I am seeking a refund of $7500 for home repairs that were never started nor materials delivered
On June 27, 2019, I gave a $7500 cash deposit to the owner of T & R Renovations, ***. ***, ***, for renovations to be done on my home at ***, ***. The original quote for work to be done was $12,100, as indicated on Invoice *** of said business. The invoice additionally includes Mr
***'s signature attesting to the cash payment. I also have pictures of the cash exchange and bank withdrawal slips to coordinate dates and amounts. I have had many text and phone interactions with the owner in which he has promised to do the work he was paid to do to no avail. Repeated promises to begin repairs have been taking place, with last promise to install my garage roof being November 6, but still no work done. Repeated requests for a refund have been ignored, merely continued promises to do the work. On Saturday, October 5, 2019, the manager of ***, ***
at ***, ***, repossessed the construction trash bin, that had been delivered to my property in July per Mr. request, due to non-payment from Mr.. Mr. continued to promise work to be done on my home. I would like my money back so that I can make the repairs for which my insurance paid me to make. As a result of no work being done, I have also lost the recoverable depreciation of $838.62. I have the home adjuster report under claim number ***, *** Insurance, under former name of *** with date of loss May 27, 2019. A check in the amount of $6806.28 was made to me by *** Insurance and was used towards the cash deposit to Mr. on June 27, 2019. I have threatened legal action against Mr., but have not officially filed litigation. I am hoping this can be resolved outside of the court system first.

Desired Outcome

I would like a full refund of $7500. NOTHING has been done to my home, and I have no other means to make the needed repairs. Additionally, I have lost the ability to file an insurance claim if the garage roof collapses as a result of the non-repair. I do not want Mr. business to perform the needed repairs, as the business has proven untrustworthy.

August 2019, I payed $10,000 to *** to remodel my mobile home bathroom, kitchen and addition. A week later I got a better option on a new trailer. So I cancelled the work to be done on my mobile home. Mr. said I would have to pay a cancellation penalty and would have to wait for the materials he already purchased to be returned so I could get my refunded money. He has contacted me several times but no money. It has been 2 weeks since last contact. Have tried calling the business number. All I get is an automated message that all lines are busy. He told me I should be getting a refund of about $8000 after material returns.

Desired Outcome

I want the $8000 refund of my down payment.

Paid in full for a job that was originally scheduled for 2 weeks has taken over 8 months. Still unfinished w/ unacceptable work done.
Paid in full for a house remodel after sewer backup. Kitchen cabinets were never sanded and primed. Just painted a top white coat. Paint is peeling off already. Backsplash is crooked and missing tiles and or cracked. Base molding is unfinished. Electrical work is still unfinished and unsafe. Living room is finished. Paid for all new interior doors. Issue is that they never replaced frames. New doors - old frames will not work. So I have doors hung, but they do not fit and hardware is not installed. So no doors shut properly and missing handles. Bedroom on suite bathroom hasn't been touched. This was a complete remodel, including tiled floor, walls with walk in shower w/ a particular shower head we paid for. Hallway bathroom is done, but shower head leaks and faucet is coming off the wall. Whole house needs a second coat or paint. The company also was hired and paid in full to run new Pope from the house to the main line out back in our yard. This part was completed, but they tore up my putting green - totally destroyed it and have never come back to regrade and seed the backyard. So our yard is destroyed and putting green needs to be replaced due to the negligence of the subcontractors they hired. I have written text agreements and copies of checks we wrote to prove all this

Desired Outcome

Complete the work that was paid for in a time line that I agree to. Like I mentioned, this was to take 2 weeks and we started this process back in January. He keeps delaying delaying delaying this work. I read tonight online, that they're more homeowners like myself that he has wronged.

This business has promised to complete the work. Has even scheduled multiple times and dates to return, only to no show on all occasions. Without any communication, just will not show up. They are NOT in progress and have not been for over 4 months. This is completely another lie

Hired company Via owner*** at beginning of Aug to do flooring work to start on the 12th. On the 19th we added basement stair relocation and Kitchen remodeling to the job and later added siding. He informed us the whole job was going to take about 3-4 months. And the kitchen wouldn't be usable for about a month. He was asked not to demo till absolutely needed but he said he would be out next monday to start cutting into patio for stairs. He demo'd kitchen on 26Aug and disconnected my oven range power cable on 19th Sept. As of today he still hasn't completed moving the stairs to basement allowing him to remove old stairs and do work on kitchen. He didn't actually cut into concrete till the 5th of Oct. The rear entrance to the house is no longer there he has boxed it in with one window at knee height(needs to be raised). There is about a 9-10 inch portion all around the room totally open to outside not to mention gaps around window and corners of the room. No sheet rock, insulation to seperate my house from the frigid cold air outside. Haven't been able to cook on my stove sonce the 19th of sept. nor had a kitchen for about 7 weeks. He has only had people here for a total of 5 days since he demo'd the kitchen. And one of those was the electrician for only 1.5 hours. Since Oct 5th he hasn't been here one day. Though with the exception of 8th said he would be there and just never showed, called, texted. He has received $44,000.00 for a $45,000.00 job because he kept saying he couldn't order without more money, first the flooring then the siding the last 2500 was for the cabinets. To this day unsure if hes ordered anything.

