Ms [redacted] I am responding to a complaint files against TN Miller Remodeling by [redacted] and [redacted] The ***’s claim we did not execute our design agreement accordantly is a misleading statement We gave the ***’s a rough estimate to complete the project and asked them to sign a design agreement to pay for our time to design and research products to fit their budget and scope of work During the design phase we gave them several options to meet their budget by either reducing the scope of work or having them put some “sweat equity” in the project completing some phases themselves They were unwilling to do so and went with another companyOur design agreement clearly states that if we do not execute the project then we keep the cost of the design agreement Our proposal included the cost for a building permitI have researched the permit website several times and have not found a permit for the projectI have gone by the site and have noticed the job was completed without a building permit required by law Jayson M [redacted] [email protected] www.TNMillerRemodeling.com

I am rejecting this response because:The dispute is simpleBefore both parties signed the design agreement we were very clear in stating our firm budget, and TN Miller was very clear they could meet that budgetIn the end, they would notThis dramatically diminished the value of the exerciseThe following points illustrate this:- 8/23/- Email from Miller includes the estimate of $25,pre-tax. - 8/27/- Email to Miller states the estimate is at our maximum budget. - 8/27/- Email to Miller asks about items mistakenly left off estimate and states we want to proceed if those items won't add any cost. - 8/23/- Email from Miller acknowledges our budget constraint and states materials can be changed to stay on budget. - 8/28/- Email from Miller "That is what the design agreement is all aboutDesigning to meet your budget."- 9/28/- Design agreement signed- 2/17/- After back and forth final budget is $30,pre-tax (including a $"permit").- After we informed TN Miller we would not proceed and requested a 50% refund we were met with a long silenceWe then shared some of our detailed concerns, which are outlined in the next bullet.- We were troubled when taking a close look at the numbers on the final quote vs the initial estimate: - floor install +150% - painting +250% - interior trim +300% , - Yet we took out a $1,shower door, an interior door, a small window and added one or two small windows (we never got close enough on price to finalize that final point).As for the permit issue, it's not really relevant to the dispute, however: - 12/12/- Email to Miller, we ask about need for permit - 12/13/- Email from Miller "This project won't require a permit." Note: Miller later told us we could do a "counter permit," but we later learned that there isn't such a thing. It's also important to note that we later discovered significant mistakes with the measurements and approach on the design provided by TN Miller and had to get them corrected. Finally, we feel our initial compromise solution of a 50% refund to wrap this up amicably is very reasonable and still makes sense
