To whom it may concern, Enclosed is a copy of Mr [redacted] 's invoiceHe has the original carbon copy as wellThis shows that he clearly knew that the engine he was purchasing and chose to purchase on his own accord was a factory secondThe year of the engine was disclosed before the saleThe yin number of the engine is on his copy and oursYou can see the devious intent of Mr [redacted] by the fact he says we represented his engine as a newer than the boatYou can see that this would not make senseHe has been claiming all kinds of different things since he bought the boat, asking for a full refundI have these emails saved if you need to see themThe first example: He said his tail lights were not the right onesThese have been the same tail lights used on Grand Island since They are the same tail lights used on Roll In, Smart Hauler and many other Trailers as wellHis tail lights failed when the bulbs blew, due to Mr [redacted] 's failure to observe pre delivery instructions as to un plug them before backing in the waterNext example: On 05-03-he stated that his pontoon must have a design flaw as it does not have full risersTahoe/Avalon has made thousands of pontoons like this as well as most other manufacturesYou can do your own research here to determine how many hundreds of thousands of pontoons have been made this way from all different manufacture'sThere is obliviously no issueThere was an issue with a water leak on the side of the floor in which the manufactures warranty states that any warranty work has to be completed at a manufacture approved dealershipMr [redacted] brought the boat back to usWe dropped everything and fixed it while he waitedWe water tested the boat with Mr [redacted] to make sure of his approvalHe left satisfiedAll work was done for him at no costWell over a year later, we received a call from him saying that when he brought his engine in for winterization at another dealership, they told him that there was water in the oilWe looked up the warranty and I informed him that it was expired but if he got it to us, we would see if we could get Mercury to cover all, or part of the repairOtherwise, we would give him a discount on parts and laborHe then went on to say that the engine was not the right year and he wanted his money back or a new engineI stated that we would do everything we could to try and resolve this if he got the boat to us, but he refused to let us see it"How can we try to resolve this or repair the engine if we cannot see it" we kept asking Mr [redacted] He just kept saying how me miss represented the year and he did not want this engineWe told him the year of this engine when he purchased itThe engine was a factory second from MercuryIf you ask him for a copy of his receipt, it will show the right yin number and that the engine was a factory secondDuring the last correspondence we had with Mr [redacted] , he threatened legal actionIt is our company policy to cease all communication with any associates once this has taken placeHe is accurate in his statement that we hung up on him once this threat was madeHe will now have to go through the proper channels of Mercury service to get his engine repaired if there is anything wrong with it, as it is out of warrantyThanks for your timeSincerely, Kenny ***

I am rejecting this response because: This response doesn't surprise me. Mr. [redacted] has been fabricating stories and telling lies through out this whole ordeal. As you can see by the invoice it does NOT say the year of the motor. It only has a "2014" cleverly inserted between the lines so that it "looks like" everything was a 2014 purchase. Kenny [redacted] told my wife and I "verbally" (as I stated in my previous complaint) that the motor was a 2015.  That's why he did NOT specify the motor's year on the invoice...so he could slip it by us...which is exactly what happened. He also failed to tell you that this motor has 2 registrations for it, one in 2007 and one in 2015. I had another Mercury dealership look it up for me and in their 24 years of business, they said they'd never seen anything like it before. Also we were never offered by T & M a discount on parts and labor!  That is a total lie and completely made up!!!  Again, Mr. [redacted] told us the motor WAS a factory second and that a factory second WAS different than a factory rebuilt....and the truth is they are the same thing. We were told by him that the factory second was NOT a rebuilt engine it was only supposed to be "slightly used" by the factory as a demonstrator or some kind of sales displays. A factory "rebuilt" on the other hand is a defective engine that has been sent back to the factory to be "rebuilt" and resold. I told him we did NOT want a "rebuilt" engine and he said that a factory second was NOT a rebuilt engine. But in reality that's what they are.  As for the tail light issue I can't find any correspondence with him by email over that issue but I know we spoke over the phone about it and telling me that it's my fault because I didn't unplug them before backing in the water is totally ridiculous!!! They refused to replace them and we had to replace them at our own expense. I would have to say Mr. [redacted] is a very dishonest and disrespectful person and has been lying for so long that he is able to convince even himself of his false stories. What is my next step or options in this process. Thanks[redacted]