Desired Outcome

Finish the job Commence working regularly 3-4 days a week and complete the tasked he's been paid for on the inside of house and complete the siding in spring as we agreed to on the 5th of October. If he is unable to do this return my $44000.00 and I will hire someone who can. Understand he has done some minor work but the drastic reduction in the use and value of my home and the fact that he hasn't completed one of the agreed tasks leave me with the feeling that he shouldn't receive compensation. I've never dealt with anyone who can say day after day that they are coming and not show up, call or text to inform that they will not be there. How much of my time am I supposed give up waiting for someone so inconsiderate?

Since the monday you contacted the company he has said he would be there every day except one and only came once. Left immediately and returned about 2 hours later and worked for 2 hours. So far that is it.

wouldn't have a problem with it if he actually came and did some work. The rest of this statement is copied from my daily log of contractors work or lack of it. This is immediately after he told me he was going to be at my house from early morning till late in the evening for the next two weeks.
11Nov, showed at about 0830 worked on sheet rock in room add. And*** was able to tighten down the ground wire to get electricity working better. Completed work for day between 1530 and 1600.
12Nov,*** showed up at about 0900 electrical company showed up at about 0930 and disconnected the power. *** installed new meter base and conduit and electrical company reinstated power about 1030. No other work done today
13Nov, Called *** at 1005 and he said he was too sick to work, asked about electrician to move box in stairwell. Said he would get back with me. Called back at 1035 told me electrician was sick also. Said he would try to get *** to come out and jackhammer second layer of concrete. They arrived at 1340 and worked till about 1530 or so not sure when they left but when I noticed the noise stopped and they were gone. *** said he would be back tomorrow to remove all the trash in my driveway.
14Nov,*** never showed said he would get a hold of electrician and call me back. Also said trash would be gone today. No call back no electrician and no one collected trash
15Nov, Called*** still can't get a hold of electrician, trash collection guys showed at about 1145 Not sure when done but gone when I went upstairs at 1445
16Nov, text *** twice to see if every day included weekends especially since he hadn't been here since Tues. but not answering. *** called at 1041 and said he wouldn't be in till Monday.
18Nov, No show called*** said he had a appt in the am but would be there in the pm to work on those stairs and the electrician was scheduled for tomorrow. *** never showed at all.
19Nov, No show not answering calls or texts, finally called in pm and said he needed another day to get better. Is he actually sick who knows, can't believe anything he says.
20Nov, nothing today,
21Nov, talked to*** at 0840, said he intends to come, never showed,*** text and said he was going to come tomorrow
22Nov,*** Called at 0935 said he was coming but had to get supplies, sheetrock and insulation, but would be there but not before lunch. Now 1400 still no one here.

has yet to 100% complete any one of the several items contracted. The projects were for 6 weeks, but its been 6 months and still no results
Two contracts for work created in April: 1) driveway, garage, sidewalks. 2) fence and landscaping. Total contracts was $39,2000. Deposit of $20,000 provided 5-1-19. All projects would be completed within 6 weeks, but no later than the end of June.He had only 4 other projects to work through before he could devote 100% of time on our projects.
Not one item of either contract is 100% complete.
The driveway was about completed (end of May) when *** informed us that he had spent our deposit on other projects and if we wanted the rest of our projects done, he would need $9000 CASH. He said that is how business works. We felt that we were under a contractor's ransom (no pay/no work). We also said that we considered him stealing our money to pay others but he insisted that that's normal practice and not stealing. *** guaranteed that with the additional $9000 payment, the work on our contracts would be completed within the week. We paid the additional demanded money on 5-29-19, of course it had to be in CASH.
After that additional payment, *** would not show up for work, he would not respond to telephone calls or messages, or respond to text messages asking for updates. His absent would run for weeks at a time. When he would finally show up for work, it was only for a day and then only a couple of hours. He would be absent for weeks at a time without any work or contact with us.
When *** did finally call, it was for money. He insisted that an additional $5200 was needed to pay one of his contractors or he wouldn't be able to finish my work. He wanted me to pay the contractor directly, but I said no I would pay him and *** would pay the contractor (even his contractor was calling me for this payment at ***'s request). The payment had to be in CASH. That demand for money was paid on 8-9-19. Again, *** would guarantee-even hand shakes-stating no my projects would be completed within the week.
Since that payment, he would not show up for work, return phone calls or answer any text messages.
*** would show up for work (again for only an hour or two) he insisted on more money to finalize the projects. Again, *** guaranteed that there would be no interruption of work on my property and that the entire project would be completed by the weekend if I paid $2000.We paid is demanded additional money of $2000, of course it had to be in CASH.
All money paid to *** totals $36,2000 of the $39200 contracts. demanded money had to be paid in cash, as there would be other contractors present when he would be paying them.
Items that still need completed:
1. Garage:
a. the west side of the garage still has exposed wood that needs properly covered to prevent rot.
b. the garage door opening has expose wood that needs properly covered to prevent rot
c. the garage door and opener still need installed
d. clean fill dirt applied around the garage, driveway, sidewalks, and fence to level the ground and allow grass to be grown
2. Driveway:
a. the end of the driveway has crack damage that still needs replaced/repaired.
b. the end of the driveway has a 4 inch lip to climb onto to access the driveway. That was to have blacktop there to level things out.
c. the turn around was built at such a slop downward (guessing about 40-50 degree slop) that needs to have stops placed at the end OR the turn needs to be redone to make level with the driveway
3. Fence:
a. Still need to have a few holes dug at proper locations
b. install pre-built fence
4. Landscaping:
a. need to remove all landscaping around house
b. removal of tree stumps
c. removal of clothes line
d. install weed bed
e. mulch
Sidewalk:
a. one area close to garage side door has excessive cement attached to the brick of the landscaping that needs removed.
Trash:
a. trash is left in piles on property including nails, damaged building material, piles of cement etc. that needs removed.

