Business failed to order and install bedroom windows on time. He then failed to respond to our inquiries and was belligerent when we spoke to him.We hired [redacted] in early September to install two pairs of windows in our master bedroom. [redacted] assured us that the work would be performed promptly. Based on this assurance we removed all furniture, clothing, and other items from our bedroom.[redacted] failed to order the windows on time. He waited until had completed all other work in our house to order the windows, shortly before November 1. He had already cut holes in the walls of our master bedroom for the new windows.The windows were not available in stock and [redacted] told us they would arrive the week of November 22, well over two months after we hired him. This has caused us to live without a bedroom for well over a month.We did not hear anything from him for several weeks. We began to contact him during the week of November 17 by telephone and email to confirm that the project would be completed the following week, as he had previously assured us.He avoided our calls and sent only a vague email stating that he had not heard anything from the window manufacturer. When we pressed him to actually confirm the delivery date with the manufacturer, he told us by email that, due to delay, the windows would not arrive until November 25.Despite our multiple requests, he refused to provide us with a date on which he would return to our home to finish the project.When we continued to press him to speak to us by phone, he claimed by email that he was working from 5am-9pm on a job where he had no cell phone service. He did, however, send two text messages to us on November 19 at around 1:00pm. This confirms that he could have spoken to us by phone at that time.The only time he offered to speak to us was at 10:00pm on November 19, well outside of normal business hours. When we asked him when he would return to our house, he immediately became belligerent, refused to provide any date by which our project would be completed, refused to listen to our concerns about the delay, and refused to acknowledge that we had had to chase him down and press him to inquire into the status of the window order, and that we had to email, call, and text him multiple times to try to get a straight answer from him.He was antagonistic on the phone to an extent that neither of us has ever experienced in a relationship with a service provider. He repeatedly interrupted us, spoke over us, and did not seem to understand what we were saying. We informed him that, based on his conduct, we did not want him to finish our project. He threatened to report us to the Revdex.com.Aside from no longer having any confidence in his ability to finish the project, we would not feel comfortable, based on his behavior, having him in our home again.[redacted]'s failure to perform the contracted services on time has caused us to experience significant inconvenience, since we have had no bedroom for over a month. Now that winter is setting in, the holes he has ripped in our walls are causing us to lose heat from the house. Along the way varies projects where being changed throughout the contract that we accommodated that where not on contract, on October 27, 14 [redacted] emailed me stating he would like the windows ordered that him and [redacted] agreed and understood that it takes 2-6 weeks for delivery. We ordered the windows next day October 28,14 and notified client in person that the windows will be delivered estimated week of November 22,14 and that we would contact them a.s.a.p. when windows arrived. week three I get an email from [redacted] stating he would like to know if we are on schedule for the week of November 22, 14. We responded by email stating we didn't hear anything from the manufacturer of any delays and we should be on target for the estimated week of November 22,14. Mellissa calls on November 18,14 leaves two voice mails stating she needs to talk direct to me that we dropped the ball on the delivery time that she don't feel comfortable when her windows are coming in & demanding a date and time the windows will be delivered, we responded by text stating that we where in an area we could not receive phone calls and we would call her later that evening, she replied Yes! " I want to speak with u directly. please call me at 10 pm tonight." we called her that night she started yelling and screaming that we are fired and breached our contract for not having windows on time for delivery an was uncivil, rude and hung up phone while trying to explain her questions. [redacted] called me back and this is when we told her we need to resolve this business action through a third party that being the Revdex.com. our closing: Client jumped to conclusions before estimated time of window delivery for November 22,14. He assured us that the windows we required would be in stock at his dealer when they were needed. He proceeded to rip out the walls around our windows. We later found out that he had never actually inquired into the availability of the windows or ordered them, despite having ripped out the walls around our windows. Instead, he did not go to the dealer to order the windows until he was driving to our house in late October on the day he planned to install the windows. At that time (if his story is true), the dealer informed him that the windows were not in stock and would take up to 6 weeks to arrive.At that point we were left with holes torn in our walls but without any replacement windows. We have since learned that it is standard practice in the industry to obtain the actual windows in hand before beginning any physical work on a window project, in order to avoid precisely the problem that [redacted] caused. Clearly [redacted] is not familiar with the process of ordering or installing windows and should not have held himself out as qualified to handle this job.We have also learned that it is well known in the industry that the Anderson windows we requested have up to a 6 week lead time. [redacted] should have known this and ordered the windows well in advance. He had been working at our house for over two months and had plenty of time to order the windows without creating the crisis that he created.In any case, once [redacted] informed us that we would have to wait up to six weeks to receive the windows, we moved forward, because [redacted]'s conduct had given us no choice. He had begun the work at our house but not completed it, and winter was rapidly approaching, leaving us concerned that we would not be able to find any replacement contractor to complete the work before the onset of winter. So we moved forward, feeling that we had no other option.It is also now our understanding that it is unlawful for a contractor in Massachusetts to provide a contract without a specific start date and end date. The contract that [redacted] provided to us had no start date or end date.