much trouble with back on my propertyThe one insight I'm having about this offer is how it reveals the way the project should have proceeded from the start, it's an admission of a good way to hold up the loose block, installing footingsMr [redacted] in our one actual meeting told me it's $a day for the crew, in four days they had the loose block and base piers installed on the ground, the math speaks for itselfThe price was $8790, and I have leaning piers, cut joists, bowed floors( nothing in the contract about that), dry concrete hardened into a big mess, and existing piers that I was promised by the project manager would have metal shims to ward away termites

This complaint has no merit A contract and warranty were agreed to by both parties prior to the work commencing GA [redacted] And Sons performed the work as agreed Following the clients first refusal to pay, we met with him, performed warranty work at his direction, provided and paid for an Engineer's inspection and collected the balance due Weeks later, without conversation the initial check paid per the contract had a stop payment placed on it There is no accusation or evidence that GA [redacted] And Sons was or is in breach of the contract The client is clearly in breach of the very same contract which he is attempting to enforce We are willing to attend mediation followed by binding arbitration with the Revdex.com as stated in our contract once the client pays the $3,due when the Engineer inspected the work along with the $in NSF/collection fees incurred by his breach The client should have done his due diligence prior to agreeing to the contract and is not entitled to renegotiate the amount due after the services were provided and inspected by a registered Engineer It is as though he purchased a Chevy, drove it home, stopped payment on the check and is now demanding a discount because the car he bought was not a caddy You get what you pay for in this world He recieved a good product from a reputable company with a superior warranty and should be required to pay for what he agreed to purchase and we in fact delivered ***

I am rejecting this response because: it's contradictory and confusing. Mr [redacted] states there is no proof for this complaint to qualify as a complaint needing resolution, yet he then proposes mediation to resolve the issue. He quite definitively states there is no merit and therefore nothing to resolve. Why then propose mediation with that attitude? Also after reading guidelines from this Revdex.com website it is not my understanding that Mr [redacted] propose the mediation and time, but more so that a Revdex.com staff member overseeing this complaint propose a next step.In a separate email yesterday Mr [redacted] in an effort to "resolve" the issue proposed, for what he calls at cost, $100 a pier, their company will install concrete footings with rebar under the block and base. I would first have to pay the $3000 I've refused to pay, so for an additional $3000, for a total of $6000 I could get these thirty new block and base piers to sit on firm substrate. One problem is that's a lot of money, too much money, way too much money to call that offer a resolution,  second I've now got the skirting and tons of earth graded away from the skirt in the way, the third problem is how could I ever have the crew I've had so much trouble with back on my property. The one insight I'm having about this offer is how it reveals the way the project should have proceeded from the start, it's an admission of a good way to hold up the loose block, installing footings. Mr [redacted] in our one actual meeting told me it's $350 a day for the crew, in four days they had the loose block and base piers installed on the ground, the math speaks for itself. The price was $8790, and I have leaning piers, cut joists, bowed floors( nothing in the contract about that), dry concrete hardened into a big mess, and existing piers that I was promised by the project manager would have metal shims to ward away termites.

This complaint still has no merit.  If fails to define any breech of contract on our part.  The client acknowledged he had read both the contract and warranty prior to agreeing to the contract and having the work performed.  One needs to submit some proof that a breech has occured and that they are in full compliance of the contract they wish to enforce in order for this to qualify as a complaint needing resolution.  This is merely an attempt to damage our reputation and diguise the fact that the client wishes to keep the money we have earned.  Please schedule a mediation for this Wednesday or Thursday at 11 AM either day and let's get this resolved.

paid for an Engineer's inspection and collected the balance due.  Weeks later, without conversation the initial check paid per the contract had a stop payment placed on it.  There is no accusation or evidence that GA [redacted] And Sons was or is in breach of the contract.  The client is clearly in breach of the very same contract which he is attempting to enforce.  We are willing to attend mediation followed by binding arbitration with the Revdex.com as stated in our contract once the client pays the $3,000.00 due when the Engineer inspected the work along with the $77.00 in NSF/collection fees incurred by his breach.  The client should have done his due diligence prior to agreeing to the contract and is not entitled to renegotiate the amount due after the services were provided and inspected by a registered Engineer.  It is as though he purchased a Chevy, drove it home, stopped payment on the check and is now demanding a discount because the car he bought was not a caddy.  You get what you pay for in this world.  He recieved a good product from a reputable company with a superior warranty and should be required to pay for what he agreed to purchase and we in fact delivered.   [redacted]