Desired Outcome

I have been asking nicely for months to have my projects completed, but *** would provide excuse after excuse as to why he cannot finish my projects. He would say he has too many projects to work on at one time, he has issues with employing people, he cannot find someone to sub-contract out tasks, rain fell through the night, the wind is blowing, he has family issues. *** said he had only 4 other projects when my project was contracted and that's the reason for it to take 6 weeks. It now been 6 months and still not one of the contracted items is 100% completely done. I even offered *** to DOUBLE the amount I owed him if he would finish the job within a week (as he kept telling me he can finish the entire job within a week). He did not respond to my offer. I requested a refund of $10000 to allow other contractors to finish the work that still needs to be completed. He has not responded to my request. My thoughts are that he is steeling my money to pay other projects and committing fraud, but *** says that is not true and that this practice is how business works. Not to my opinion. *** will lie to your face making promises of coming to work the next day and never show up for weeks at a time and during his absences, he would not respond to phone calls or text messages unless he was demanding more money (my estimation this is considered a contractor's ransom). In my opinion from his business practices I've experienced with him, he is one that will tell you the check is in the mail, but he would never place the check in the mail and blame the postal service for not delivering the mail.

contractor has only showed up sporadically in 3plus months. promised job completion 2-3 weeks.
about 1 1/2 ago I hired fourth generation installition (rob eberle jr) to do work for me on a house. after a year of him not finnishing and many issues of not doing the work I stopped work relations with him. while I was looking for a new contractor to finnish the work his father called me. (rob eberle sr) (T & R Renovations) and asked if he could come look at the house and work needing done. I said ok. he came over with a crew of 7-8 guys and told me he could do this job for me and told me how good his company was and proceeded to tear apart most of the work his son/company did, tore old landscaping up, all before we singed a contract. two days after they started this and making me think they were there till it was finished I signed a contract and gave him $7000 for materials to complete job. after he received the money he disappeared for 2 months. left the yard tore up spouting laying in yard killing grass and piles of what they tore up laying in yard. I tried for the 2 months to contact him and rearly would reply or answer phone and when he did would tell me hes behind on work or low on help, which was completely different until I gave him money. after 2 months he sporadically had some people ther off and on. 3 and 1/2 months now and has told me and a realtor approximately 20-30 times "we'll be done in a week or "I swear we'll be there next week" and NEVER shows up. the times I have talked to him he has NEVER told me the truth, when I do talk to him he assures me it will be done by the end of next week! for 2 months its been same thing "we'll be done next week".

i would like the job finished but honestly dont think the contractor can finnish the job, his reasons, not enough help. or has an issue with me for firing his son. tried many times to ask him why he wont finish the but never a straight answer.if he cant do the job like the contract calls for i want the materials. siding, innsullation,front and back porch marerial, garage door. and a reply of we'll be there to finnish is unaccepable as he has said that 20-30 times in 3 plus months and never shows. only acceptable answer is to be there and do it.

the business said the job would be completed in 2-3 weeks. it is now going on 5 months and in the last 6 weeks has worked on it an average of 1 day a week. the response of in the process of working on the house woulfd be ok but 1 day a week and now 5 months is unacceptable

collected $6000 for materials and labor to complete a bathroom renovation and electrical work. Work was not done, materials not delivered.
*** collected money up front to cover the cost of materials for a bathroom remodel and to install junction boxes in my attic for electrical connections. I have the canceled checks and a breakdown of the cost of work he did prior to March 28, 2019 when I wrote a check for $5000. H e never delivered the materials and repeatedly rescheduled the start date for the project. In June, I told him I no longer wanted him to do the work because he did not deliver on his promises. I gave him 30 days to refund me $6000. He asked for another 30 days with a hard deadline of August 9, 2019. He did not deliver the refund and said I would have it in my mailbox on Saturday August 17. His refund did not arrive and he is not communicating with me any longer.

He is not working with me to resolve the issue. He says "the check is in the mail", but no check has ever arrived. He has not refunded anything and his subcontractor is trying to collect money from me that I paid to ***.

The business did not agree to send check because there wasn't an agreement on the price. The consumer is requesting more money than the business believes she is owed. It is difference of $500.

*** agreed to refund $3000 in writing. I have not received anything since. I will drop the matter if I get a check for $3000.