[redacted] informed us that the windows would arrive on November 22. As that date approached, we began to contact him to confirm that the windows were on schedule and that he would arrive promptly at our house to install the windows after they arrived. He evaded our emails and telephone calls for several days. We have email documentation of our several attempts to reach [redacted].After hunting [redacted] down, the only time he offered to speak to us was at 10pm at night. Although this was clearly unprofessional and unreasonable, we immediately agreed to speak to him at that time since he had proven impossible to reach by phone otherwise. Although he later claimed that he had not responded to us because he lacked cell phone service during the day at his current job in Harvard, MA, this is clearly false because he texted us during the day, which confirms that he had cell phone service and could have called us during normal business hours as requested.When we spoke to him on the phone and asked him to confirm the delivery date of the windows, he became evasive and would not commit to a particular date. When we asked him when we would be at our house to finally install the windows, he became belligerent and would not stop talking for several minutes at a time. After many failed attempts to get a straightforward answer to the simple question, "When will you be at our house to install the windows?," we told him that he was fired.After that, we have hired another licensed contractor to fix and complete the work that [redacted] started but failed to complete. Our replacement contractor presented us with a clear and detailed contract with start and end dates. That contractor ordered the windows on the same day that we signed the contract not months later. That contractor also identified equivalent windows that would be available within 10 business daysnot 6 weeks. He is scheduled, by contract, to begin work exactly 10 business days after the date on which the contract was signed. His contract specifies that all of the work will be completed within 3 days. Contrast this with the several months of time that we spent with [redacted] without the work being completed.We repeat our request that [redacted] pay us $2,597.04 to compensate us for the additional amount we will now need to pay the replacement contractor to fix the work that [redacted] began but failed to complete. This does not even begin to take into account the time that we have spent locating, hiring, and working with the replacement contractor, the energy costs we have incurred due to the holes that [redacted] ripped into our bedroom walls during cold-weather months, or the loss of use of our master bedroom for several months.Final Business Response Hello [redacted],T&R General Construction LLc has exercised every reasonable effort to satisfy the client completely giving all specifics of estimated date of custom windows & installation, everything was agreed upon the day of October 28,2014 between [redacted] &T&R General Construction LLc. T&R General Construction LLC can only install clients custom windows when custom windows are delivered estimated week of November 22, 2014, therefore regardless the accusations from the client we do not understand why the client would call T&R General Construction LLc asking for their custom windows & make a complaint to the Revdex.com before estimated delivery date of November 22, 2014, when Client was well aware with email from [redacted] stating [redacted] & him understood delivery took 2 to 6 weeks & also verifying estimated week of November 22, 2014. Therefore this does not give T&R General Construction LLc a fair chance to exercise a reasonable effort to satisfy the client completely with complaints & accusations before estimated date of November 22, 2014 On November 18, 2014 clients (wife) [redacted] fired T&R General Construction LLc before estimated date of November 22, 2014 therefore breaching agreed contract between Client & T&R General Construction LLc, plus hiring another general contractor before complaint was mediated has nothing to do with T&R General Construction LLc, nothing for nothing! That like us selling the windows & asking them for restitution for them. therefore contract should be honored & paid in full final payment, cost of custom windows, storage fee per day & 1.5% interest per month the final payment is not made after November 22, 2014. T&R General construction LLc exercised every reasonable effort to speed up progress by laying out & cutting only the wall board around existing windows with leaving existing windows in tact we insulated the open walls around existing windows with R-13 faced insulation stapled to wall studs filling all wall voids & plastic sheeting vapor barrier. We have pictures of the condition we left the bedroom. As far as inconvenience goes! In any shape of form! We left that bedroom habitable, that they could have moved back in there bedroom on October 28,2014. T&R General Construction LLc has plenty of client reviews with window installation. We have pictures & emails that verify client understood agreementof November 22, 2014. Thank You, [redacted]Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)We take [redacted]'s failure to respond to our assertion that his proposed contract was unlawful to be an admission by him that his proposed contract was unlawful and therefore void.The fact that his failure to install the windows in our bedroom several months after we hired him was sufficient cause to fire him is confirmed by the fact that we subsequently hired another contractor who delivered the windows in 10 business days after signing a contract, who did not start any physical work on our house until he had the windows in hand, and who then installed TEN windows in our house in five business days from start to finish. Compare this to [redacted]'s failure to complete the installation of only FOUR windows after several months.[redacted]'s assertion that his cutting open of our walls was an attempt to "speed up progress" is absurd. He cut open the walls before he had any idea whether or when he would be able to obtain the windows we needed. His failure to contact the supplier in advance about the availability of our windowseven though he had months of time in which to make a single, simple phone call to the suppliercaused a significant delay, not a "speed up."Furthermore, [redacted]'s repeated references to the estimated delivery date of November 22, 2014 are false and misleading. The reason we fired [redacted] is that when we attempted to contact him, in advance of November 22, to confirm that the windows would arrive on November 22 as promised, he failed to return our phone calls. When we eventually tracked him down he admitted that he had not contacted the supplier since he first ordered the windows to ensure that the November 22 date would still be met. He subsequently contacted the supplier and told us that the windows would NOT arrive on November 22 and would be delayed. When we then asked him to provide ANY specific date on which he would install the windows, he became belligerent and refused to provide us with any specific date on which he would install the windows. This further delay, evasiveness, unprofessionalism, and belligerence was more than sufficient cause for us to fire him, particularly in light of his previous significant delay and negligence.We do not see any reason to respond to any further communications unless they include an offer to compensate us for the losses we incurred as a result of having to pay another contractor to complete the work that [redacted] failed to finish professionally and on time. Our damages include not only the additional payments we needed to make to the other contractor, but also the time during which we lost use and enjoyment of our master bedroom due to [redacted]'s significant delay, misrepresentations, and failure to perform the work in a manner consistent with industry standards.
